Cerritos Lawsuits & Judgments Lawyer

A lawsuit from a debt collector is not a verdict, and a judgment is not always the end of your options. Wadhwani & Shanfeld is a consumer bankruptcy and debt relief law firm that helps people in Cerritos and across Los Angeles County, Orange County, Riverside County, and San Bernardino County respond to Cerritos lawsuits and judgments, whether the papers just arrived or a judgment has already been entered and money is being taken from a paycheck or bank account.

Cerritos sits right at the Los Angeles and Orange County line, and residents here often have creditors, collection firms, and court filings pulling in two directions. Where a case gets filed depends on the contract and the parties, and the clock starts running the day you are served. What you do in the first weeks, whether you answer, whether you raise a time-bar defense, whether you negotiate, or whether you file bankruptcy, shapes everything that follows.

The decisions are different at each stage. Before judgment, the main question is whether to fight, settle, or stop the case altogether. After judgment, the questions turn to what a creditor can actually reach and for how long. Our attorneys walk through both with you in plain terms.

Why Choose Wadhwani & Shanfeld for Lawsuit and Judgment Defense

Wadhwani & Shanfeld has helped more than 30,000 individuals and families get out from under debt. The firm is led by two Board-Certified Specialists in Consumer Bankruptcy through the American Board of Certification, with more than 90 years of combined legal experience. We serve clients throughout Los Angeles County, Orange County, Riverside County, and San Bernardino County, starting with communities like Cerritos, Norwalk, Bellflower, and Long Beach, and our practice covers Chapter 7, Chapter 13, debt settlement, creditor lawsuits, wage garnishment, foreclosure defense, and IRS tax debt. You get direct access to an attorney from your first call, and we can handle your case by phone, email, video, and online chat, with 100% virtual consultations available.

Raj Wadhwani, a founding shareholder and partner, is a Board-Certified Specialist in Consumer Bankruptcy, a Southwestern Law School graduate, helped pilot the Best Case Bankruptcy software in 1998, and was the first attorney to file a bankruptcy case electronically in the Central District of California. Greg Shanfeld, also a founding shareholder and partner and a Board-Certified Specialist in Consumer Bankruptcy, earned his law degree from the University of Southern California and has handled more than 10,000 bankruptcy cases over three decades.

That background matters for lawsuit and judgment work because the strongest answer to a collection case is sometimes not in the civil courtroom at all. We file in every division of the U.S. Bankruptcy Court for the Central District of California, so when bankruptcy is the better tool, we can act fast, including when a garnishment, levy, or sale is days away. When it is not, we say so and look at settlement or other options. You hear a recommendation built on your income, property, and goals, not on the only service a firm happens to sell.

Situations That Lead to Lawsuits and Judgments Against Cerritos Residents

  • Credit Card Collection Suits: Banks and debt buyers often sue on cards that went delinquent years earlier. The claim is typically a written contract or book account claim, which carries a four-year limitations period, so the age of the account is the first thing we check.
  • Medical Bill Judgments: Unpaid hospital and provider balances can be sued on and reduced to judgment. These debts are usually dischargeable in bankruptcy, and the rules for renewing a medical judgment are narrower than for many other judgments.
  • Personal Loan and Payday Loan Suits: Online lenders and installment lenders file in court when payments stop. Oral agreements carry a shorter two-year deadline, while written loan agreements carry four years.
  • Auto Repossession Deficiencies: After a vehicle is repossessed and sold, the lender can sue for the shortfall. Whether you owe a deficiency at all depends on whether the lender sent the required notice and followed the timing rules.
  • Debt Buyer and Assigned Account Suits: When an account has been sold, the plaintiff must be able to prove it owns the debt and the amount. Many of these cases rest on thin paperwork, which creates leverage for negotiation or defense.
  • Default Judgments: If a response is never filed, a court can enter judgment even on a debt that has expired under the statute of limitations. This is the most preventable way to lose a case.
  • Judgment Enforcement Actions: Once a creditor holds a judgment, it can pursue wage garnishment, bank levies, and liens on real property. Each has its own protections and limits.
  • Business and Personal Guaranty Suits: Owners who personally guaranteed a business debt can be sued individually when the business fails, which often calls for a small business bankruptcy or debt solution analysis.

What to Do Right Now If You Have Been Served or a Judgment Has Been Entered

Start with the date on the summons, because your response deadline is short and does not move because you are confused or embarrassed. Do not ignore the papers. In California, an expired statute of limitations is a defense that you must raise in a written answer; if you do nothing, the court can still enter judgment. Gather the summons and complaint, any letters from the collector, and anything you have about the original account. Do not make a payment or sign anything acknowledging the debt until you have spoken with a lawyer. A signed written acknowledgment can restart the limitations period on a debt that is still within it, although a payment cannot revive a debt that has already expired.

Next, figure out where the case is pending. Cerritos residents may see cases filed in Los Angeles County Superior Court, which has courthouses including the Norwalk courthouse, or in Orange County Superior Court, depending on where the contract was made and where the parties are. The caption on your papers tells you which court, and we confirm the venue and deadlines when we review them. If you have been sued by a collection firm, call us before your response deadline passes so we can decide together whether to answer, negotiate, or file bankruptcy.

If judgment has already been entered, the question becomes what the creditor can actually take. A wage garnishment on an ordinary judgment is capped by a formula tied to your weekly disposable earnings and the minimum wage, and you can ask the court to exempt more of your pay if you can show it is needed to support yourself or your family. Your employer cannot fire you because your wages are garnished for a single judgment. Bank levies work differently: California automatically protects a set amount in your deposit accounts without you filing a claim, and the bank is supposed to apply that protection before turning anything over. That protection does not apply to every kind of debt, such as support or money owed to the state, and the amount adjusts periodically.

The most common mistakes are missing the answer deadline, ignoring a default judgment notice, moving money around in a panic, and paying a collector who is suing on a debt that may be time-barred. Filing a Chapter 7 or Chapter 13 case stops most garnishments, lawsuits, and levies the moment the petition is filed through the automatic stay, and when a levy or sale date is close, we can often prepare and file quickly.

How Long a Judgment Lasts and What Creditors Can Reach

A California money judgment is enforceable for 10 years from the date it is entered. After that, the creditor cannot enforce it, enforcement procedures stop, and liens created through enforcement fall away. A creditor can file to renew the judgment, which extends enforceability for another 10 years from the renewal filing. For medical expense judgments with unpaid principal under $200,000 and personal debt judgments with unpaid principal under $50,000, recent law allows only one renewal, and only for five years. That limit can matter a great deal for an older judgment sitting in the background.

What a creditor can reach depends on what you own and which exemption rules apply. For homeowners, California’s homestead exemption protects equity up to a level tied to the countywide median home price, within a statutory floor and ceiling that adjust yearly. In bankruptcy, California filers choose between two state exemption systems rather than the federal list, and must pick one for the whole case. One favors homeowners with significant equity; the other offers a flexible wildcard that often suits renters better. You generally must have lived in California long enough to use the state exemptions. Choosing between them is one of the most consequential decisions in a case, and our board-certified attorneys make it deliberately.

A judgment also does not have to be paid in full to be dealt with. Depending on your situation, the options include negotiating a reduced payoff, asserting exemptions to limit what a creditor can actually collect, challenging the judgment if it was entered improperly, or discharging the underlying debt in bankruptcy. Many creditors will accept less than the full amount when they see that collection is difficult.

Collector Misconduct and Your Own Claims

Sometimes the collector has broken the rules. California’s Rosenthal Act covers original creditors as well as third-party collectors, which makes it broader than the federal debt collection law. A consumer can recover actual damages, a court can add $100 to $1,000 if the collector acted willfully and knowingly, and a prevailing consumer can recover reasonable attorney fees. The deadline is short: one year to sue under the Act. A collector can avoid liability by notifying you and correcting a curable violation within 15 days of discovering it or receiving written notice, so these claims need to be raised carefully. If you think a collector lied, threatened, or contacted you improperly, tell us while we review the lawsuit.

Cerritos Lawsuit and Judgment Questions, Answered

How long do I have to respond to a debt collection lawsuit?

The deadline is printed on the summons and is short, so read it the day it arrives. If you miss it, the creditor can ask for a default judgment. Call us before the deadline so we can decide whether to answer, negotiate, or file bankruptcy.

Can I be sued for a debt that is very old?

You can be sued, but the creditor may lose if the limitations period has run. A written contract or book account claim carries four years, and an oral contract two years. You must raise this defense in a written answer; the court will not apply it for you.

If I make a small payment, does it restart the clock?

A payment cannot revive a debt that is already time-barred. A signed written acknowledgment of a debt that is still within the deadline can restart it, which is why you should talk to a lawyer before responding to a collector.

Will filing bankruptcy stop the lawsuit?

Yes. The automatic stay takes effect when the petition is filed and halts lawsuits, judgments, bank levies, wage garnishments, repossessions, and foreclosure proceedings. Some limited exceptions exist, which we review with you.

How much of my paycheck can be garnished?

On an ordinary judgment, garnishment is limited to the lesser of 20% of your weekly disposable earnings or 40% of the amount by which those earnings exceed 48 times the minimum hourly wage. Different multiples apply for biweekly, semimonthly, and monthly pay, and a higher local minimum wage is used where it applies. You can also ask the court to exempt more if you show it is needed to support your family.

Can my employer fire me for a garnishment?

Not for a garnishment from a single judgment. California law prohibits it, and filing bankruptcy generally cannot be the sole reason for termination either.

Is any money in my bank account protected from a levy?

Yes. California automatically protects a set amount per judgment debtor, and the bank must apply it before sending money to the levying officer, with no claim of exemption required. The amount adjusts periodically, and the protection does not cover some debts, such as support or amounts owed to the state.

Can a judgment be collected forever?

No. A judgment is enforceable for 10 years and can be renewed. Newer rules limit renewal to a single five-year extension for certain medical and smaller personal debt judgments, so the age and type of your judgment matter.

Can I get a judgment off my record without paying it?

Often, yes, through bankruptcy. If the underlying debt is dischargeable, a Chapter 7 can eliminate it, and in some cases bankruptcy can also remove judgment liens from property. We review your debts and property to see what applies.

My car was repossessed and now I am being sued. Do I really owe the difference?

Not necessarily. The lender must send written notice of its intent to sell the vehicle, generally at least 15 days beforehand (20 if mailed from or to an out-of-state address), and must give that notice within 60 days of repossession to pursue a deficiency. If the notice was missing or defective, the deficiency claim can fail.

Is it worth hiring a lawyer for a smaller collection case?

Often it is, because a default judgment can lead to garnishment and liens regardless of the original amount. A short consultation can show whether you have a time-bar defense, a paperwork problem, or a cheaper path through settlement or bankruptcy.

Do I have to come into an office to get help?

No. We handle cases fully by phone, email, video, and online chat, and 100% virtual consultations are available.
