Cerritos Chapter 7 Bankruptcy Lawyer

Wadhwani & Shanfeld is a consumer bankruptcy and debt relief law firm that helps Cerritos residents and families across Southern California get out from under credit card balances, medical bills, personal loans, and collection lawsuits through Chapter 7, Chapter 13, and debt settlement. The firm has helped more than 30,000 individuals and families, and clients in Los Angeles County and Orange County reach an attorney directly from the first call.

A Cerritos Chapter 7 bankruptcy lawyer does more than fill in forms. The real work happens before anything is filed: deciding which of California’s two exemption systems protects your property, checking whether your income clears the means test, and timing the petition so a garnishment, bank levy, or sale date is stopped before it does damage. Chapter 7 wipes out qualifying unsecured debt, usually in roughly four months, and most filers keep everything they own.

Cerritos sits on the line between Los Angeles and Orange Counties, and many households here have debts, jobs, and creditors in both. That does not change where your case is filed. The street address where you live decides the bankruptcy division, and getting that right at the start avoids avoidable delays.

What a Chapter 7 Attorney Actually Does Before You File

The petition is the last step, not the first. An attorney handling a Chapter 7 case spends the early work on questions that determine whether the filing succeeds.

First, the means test. Your household income is compared to the California median for a household of your size, and if you are above it, your allowed expenses are worked through to see whether you still qualify. Mistakes here can get a case challenged or converted.

Second, exemptions. California has opted out of the federal exemption scheme, so you choose one of two state systems for the entire case. One favors homeowners with real equity. The other offers a flexible wildcard that often suits renters and people with little home equity. You cannot mix and match, and you generally must have lived in California for at least 730 days to use the state exemptions. We work through both systems against your actual assets before recommending one.

Third, creditor review. Not every debt is dischargeable. Child support, alimony, most student loans, most government fines, and debts from injuries caused by drunk driving generally survive. Some older income tax debt can be eliminated if it meets specific timing rules. Knowing which of your debts fall where shapes the whole decision about whether Chapter 7 is the right tool.

Why Choose Wadhwani & Shanfeld for Chapter 7 Filings in Cerritos

Wadhwani & Shanfeld serves clients throughout Los Angeles County, Orange County, Riverside County, and San Bernardino County, with Cerritos and the surrounding Gateway Cities communities among them. The firm is led by two Board-Certified Specialists in Consumer Bankruptcy through the American Board of Certification, a distinction earned by a small fraction of attorneys in the country. You get direct access to an attorney from your very first call, free consultations, and the option to handle everything by phone, email, video, or online chat, including 100% virtual consultations.

Raj Wadhwani, founding shareholder and partner, is a Southwestern Law School graduate who helped pilot the Best Case Bankruptcy software in 1998 and was the first attorney to file a bankruptcy case electronically in the Central District of California. Greg Shanfeld, founding shareholder and partner, earned his law degree from the University of Southern California and has handled more than 10,000 bankruptcy cases over three decades. Both are Board-Certified Specialists in Consumer Bankruptcy.

For a Chapter 7 client, those credentials matter in concrete ways. The firm files in every division of the U.S. Bankruptcy Court for the Central District of California, so your case is handled by people who know how each division operates. And when a garnishment, foreclosure sale, or repossession is days away, the firm acts fast, because the automatic stay only helps if the petition is on file in time.

Debts and Situations That Lead Cerritos Residents to Chapter 7

  • Credit Card Debt: Revolving balances that have outgrown your income are the most common reason for filing. Chapter 7 discharges them, and the collection calls and demand letters stop once the case is filed.
  • Medical Bills: Unsecured medical debt, including accounts already sent to collections, is generally dischargeable. A single hospitalization can produce debt that no payment plan realistically resolves.
  • Personal and Payday Loans: High-interest installment and payday loans are unsecured and generally eligible for discharge, which ends the cycle of renewing and re-borrowing.
  • Collection Lawsuits and Judgments: If a creditor has sued or already won a judgment, filing triggers the automatic stay, which halts the suit, bank levies, and wage garnishment. A California money judgment is enforceable for 10 years and can be renewed, so a judgment left alone does not simply fade away.
  • Wage Garnishment: On an ordinary judgment, a garnishment is capped at the lesser of 20% of weekly disposable earnings or 40% of the amount by which those earnings exceed 48 times the applicable minimum hourly wage. That cap still takes real money from every paycheck, and filing stops it.
  • Repossession Deficiencies: After a vehicle is repossessed and sold, the lender can pursue the shortfall. That deficiency is unsecured debt and can be eliminated in Chapter 7.
  • Older Income Tax Debt: Some income taxes can be discharged if they meet specific timing rules. Whether yours qualifies requires a look at the filing and assessment dates, not a guess.
  • Business Debt After a Closed Venture: Owners of small businesses that did not work out often carry personal guarantees. Chapter 7 can clear the unsecured portion of that exposure.

What to Do Right Now if Creditors Are Closing In

Start by gathering paperwork: recent pay stubs, tax returns, a list of every creditor, and any lawsuit papers, garnishment notices, or notices of sale. Do not ignore a summons. A collection lawsuit generally has a response deadline, and in California an expired statute of limitations is a defense you have to raise in a written answer. If you do nothing, the court can still enter judgment. For written contract debt the limit is four years to sue, and for oral contracts it is two. A payment on a time-barred debt does not revive it, and only a signed written acknowledgment restarts the clock, so be careful what you say to a collector.

Watch your bank account. California automatically protects a set amount in a deposit account from a levy without any claim being filed, but that protection does not cover levies for wages owed to another person, support, or debts owed to the state. If a levy is hitting your account, tell us immediately.

If a car repossession has happened, the lender must give written notice of intent to sell, generally at least 15 days before disposition, and 20 days if the notice is mailed from or to an address outside California. You can ask in writing for a 10-day extension of the redemption period. If you own a home and received a notice of default, remember that the sale date cannot be set sooner than three months and 20 days after that notice is recorded, and you can reinstate by curing a monetary default up to five business days before the sale. Chapter 7 will not cure a mortgage default, but filing still stops the sale temporarily, and we will tell you plainly whether Chapter 13 is the better route for keeping the house.

Where the case is filed depends on your zip code, using your street address and not a P.O. box. Cerritos residents file in the Los Angeles Division of the U.S. Bankruptcy Court, which sits in downtown Los Angeles. Because you can handle the entire case with us by phone, video, and email, that does not mean extra trips on your part. Do not run up new charges, do not pay back relatives or favored creditors right before filing, and do not move money or transfer property without talking to us first. Those moves can be undone or can put the discharge at risk.

Keeping Your Home, Car, and Savings Through a Chapter 7

The word liquidation scares people, but the vast majority of our clients keep everything they own. A trustee is appointed to review your case, and anything not protected by an exemption can be sold for creditors. The work is making sure that almost nothing falls outside the protection.

Under the homestead system, the protected amount for a home is tied to the prior-year median single-family sale price in your county, within a statutory floor and ceiling that adjust annually. That is generous in much of Los Angeles and Orange Counties, but it only helps if you stay current on the mortgage and your equity is within the protected amount. Under the alternative system, the dollar amounts for a residence, vehicle, tools of the trade, and a wildcard are far smaller and adjust on a set schedule, so it tends to suit people with little equity to protect. Retirement accounts, household goods, and tools of the trade are also protected under California law. Choosing between the two systems is one of the most consequential decisions in the case, and the right answer depends on what you own, not on a rule of thumb.

Cerritos Chapter 7 Questions We Hear Most

How long does a Chapter 7 case take?

Most cases are completed in roughly four months from filing to discharge. Preparation before filing takes additional time, which is shorter if you have documents ready and longer if there are complications like a recent lawsuit or tax issue.

Do I qualify for Chapter 7?

Qualification turns on the means test, which compares your household income to the California median for your household size and then accounts for your actual allowed expenses. Being above the median does not automatically disqualify you, which is why the full calculation matters.

Will I lose my house or car?

Most clients keep both. If your home equity is within California’s homestead protection and you are current on the mortgage, you keep it. If you are behind or have more equity than is protected, Chapter 13 may be the better fit because it lets you catch up over time.

Can bankruptcy stop a wage garnishment?

Yes. The automatic stay takes effect the moment the petition is filed, and your employer must stop withholding. California law also bars an employer from firing you because wages are garnished for a single judgment.

What debts survive Chapter 7?

Child support, alimony, most student loans, most government fines, and debts for injuries caused by drunk driving generally cannot be discharged. Some older income taxes can be, if they meet timing rules.

Will my employer find out I filed?

Not automatically. They may learn if they are a creditor or if a garnishment has to stop. California and federal law prohibit an employer from firing you solely because you filed.

I filed before. Can I file again?

Yes, subject to waiting periods. You must wait 8 years between Chapter 7 filings, 4 years to file Chapter 13 after a Chapter 7, 2 years between Chapter 13 filings, and generally 6 years to file Chapter 7 after a Chapter 13, though that last period can be shortened if the plan paid enough to unsecured creditors.

My Cerritos debt is old. Do I still need to worry about being sued?

It depends on the type of debt and what has happened since. Written contract debt has a four-year window to sue and oral contract debt has two. But a debt past that window can still produce a judgment if you ignore a lawsuit and fail to raise the defense. And if a judgment already exists, it can be enforced for 10 years and renewed, so an old judgment is a live problem even when the underlying debt feels ancient.

Can a collector sue me for how they treated me?

California’s Rosenthal Act covers original creditors as well as third-party collectors. You can recover actual damages, a court can add $100 to $1,000 for willful and knowing violations, and a prevailing consumer can recover attorney fees. The deadline to bring that claim is one year, and a collector can avoid liability by curing a violation within 15 days of learning of it. If a collector has crossed a line, mention it during your consultation.

Can I use a paralegal or petition preparer instead of an attorney?

A petition preparer can type information into forms but cannot give legal advice, choose your exemptions, or represent you if a trustee or creditor challenges something. Errors in a filing can cost you property or the discharge itself, which is why having a bankruptcy attorney handle the case matters.

Do I have to come to an office?

No. We handle cases fully by phone, email, video, and online chat, and offer 100% virtual consultations, so you can complete the process from home.
