Cerritos Debt Relief Lawyer
The goal in a debt case is simple to state: the calls stop, the garnishment ends, the lawsuit goes away, and what you owe becomes something you can actually pay or no longer owe at all. Wadhwani & Shanfeld is a consumer bankruptcy and debt relief law firm that helps individuals and families across Los Angeles County, Orange County, Riverside County, and San Bernardino County reach that point, and a Cerritos debt relief lawyer from our team can walk you through the routes that exist, both inside and outside of bankruptcy.
Cerritos sits on the line between Los Angeles County and Orange County, and that matters more than people expect. Residents commute, work, and borrow across both, and a collection lawsuit may be filed in either county’s Superior Court depending on where the contract was signed or where you live. Debt relief here is not one tool. It is a choice among settlement, Chapter 7, Chapter 13, and defending a lawsuit, and the right answer depends on how old the debt is, what you own, and what your paycheck looks like.
Why Choose Wadhwani & Shanfeld for Debt Relief Near Cerritos
Wadhwani & Shanfeld is a consumer bankruptcy and debt relief firm that has helped more than 30,000 individuals and families, led by two Board-Certified Specialists in Consumer Bankruptcy through the American Board of Certification. Together the firm’s attorneys bring more than 90 years of combined legal experience to cases involving credit cards, medical bills, personal loans, mortgages, student loans, and IRS tax debt. We serve clients throughout Los Angeles, Orange, Riverside, and San Bernardino Counties, with full handling by phone, email, video, and online chat, and 100% virtual consultations are available. The first consultation is free, and you reach an attorney directly from your first call.
Raj Wadhwani, a founding shareholder and partner and a Board-Certified Specialist in Consumer Bankruptcy, is a Southwestern Law School graduate. He helped pilot the Best Case Bankruptcy software in 1998 and was the first attorney to file a bankruptcy case electronically in the Central District of California. Greg Shanfeld, also a founding shareholder and partner and a Board-Certified Specialist in Consumer Bankruptcy, earned his law degree from the University of Southern California and has handled more than 10,000 bankruptcy cases over three decades.
For debt relief, those credentials matter because the decision between bankruptcy and an alternative is the whole case. A firm that only files bankruptcy will recommend bankruptcy. We handle Chapter 7, Chapter 13, debt settlement, creditor lawsuits, wage garnishment, foreclosure defense, loan modification, and IRS representation, so the recommendation follows your numbers. We also file in every division of the U.S. Bankruptcy Court for the Central District of California and act fast when a garnishment, foreclosure sale, or repossession is days away.
Debt Situations That Bring Cerritos Residents to a Debt Relief Attorney
- Credit Card Debt: Balances that have grown through interest and minimum payments are the most common starting point. These unsecured debts can be discharged in Chapter 7, folded into a Chapter 13 plan, or negotiated down through settlement, depending on income and assets.
- Collection Lawsuits: Once a creditor or debt buyer sues, the clock on your response begins. A written contract debt generally carries a four-year limit for suing, an oral one two years, but the expired deadline is a defense you must raise in a written answer or a judgment can still be entered.
- Wage Garnishment: After a creditor wins a judgment, it can take a share of your paycheck. Filing Chapter 7 or Chapter 13 triggers the automatic stay, which stops most garnishments the moment the case is filed.
- Bank Account Levies: A judgment creditor can freeze and take funds from your account. California automatically shields a set amount of deposit-account money per debtor from an ordinary levy, with no claim required, but that protection does not cover wages owed to someone else, support debts, or debts owed to the state.
- Mortgage Default and Second Mortgages: Missed payments lead to a notice of default and eventually a sale date. Chapter 13 can stop a sale and spread out the arrears, and a wholly unsecured second mortgage may in some cases be stripped off.
- Auto Repossession and Deficiencies: A lender that repossesses must follow strict notice rules, and the leftover balance after a sale can often be discharged in bankruptcy.
- IRS Tax Debt and Student Loans: Some older income taxes can be discharged if they meet timing rules, while most student loans cannot, so these debts often call for negotiation or payment-plan strategy rather than a simple filing.
- Medical Bills and Personal Loans: Both are unsecured and usually dischargeable, and both are frequent triggers after illness, job loss, or divorce.
What to Do Now If Debt Is Closing In on You
Start by sorting your paper by urgency. A summons and complaint comes first, because a missed response deadline can lead to a default judgment. Cerritos is in Los Angeles County, so a suit against you may be filed in the Los Angeles County Superior Court, which operates through courthouses including the one in Norwalk, or, if you live or signed your contract on the Orange County side, in the Orange County Superior Court. Check the court named on the summons and the date on it, then call us before that date passes. We can tell you whether to answer, negotiate, or file bankruptcy.
Next, gather what a bankruptcy or settlement attorney needs: recent pay stubs, a list of every creditor with approximate balances, statements for any account being collected, your last tax return, deeds or loan statements for real estate, and vehicle loan documents. If a creditor has already served a levy or garnishment notice, bring that too, since the form tells us what kind of judgment it is and which exemptions may apply.
Be careful with two common mistakes. First, do not make a small payment to a debt collector to “show good faith” on an old account. In California a payment cannot revive a time-barred debt, but a signed written acknowledgment can restart the clock, and collectors know the difference. Second, do not move assets or favor one creditor right before filing. Courts review transfers and payments made before a case begins, and they can be undone.
If you decide to file, your street address determines which division of the U.S. Bankruptcy Court for the Central District of California hears your case, and the Los Angeles Division handles most of Los Angeles County. We confirm the right division before filing, prepare the petition, and handle the creditor meeting and any questions from the trustee. If a foreclosure sale, garnishment, or repossession is imminent, tell us in the first call so we can prioritize the filing.
Bankruptcy, Settlement, or a Court Defense: How the Choice Gets Made
Chapter 7 is generally for households whose income passes the means test, which compares your income to the California median for your household size and then considers your actual expenses. It eliminates qualifying unsecured debt, and most cases finish in roughly four months. Chapter 13 suits people with steady income who are behind on a mortgage or car loan, earn too much for Chapter 7, or owe priority debts such as certain taxes or support arrears. Payments run three to five years under a court-confirmed plan, and creditors are bound by it.
Debt settlement is a different animal. We negotiate directly with your creditor to resolve the debt for less than the full balance, which can make sense when the debt is large but you have the means to fund a lump sum or short payment plan, or when bankruptcy would put an asset at risk. Settlement does not trigger the automatic stay, so it works best before a garnishment or sale is imminent.
Sometimes the best move is a defense. If the creditor sued after the limitations period ran, or cannot prove it owns the debt, an answer filed on time can end the case. California’s Rosenthal Act also applies to original creditors as well as third-party collectors, so harassing or deceptive collection conduct can give you a claim for damages, an additional award of $100 to $1,000 if the violation was willful and knowing, and attorney fees. The suit must be brought within one year, and a collector can avoid liability by correcting a curable violation within 15 days of learning of it.
What California Lets You Keep, and How Judgments Work Over Time
California does not use the federal exemption list. A filer chooses one of two state systems for the entire case: the standard system, which includes a homestead exemption tied to local home prices with a statutory floor and cap that adjust annually, or the alternative system, which has a smaller residence exemption but a flexible wildcard that often works better for renters. You generally must have lived in California for 730 days to use these exemptions. Picking the system is among the most consequential choices in a case, and it depends on your equity, vehicles, retirement accounts, and tools of your trade.
Judgments also have a life cycle. A California money judgment can be enforced for 10 years from entry, and a creditor can file a renewal to extend it. For medical judgments under a set principal amount and personal debt judgments under a set principal amount, recent law limits renewal to a single five-year extension. If you are carrying an old judgment, its age and renewal history can change what leverage the creditor really has.
Wage garnishment on an ordinary judgment is capped by formula at the lesser of 20 percent of weekly disposable earnings or the amount by which those earnings exceed 48 times the applicable minimum hourly wage, with different multiples for biweekly, semimonthly, and monthly pay. If a garnishment would leave you unable to support your family, you can ask the court to exempt the portion of earnings you can prove is necessary. Your employer cannot fire you because wages are garnished for a single judgment.
Cerritos Debt Relief FAQs
Is debt settlement or bankruptcy better for me?
It depends on the size of the debt, your income, and what you own. Settlement fits people who can fund a reduced payoff and want to avoid a bankruptcy filing. Bankruptcy fits when debt is beyond what any negotiation can realistically resolve, or when a garnishment or sale is imminent and you need the automatic stay. We review both before recommending one.
Will filing stop a wage garnishment?
Yes. Filing Chapter 7 or Chapter 13 triggers the automatic stay, which halts most garnishments from the moment the petition is filed. In an emergency we can often prepare and file quickly.
How long do creditors have to sue me for a debt?
For a written contract, including most credit card agreements and book account claims, the period is four years. For an oral contract it is two years. The expired deadline is a defense you must raise in a written answer, otherwise the court can still enter judgment against you.
Can a small payment restart the clock on an old debt?
A payment cannot revive a debt that is already time-barred. A signed written acknowledgment of the debt can restart the limitations period, so avoid signing anything a collector sends before speaking with an attorney.
Will I lose my home if I file?
Most clients keep their homes. In Chapter 7 the question is whether your equity falls within California’s homestead exemption and whether you are current on the mortgage. If you are behind or have more equity than the exemption covers, Chapter 13 lets you keep the property and catch up over time.
What debts can bankruptcy not erase?
Child support, alimony, most student loans, most government fines, and debts for injuries caused by drunk driving generally cannot be discharged. Some older income tax debt can be eliminated if it meets specific timing rules.
What protects my bank account from a levy?
California automatically exempts a set amount per judgment debtor in deposit accounts, and the bank must apply it before releasing money, with no claim of exemption needed. It does not apply to levies for wages owed to another person, child or spousal support, or debts owed to the state, and the amount is adjusted periodically.
Is a bank-account freeze the same as garnishment?
No. A levy takes funds from your account, while garnishment takes a portion of each paycheck. Both require a judgment, and bankruptcy stops both once filed. Different exemptions and procedures apply, which is why the type of enforcement matters.
How long can a creditor enforce a judgment against me?
A California money judgment is enforceable for 10 years from entry and can be renewed. After it expires without renewal, enforcement stops and liens created by enforcement are extinguished. Recent law restricts renewal for certain medical and personal debt judgments to one five-year extension.
What happens if a debt collector breaks the rules?
Under the Rosenthal Act you can recover actual damages, a court may add $100 to $1,000 for willful and knowing violations, and a prevailing consumer can recover reasonable attorney fees. The deadline to sue is one year, and no class actions are allowed under that statute.
Can my employer fire me over bankruptcy or a garnishment?
No. California and federal law prohibit an employer from firing you solely because you filed bankruptcy, and Labor Code section 2929 bars termination because wages are garnished for one judgment.
Do I have to come into an office to start?
No. We handle cases fully by phone, email, video, and online chat, and 100% virtual consultations are available for clients anywhere in Southern California.
