Anaheim Student Loan Debt Lawyer

Wadhwani & Shanfeld is a consumer bankruptcy and debt relief law firm that helps Anaheim residents and families across Orange County, Los Angeles County, Riverside County, and San Bernardino County deal with the debts that have taken over their budgets, including federal and private student loans. If you are looking for an Anaheim student loan debt lawyer, the first thing worth knowing is that student loans are not one problem. A federal loan, a private bank loan, and a loan that went to a collection agency are governed by different rules, and the right move for one can be the wrong move for another.

Student loans are also the debt most people assume bankruptcy cannot touch. That assumption is half right. Most student loans are not wiped out in a standard bankruptcy discharge, but filing can still change your situation dramatically by eliminating the credit cards, medical bills, and personal loans that compete with your student loan payment for every paycheck. For many Anaheim households, the student loan is only one piece of a larger pile, and clearing the rest is what makes the loan manageable.

The loan holder’s behavior matters too. A private lender or a collector that has sent a demand letter or filed a lawsuit can be dealt with through defenses, negotiation, or bankruptcy, while a federal loan in default calls for a different conversation about repayment options. Sorting out which kind of debt you actually have is where a useful consultation begins.

Why Choose Wadhwani & Shanfeld for Student Loan Debt Problems

The firm is led by two Board-Certified Specialists in Consumer Bankruptcy through the American Board of Certification, and together the team brings more than 90 years of combined legal experience. That specialization matters for student loan questions because the answers usually sit at the boundary between bankruptcy law, creditor law, and negotiation, and the firm handles all three rather than offering only one tool.

Raj Wadhwani, a founding shareholder and partner, graduated from Southwestern Law School, helped pilot the Best Case Bankruptcy software in 1998, and was the first attorney to file a bankruptcy case electronically in the Central District of California. Greg Shanfeld, also a founding shareholder and partner, earned his law degree from the University of Southern California and has handled more than 10,000 bankruptcy cases over three decades. The firm files in every division of the U.S. Bankruptcy Court for the Central District of California, which is the court that handles Orange County filers.

Clients get direct access to an attorney from the very first call, free consultations, and the option to handle everything remotely by phone, email, video, and online chat, including 100% virtual consultations. When a garnishment, foreclosure sale, or repossession is days away, the firm acts fast. Because the firm also handles debt settlement, creditor lawsuits, wage garnishment, IRS tax debt, and loan modification, your recommendation is based on what fits your finances, not on the only service a firm happens to sell.

Student Loan Situations We See From Orange County Borrowers

  • Federal Student Loans in Default: A federal loan that has gone unpaid long enough can lead to collection pressure and, in some cases, garnishment of wages. The approach depends on the loan type and your income, and the options differ from anything available for private debt.
  • Private Student Loans: Loans from banks and private lenders are contracts, so ordinary debt defenses apply. A written contract claim generally carries a four-year limitations period under California law, and a lender that waits too long can lose the right to sue.
  • Student Loan Debt Sold to Collectors: Private loans are frequently sold or assigned, and the new holder may struggle to document ownership. Those gaps can be leveraged in a lawsuit or a settlement negotiation.
  • Student Loans Alongside Credit Card and Medical Debt: Borrowers often carry several debts at once. Chapter 7 can eliminate qualifying unsecured debt like credit cards, medical bills, and personal loans, freeing income to address the loan that remains.
  • Chapter 13 for Borrowers With Steady Income: If your income is above the Chapter 7 means test limits or you are behind on a mortgage or car loan, a three-to-five-year plan can consolidate what you owe into one payment while you keep your property.
  • Wage Garnishment From a Judgment: When a private lender wins a judgment, ordinary garnishment is capped by a formula tied to your disposable earnings and the minimum wage, and you can ask the court to exempt more if you prove it is needed to support your family.
  • Bank Account Levies: A judgment creditor can levy a bank account, though California automatically protects a set amount in deposit accounts without any claim being filed.
  • Co-Signed Loans: Parents and relatives who co-signed a private loan face the same collection risk as the student, and their own financial picture may point to a different solution.

What to Do Right Now If Student Loan Collectors Are Closing In

Start by identifying exactly who holds each loan and what kind it is. Pull your most recent statements and any letters or emails from servicers, lenders, or collection agencies, and write down dates of your last payment and any written communication. That information drives almost every decision that follows. A federal loan and a private loan call for different strategies, and the date of your last payment can decide whether a lawsuit is even timely.

If you have been served with a summons and complaint, do not ignore it. The expired filing deadline is a defense, but it only helps if you raise it in a written answer. A court can still enter judgment against someone who simply does not respond. Orange County cases of this kind are heard by the Superior Court, and if the case is not answered by the deadline printed on the summons, you can lose the chance to defend it. Call before that date passes so an attorney can tell you whether to answer, negotiate, or file bankruptcy.

Be careful about what you say and sign. A signed written acknowledgment of an old debt can restart the limitations clock, though a payment alone cannot revive a debt that is already time-barred. Collectors sometimes push for a small “good faith” payment or a signed agreement for exactly this reason. Do not agree to anything on a collection call until you know where the debt stands.

If you are considering bankruptcy, filing creates an automatic stay that halts most lawsuits, garnishments, and bank levies the moment the petition is filed. Orange County filers file in the Santa Ana Division of the U.S. Bankruptcy Court for the Central District of California, and your home zip code determines the division. Gather pay stubs, tax returns, bank statements, and a list of your property so we can run the means test and decide which exemption system protects you best. California filers choose between two state exemption systems rather than the federal one, and that choice is one of the most consequential decisions in a case.

How Bankruptcy Treats Student Loans and the Debts Around Them

Federal and private student loans generally survive a standard Chapter 7 discharge, which is why honest advice starts by separating what bankruptcy can and cannot do. What it can do is eliminate credit cards, medical bills, payday loans, personal loans, and repossession deficiencies, often within roughly four months. For a borrower whose income is stretched thin across ten creditors, removing nine of them can turn an impossible budget into a workable one.

Chapter 13 works differently. Your debts are reorganized into a single monthly payment over three to five years, and creditors are bound once the court confirms the plan. It is the usual choice for borrowers who earn too much for Chapter 7, who are behind on a house or car, or who owe priority debts like back taxes or support arrears that Chapter 7 cannot clear. Many homeowners also use it to catch up on a mortgage and stop a scheduled foreclosure sale.

Protecting property is a central part of the analysis. California’s homestead exemption is based on county median home prices with a statutory floor, and the alternative system offers a smaller residence protection plus a flexible wildcard that often suits renters. We work through every available exemption before you file, and most clients keep everything they own.

Not every situation calls for bankruptcy. Debt settlement lets us negotiate directly with a lender to resolve a debt for less than you owe, and in the right case that is the cleaner path for a private student loan. If a collector has violated California’s Rosenthal Act, which covers original creditors as well as collection agencies, you may also have claims of your own, with a one-year window to bring them.

Anaheim Student Loan Debt Questions Answered

Can student loans be discharged in bankruptcy?

Most student loans are not eliminated in a standard bankruptcy discharge. The more practical benefit is that bankruptcy can erase the other unsecured debts that are consuming your income, and Chapter 13 can restructure what you owe into one affordable payment. We review your loans and your finances to tell you honestly what bankruptcy can accomplish in your situation.

Is there a difference between federal and private student loan collection?

Yes, a significant one. Private student loans are ordinary contracts, so limitations periods, lawsuits, judgments, and settlement negotiation all work the way they do for other consumer debt. Federal loans follow their own collection rules and repayment programs. Knowing which category your loan falls into is the first step in any strategy.

How long can a private lender wait to sue me in California?

For a written contract, California generally allows four years under the Code of Civil Procedure, and two years for an oral contract. The clock depends on the facts, including when you last defaulted. Expiration is a defense you must raise in a written answer, because a court can still enter judgment if you do not respond.

Will making a small payment restart the clock on an old loan?

A payment cannot revive a debt that is already time-barred in California. A signed written acknowledgment of the debt, however, can restart the period. Be cautious about signing anything a collector sends you until you know the age and status of the debt.

Can my wages be garnished for a student loan?

If a private lender wins a judgment, it can seek a wage garnishment. On an ordinary judgment, the amount is capped at the lesser of 20% of weekly disposable earnings or 40% of the amount by which weekly disposable earnings exceed 48 times the minimum hourly wage, using a higher local minimum wage if one applies. Filing Chapter 7 or Chapter 13 stops most garnishments when the case is filed.

What if a lender already has a judgment against me?

A California money judgment is enforceable for 10 years from entry and can be renewed, though recent law limits renewal to one time, for five years, on certain personal debt and medical judgments below stated dollar amounts. A judgment does not mean you are out of options. Bankruptcy can stop enforcement, and a claim of exemption can protect part of your earnings.

Does my bank account get frozen if I’m sued over a student loan?

Only after the creditor has a judgment and levies the account. California automatically protects a set amount in a deposit account without you filing a claim, and the bank must apply it before turning money over. That protection does not apply to certain levies, such as for child or spousal support or debts owed to the state.

I co-signed my child’s student loan. Am I at risk?

Yes. A co-signer is fully liable on a private loan and can be sued, judged, and garnished just like the borrower. Your own finances may point to a different solution than your child’s, so each person’s situation deserves its own review.

Is it worth hiring a lawyer if my loan balance is small?

Often yes. A lawsuit you do not answer can become a judgment with years of enforcement, and a small loan is frequently only one of several debts. A free consultation costs nothing and tells you whether a defense, a settlement, or a bankruptcy filing makes sense.

Can I handle all of this without coming into an office?

Yes. We handle cases fully by phone, email, video, and online chat for clients anywhere in Southern California, and consultations can be 100% virtual. Anaheim clients are welcome to meet in person if they prefer.

Will my employer find out if I file bankruptcy over my debts?

Not automatically. They may learn of it if they are a creditor, if garnishments must stop, or if Chapter 13 payments are deducted from your paycheck. California law also bars an employer from firing you because your wages are garnished for a single judgment.
