Orange County Bankruptcy Lawyer
Bankruptcy filings for Orange County residents go through a single federal courthouse, the Santa Ana Division of the U.S. Bankruptcy Court for the Central District of California, while the creditor lawsuits that often come first are heard in the county’s Superior Court. Knowing which court controls which part of your problem shapes every decision about timing. Wadhwani & Shanfeld is a consumer bankruptcy and debt relief law firm that handles Chapter 7, Chapter 13, debt settlement, foreclosure defense, wage garnishment, and creditor lawsuits for individuals and families across Orange County and the rest of Southern California.
An Orange County bankruptcy lawyer has to do more than file forms. The right chapter depends on your income against the California median, whether you own a home in a county where equity can be substantial, how far behind you are on a mortgage or car loan, and whether a garnishment or bank levy is already draining your paycheck. Some people need Chapter 7, some need Chapter 13, and some are better off with a negotiated settlement or no filing at all. Getting that call right before anything is filed is most of the work.
Why Choose Wadhwani & Shanfeld for Orange County Bankruptcy Cases
Founding shareholders Raj Wadhwani and Greg Shanfeld both hold that certification through the American Board of Certification, a credential earned by a small fraction of attorneys nationally. Together with their associate attorneys, the firm brings more than 90 years of combined legal experience to Orange County filers in Anaheim, Santa Ana, Irvine-area communities, Huntington Beach, and beyond.
Raj Wadhwani, a Southwestern Law School graduate, helped pilot the Best Case Bankruptcy software in 1998 and was the first attorney to file a bankruptcy case electronically in the Central District of California. That familiarity with the court’s filing systems matters when a sale date or levy is close and a case has to be prepared quickly. Greg Shanfeld earned his law degree from the University of Southern California and has handled more than 10,000 bankruptcy cases over three decades. The firm files in every division of the Central District, including Santa Ana.
Clients reach an attorney directly from the first call, not an intake screener, and the consultation is free. The firm acts fast when a garnishment, foreclosure sale, or repossession is days away, and it handles cases fully by phone, email, video, and online chat, with 100% virtual consultations available. Because the firm also practices debt settlement, loan modification, and IRS representation, the recommendation is based on what fits your situation rather than on the only service on offer.
Debt Situations That Bring Orange County Residents to Bankruptcy Court
- Credit Card and Medical Debt: Unsecured balances are the core of most Chapter 7 cases. When high living costs push households onto cards to cover rent and groceries, these balances are generally dischargeable, and medical bills after an illness or injury are treated the same way.
- Creditor Lawsuits and Judgments: Collection firms file in Orange County Superior Court, and a default judgment can lead to wage garnishment or a bank levy. Filing bankruptcy halts those lawsuits and enforcement through the automatic stay.
- Mortgage Arrears and Foreclosure: Homeowners who fall behind can use Chapter 13 to stop a scheduled sale and spread missed payments over a plan lasting three to five years. In some cases a wholly unsecured second mortgage can be stripped off.
- Car Loan Defaults and Repossession: A repossession deficiency, the balance owed after the vehicle is sold, is an unsecured debt that Chapter 7 can eliminate. Chapter 13 can let you keep a car you are behind on.
- IRS and Tax Debt: Some older income tax debt can be discharged if it meets specific timing rules, while recent taxes are priority debts that Chapter 13 can organize into payments. The firm also negotiates with the IRS outside of bankruptcy.
- Personal Loans and Payday Loans: These unsecured debts are generally dischargeable, which matters for people who borrowed to cover a gap and found the payments unmanageable.
- Student Loans: Most student loans generally cannot be discharged in bankruptcy, so the firm approaches them through separate repayment strategies while eliminating other debt that is competing for your income.
- Small Business Debt: Owners whose businesses did not work out often carry personal guarantees. The firm handles small business bankruptcy and business debt solutions.
What to Do Right Now When Creditors Are Closing In
The most urgent step is to find your next deadline. If you were served with a summons from a collection firm, your response deadline is short, and a missed deadline can mean a default judgment. An expired limitations period is also a defense you must raise in a written answer; a court can still enter judgment if you stay silent. For written contract and book account debt, suits generally must be filed within four years, and for oral contracts, two. A payment does not revive a debt that is already time-barred, and only a signed written acknowledgment can restart the clock, so be careful about what you sign or agree to on a collector’s call. Lawsuits are filed in Orange County Superior Court, whose civil matters are heard at the Central Justice Center in Santa Ana, the Civil Complex Center in Santa Ana, and other county justice centers.
If a foreclosure is underway, the dates are fixed by statute. A sale cannot be set earlier than three months and 20 days after the notice of default is recorded, and the notice of sale must be mailed and posted at least 20 days before the sale. You can reinstate a monetary default until five business days before the sale, which is why the window for choosing between reinstatement and a Chapter 13 plan is narrower than most people assume. For repossession, the lender must give at least 15 days’ written notice before disposing of the vehicle, and you can ask in writing to extend the redemption period by 10 days.
Gather your most recent pay stubs, tax returns, bank statements, a list of every creditor and collection letter, and any mortgage or car loan paperwork. Do not move money or transfer property to family, and do not pay one creditor in a lump sum right before filing without talking to an attorney first. Garnishments on ordinary judgments are capped by a formula tied to your disposable earnings and the minimum wage, and an employer cannot fire you because of a garnishment on a single judgment, but a garnishment can still take a painful share of each paycheck. Filing Chapter 7 or Chapter 13 stops most of them when the case is filed. Orange County filers file with the Santa Ana Division, and the firm handles the entire process remotely or in person.
California Exemptions: What You Keep When You File in Orange County
California has opted out of the federal exemption scheme, so filers choose one of two state systems for the entire case: the standard exemptions under CCP § 704 or the alternative system under § 703.140(b). The choice is among the most consequential in a case. The § 704 system includes a homestead exemption that is tied to the prior year’s countywide median single-family home price, within a statutory floor and ceiling that adjust annually for inflation. That structure can be especially important in a county with high home values, and it is why equity analysis comes before any Chapter 7 filing. The § 703.140(b) system has much smaller dedicated amounts for a residence and vehicle but adds a flexible wildcard that often suits renters and people without real estate.
To use California’s exemptions you must generally have lived in the state at least 730 days. The § 703.140(b) amounts adjust every three years, and the homestead floor and cap adjust each year, so the figures should be confirmed against current law at your consultation rather than assumed. Retirement accounts, household goods, tools of the trade, and a vehicle are typically protected under one system or the other. For a bank account, California also applies an automatic deposit account exemption on levies by a bank, without a claim of exemption, though it does not reach levies for support or debts owed to the state.
Chapter 7 or Chapter 13: Choosing Between Them
Chapter 7 wipes out qualifying unsecured debt, and most cases finish in roughly four months. You qualify through the means test, which compares your household income to the California median for your household size and then accounts for your actual expenses. Despite the label “liquidation,” the vast majority of the firm’s clients keep everything they own because of the exemptions above.
Chapter 13 is built for people with steady income who need structure. Your debts are reorganized into one monthly payment over three to five years, and creditors are bound once the court confirms the plan. It fits borrowers behind on a mortgage or car loan, people over the Chapter 7 income limits, and those with priority tax debt, support arrears, or equity beyond what exemptions cover. Prior filings affect timing: eight years between Chapter 7 cases, four years to file Chapter 13 after a Chapter 7, and two years between Chapter 13 cases. After a Chapter 13, the wait to file Chapter 7 is generally six years, shortened if the plan paid enough to unsecured creditors.
Orange County Bankruptcy Questions, Answered
How quickly does filing stop collections?
The automatic stay takes effect the moment the petition is filed. Lawsuits, garnishments, bank levies, repossessions, and foreclosure proceedings must stop. In an emergency the firm can often prepare and file a case quickly to stop a sale or levy.
Will I lose my house in bankruptcy?
Most clients keep their homes. In Chapter 7 the question is whether your equity is covered by the homestead exemption and whether you are current on the mortgage. If you have more equity than the exemption protects or you are behind, Chapter 13 lets you keep the home and catch up over time.
Which debts can bankruptcy eliminate?
Credit cards, medical bills, personal loans, payday loans, and deficiency balances after a repossession or foreclosure are generally dischargeable, as is some older income tax debt. Child support, alimony, most student loans, most government fines, and debts from injuries caused by drunk driving generally are not.
How long does bankruptcy stay on my credit report?
A Chapter 7 can remain for up to 10 years from filing, and the bureaus typically remove a Chapter 13 after seven. The effect on your score fades well before then, and many clients see recovery begin within the first year with careful use of a secured card and on-time payments.
Do I have to come into an office?
No. The firm handles cases entirely by phone, email, video, and online chat, and virtual consultations are available. In-person meetings are available if you prefer.
Will my employer find out?
Not automatically. They may learn if they are a creditor, if a garnishment must be stopped, or if Chapter 13 payments are deducted from your paycheck. An employer cannot fire you solely because you filed for bankruptcy.
My judgment is old. Can the creditor still collect?
A California money judgment is enforceable for 10 years from entry, after which enforcement ceases and liens from enforcement are extinguished. A creditor can renew it, but for medical judgments with unpaid principal under $200,000 and personal debt judgments under $50,000, renewal is limited to one time for five years.
Can a collector be held accountable for harassment?
Under California’s Rosenthal Act, a consumer can recover actual damages, plus $100 to $1,000 more if the collector acted willfully and knowingly, and a prevailing consumer can recover attorney fees. The Act covers original creditors as well as third-party collectors, the suit must be brought within one year, and a collector can avoid liability by correcting a curable violation within 15 days of learning of it.
Can a paralegal or notary file my case instead of a lawyer?
A petition preparer can type your information into forms but cannot give legal advice, choose exemptions, or represent you if a trustee or creditor raises a problem. Mistakes can cost you property or your discharge.
Is it worth hiring a lawyer if I have a small amount of debt?
Often it is worth at least a consultation. The firm will tell you honestly if bankruptcy is not the right answer, and options like settlement or negotiation may resolve smaller debts without a filing.
What if I am being sued by a collection firm right now?
Call before your response deadline passes. The firm can explain whether to answer the suit, negotiate a resolution, or file bankruptcy, and can help with judgments that have already been entered.
