Van Nuys Creditor Harassment Lawyer

The Van Nuys courthouse in the San Fernando Valley is where many Valley residents end up when a collection firm decides to sue, and the calls, letters, and workplace contacts that lead there often cross legal lines long before a summons arrives. Wadhwani & Shanfeld is a consumer bankruptcy and debt relief law firm that represents people in Van Nuys, the surrounding San Fernando Valley, and throughout Los Angeles, Orange, Riverside, and San Bernardino Counties who are being pressured by creditors and debt collectors.

If you need a Van Nuys creditor harassment lawyer, the first thing to know is that California gives you more protection than most states. The Rosenthal Act reaches original creditors as well as third-party collectors, so the bank, card issuer, or medical provider that holds your account is bound by the same rules as the agency it hires.

Harassment is not just an annoyance. It can push people into paying debts they do not owe, debts that are too old to sue on, or amounts inflated by fees. It can also cost a job when collectors call a workplace. Knowing which conduct is unlawful, and which tools actually end it, changes what you do next.

What the Rosenthal Act Gives You When a Collector Crosses the Line

California’s Rosenthal Fair Debt Collection Practices Act, found in Civil Code sections 1788 through 1788.33, is the main state law behind most harassment claims. A consumer who proves a violation can recover actual damages. If the court finds the collector acted willfully and knowingly, it can add a penalty between $100 and $1,000. A consumer who prevails can also recover reasonable attorney fees, which is why many harassment cases can be pursued without the client paying out of pocket.

Two limits matter. The deadline to sue under the Act is one year, so waiting costs you leverage. And the Act allows individual actions only, not class actions. A collector also gets a narrow safe harbor: if it discovers a curable violation, or receives written notice of one, and notifies you and fixes it within 15 days, it can avoid liability for that violation. That is one reason written documentation of every contact matters.

Why Choose Wadhwani & Shanfeld for Creditor Harassment Problems in Van Nuys

Wadhwani & Shanfeld has helped more than 30,000 individuals and families across Southern California deal with debt, and the firm is led by two Board-Certified Specialists in Consumer Bankruptcy through the American Board of Certification. Raj Wadhwani, a founding shareholder and partner, is a Southwestern Law School graduate who helped pilot the Best Case Bankruptcy software in 1998 and was the first attorney to file a bankruptcy case electronically in the Central District of California. Greg Shanfeld, also a founding shareholder and partner, earned his law degree from the University of Southern California and has handled more than 10,000 bankruptcy cases over three decades. Together the firm brings more than 90 years of combined legal experience.

That background matters for harassment because the fastest cure is often not a lawsuit against the collector but a bankruptcy filing. The firm files in every division of the U.S. Bankruptcy Court for the Central District of California, and it handles Chapter 7, Chapter 13, debt settlement, wage garnishment, creditor lawsuits, foreclosure defense, and IRS tax debt. Because it offers the full range, the recommendation depends on your situation, not on the only service a firm happens to sell.

Clients get direct access to an attorney from the first call, a free consultation, and fast action when a garnishment, foreclosure sale, or repossession is days away. Cases can be handled entirely by phone, email, video, and online chat, with 100% virtual consultations available, so you do not have to leave work or home to get answers.

Common Forms of Creditor Harassment We See

  • Relentless Phone Campaigns: Repeated calls at all hours, calls to relatives, or calls to your employer after you have said the workplace is off limits. Under the Rosenthal Act, original creditors face these limits too, not just collection agencies.
  • Collection Lawsuits from Volume Filers: Firms that represent creditors in Southern California, including Hunt & Henriques, Reese Law Group, and Patenaude & Felix, file large numbers of suits. Missing the response deadline lets a court enter a default judgment.
  • Collecting Time-Barred Debt: A written contract debt generally carries a four-year window to sue, and an oral contract debt two years. Collectors still call on older accounts and sometimes push a small payment to make the debt look alive.
  • Wage Garnishment Threats and Overreach: A garnishment on an ordinary judgment is capped by statute, and a collector who threatens more than the law allows, or threatens garnishment with no judgment, may be violating the Act.
  • Bank Account Levies: After a judgment, a creditor can levy a deposit account. California automatically shields a set amount in a deposit account without any claim being filed, but that protection does not cover every kind of levy.
  • Misleading or Threatening Letters: Letters that imply a lawsuit is coming when none is planned, overstate what you owe, or mimic court documents.
  • Repossession and Deficiency Pressure: After a vehicle is taken, lenders sometimes demand a deficiency without sending the required notice on time, which can defeat the claim.
  • Foreclosure-Related Contact: Servicers and second-lien holders who pursue borrowers aggressively while a notice of default or sale is pending.

What to Do Right Now When Collectors Will Not Stop

Start by keeping a log. Write down the date, time, caller, number, and what was said, and save every voicemail, letter, text, and envelope. A harassment claim is built on specifics, and the one-year deadline under the Rosenthal Act means you want a clean record while memories are fresh. Do not ignore any court papers. If you have been served with a summons, the clock to file a written response is short, and an expired limitations period is a defense you must actually raise in that response or the court can still enter judgment.

Be careful about paying anything on an old account. A payment cannot revive a debt that is already time-barred, but collectors may try to get you to sign a written acknowledgment, and a signed writing can restart the clock. Do not sign or agree to anything on a call you did not initiate until someone has reviewed the account.

If you are sued, civil collection cases in Van Nuys are heard at the Van Nuys courthouse of the Los Angeles County Superior Court. If the case has already reached judgment, remember that a California money judgment is enforceable for 10 years and can be renewed, although recent reforms limit renewal to one time, for five years, on certain medical expense and personal debt judgments under the stated dollar caps. A judgment is not a reason to give up. Wage garnishments, levies, and liens are all things to address quickly.

The most direct path to stopping the contact is the automatic stay. The moment a Chapter 7 or Chapter 13 petition is filed, most collection calls, lawsuits, garnishments, bank levies, repossessions, and foreclosure proceedings must stop. For Van Nuys residents, bankruptcy cases are typically filed in the San Fernando Valley Division of the Central District, though the filing division is set by your street address zip code, and our attorneys confirm that before filing. Call before your response deadline, garnishment date, or sale date passes.

Garnishments, Levies, and Judgments: The Harassment That Hits Your Paycheck

Wage garnishment on an ordinary judgment is limited by CCP section 706.050 to the lesser of two figures: 20% of your weekly disposable earnings, or 40% of the amount by which those earnings exceed 48 times the minimum hourly wage. If you are paid biweekly, semimonthly, or monthly, the multiplier becomes 96, 104, or 208 instead of 48. If a local minimum wage is higher than the state rate, the local rate is used in the calculation, which can matter for Los Angeles workers. You can also ask the court to exempt the portion of your earnings proven necessary to support you and your family.

Your job is protected in a narrow but important way. Labor Code section 2929 bars an employer from firing you because your wages are garnished for a single judgment. Filing Chapter 7 or Chapter 13 stops most garnishments as soon as the case is filed.

Bank levies work differently. A set amount in a deposit account is automatically protected, and the bank must apply it before sending money to the levying officer, with no claim of exemption required. That protection does not apply to levies for wages owed to another person, child or spousal support, or debts owed to the state.

Keeping Your Property While Collectors Push

California does not use the federal exemption list. A filer chooses between two state systems, either the CCP section 704 system or the section 703.140(b) system, and must use one for the entire case. The 704 system carries a homestead exemption that is the greater of the prior-year countywide median single-family sale price (subject to a ceiling) or a statutory floor, and these figures adjust annually for inflation. The 703.140(b) system uses fixed dollar amounts, including exemptions for a residence, a motor vehicle, tools of the trade, and a wildcard, and those amounts are adjusted every three years. To use California’s exemptions you must have lived in the state at least 730 days.

Choosing the right system is one of the most consequential decisions in a case, and it depends on whether you own a home, how much equity you have, and what else you need to protect. It is a decision our board-certified attorneys make with each client before anything is filed.

Van Nuys Creditor Harassment Questions Answered

Is a creditor allowed to call me at work?

Not if you have told them not to or they know your employer prohibits it, and the Rosenthal Act’s rules on harassing and embarrassing contact apply to original creditors as well as collection agencies. Tell the collector in writing to stop contacting you at work and keep a copy.

Can I sue a collector for harassment?

Yes. You can seek actual damages, plus an additional $100 to $1,000 if the collector acted willfully and knowingly, and a prevailing consumer can recover reasonable attorney fees. The suit must be filed within one year.

Does the Rosenthal Act apply to the bank that issued my card?

Yes. Unlike the federal FDCPA, the California law reaches original creditors, not just third-party debt collectors.

How long can a creditor sue me on an old debt?

Four years on a written contract or book account, and two years on an oral contract. The deadline is a defense you have to raise in a written answer; a judge will not automatically apply it for you.

If I make a small payment on an old debt, does it restart the clock?

A payment cannot revive a debt that is already time-barred. A signed written acknowledgment of the debt, however, can restart the period, so do not sign anything a collector sends without having it reviewed.

Will bankruptcy stop the calls?

Yes. The automatic stay takes effect the moment your petition is filed, and creditors must stop collection activity. Collectors who keep contacting you after notice of the filing may be violating federal law.

What if a collector gets a judgment against me before I call?

A judgment can be enforced for 10 years and is typically followed by wage garnishment or a bank levy. Bankruptcy can stop most of that, and there may be defenses to the judgment itself, so call as soon as you learn it was entered.

Can my employer fire me if my wages are garnished?

Not for a single judgment. Labor Code section 2929 prohibits termination because wages are garnished for one judgment.

Is it worth hiring a lawyer if the debt is small?

Often yes, because fee-shifting under the Rosenthal Act means a violation claim does not depend on the size of the debt. A free consultation costs nothing and tells you whether you have a claim or a bankruptcy option.

What if the collector says it will fix the violation?

A collector that corrects a curable violation within 15 days of discovering it or receiving written notice may avoid liability for it. That is why the timing and form of your notice matter and why having an attorney send it is worth considering.

Do I need to come to an office to get help?

No. The firm handles cases fully by phone, email, video, and online chat, and 100% virtual consultations are available for clients anywhere in Southern California.
