Hollywood Credit Card Debt Lawyer

Wadhwani & Shanfeld is a consumer bankruptcy and debt relief law firm that works with Hollywood residents who have fallen behind on credit cards and are now facing collection calls, court papers, or a paycheck at risk, and it serves people throughout Los Angeles County, Orange County, Riverside County, and San Bernardino County. A Hollywood credit card debt lawyer can look at the whole picture at once: how much you owe, who is collecting, whether a lawsuit has been filed, and what you own that a creditor could try to reach.

Credit card debt rarely stays a private problem. Once an account is charged off, it is often sold to a debt buyer or placed with a collection law firm, and the next step can be a summons from the Los Angeles County Superior Court. If nobody answers that summons, the court can enter a default judgment, and a judgment is what lets a creditor garnish wages and levy bank accounts. In an entertainment-driven city where income can swing from month to month, a garnishment or frozen account can do real damage before the person even understands what happened.

The good news is that credit card debt is one of the most treatable kinds of debt. It is unsecured, it is generally dischargeable, and California gives debtors real tools to fight back, from the statute of limitations to wage and bank account protections to the automatic stay that comes with a bankruptcy filing. What matters is matching the right tool to your situation before the deadlines run out.

Why Choose Wadhwani & Shanfeld for Credit Card Debt Relief

The firm is led by two Board-Certified Specialists in Consumer Bankruptcy, certified through the American Board of Certification, and the team brings more than 90 years of combined legal experience to cases involving credit cards, medical bills, personal loans, mortgages, and taxes. Clients get direct access to an attorney from the first call, free consultations, and the option to handle everything by phone, email, video, or online chat, including 100% virtual consultations.

Raj Wadhwani, a founding shareholder and partner, is a Southwestern Law School graduate who helped pilot the Best Case Bankruptcy software in 1998 and was the first attorney to file a bankruptcy case electronically in the Central District of California. Greg Shanfeld, also a founding shareholder and partner, earned his law degree from the University of Southern California and has handled more than 10,000 bankruptcy cases over three decades. For a credit card debtor, that depth matters in a practical way. The right answer might be a discharge in Chapter 7, a repayment plan in Chapter 13, a negotiated settlement, or a defense to a lawsuit, and a firm that handles all of these will recommend the one that fits rather than the only one it offers.

The firm also acts fast when timing is tight. When a garnishment, foreclosure sale, or repossession is days away, the attorneys can prepare and file quickly so the automatic stay takes hold. The firm files in every division of the U.S. Bankruptcy Court for the Central District of California.

Credit Card Debt Situations We See Among Hollywood Clients

  • Charged-off cards sold to debt buyers: After a card is written off, the balance is often resold, and the new owner may sue for the full amount plus interest. Many of these buyers have thin paperwork, which can make them vulnerable to challenge, and a four-year deadline to sue on written contract debt may already have passed.
  • Active collection lawsuits: A summons from a collection firm starts a short clock to file a written answer. Ignoring it invites a default judgment, which opens the door to garnishment and bank levies.
  • Wage garnishment on a judgment: On an ordinary judgment, California caps garnishment at the lesser of 20 percent of weekly disposable earnings or 40 percent of the amount by which those earnings exceed 48 times the applicable minimum hourly wage. Filing bankruptcy stops most garnishments the moment the case is filed.
  • Frozen or levied bank accounts: A judgment creditor can levy a bank account, but California automatically shields a set amount in deposit accounts without any claim being filed, and the bank must apply that protection before turning money over.
  • Irregular and gig income: Actors, crew members, musicians, rideshare drivers, and freelancers often use cards to bridge gaps between jobs. When the gaps outlast the credit limits, balances snowball, and the means test looks at your actual income pattern.
  • Medical bills mixed with card balances: Many clients carry both. In bankruptcy, medical debt and credit card debt are treated alike as unsecured and are generally dischargeable together.
  • Cash advances and recent heavy charges: Large charges for luxuries or cash advances shortly before filing can draw a creditor’s objection, so timing and documentation need attention before any filing decision.
  • Judgments that have aged: A California money judgment is enforceable for 10 years from entry, and renewals for personal debt judgments under the current rules are limited, so the age and size of a judgment can change your options.

What to Do the Week You Are Sued or Garnished

Start by reading every piece of paper you have received and noting the dates. A summons gives you a limited window to file a written answer, and a missed deadline is the single most expensive mistake in credit card collection cases. If the suit is filed in Los Angeles County Superior Court, which hears these cases through its geographic districts and courthouses across the county, the answer must be filed with that court and served properly. Do not assume a collector’s letter or phone call extends your deadline. Gather your recent pay stubs, bank statements, the last few statements from each card, and any letters from collection agencies, because those documents drive both the defense and the bankruptcy analysis.

Before you pay anything, check whether the debt is time-barred. Suits on written contract debt, which covers most credit cards, must generally be brought within four years, and oral contract claims within two. The expired deadline is a defense you must raise yourself in a written answer, or the court can still enter judgment. A critical trap: a payment on a time-barred debt does not revive it under California law, but a signed written acknowledgment of the debt can restart the clock, so be careful about what you sign or agree to on a collection call.

If wages are already being garnished, your employer cannot fire you because of garnishment on a single judgment. You can also ask the court to exempt the portion of earnings proven necessary to support you and your family. If you decide bankruptcy is the right path, a Chapter 7 or Chapter 13 filing stops most garnishments, lawsuits, and levies immediately through the automatic stay. Hollywood addresses are typically assigned to the Los Angeles Division of the U.S. Bankruptcy Court for the Central District of California, though the court assigns divisions by the zip code of your street address, so that should be confirmed before filing. Calling a lawyer early, before the response deadline, keeps every option open: answer the suit, negotiate, or file.

Bankruptcy, Settlement, or Defense: Choosing the Path for Card Debt

Chapter 7 is the usual route for people whose income and expenses leave little room to repay. It eliminates qualifying unsecured debt, including credit cards, and most cases finish in roughly four months. Eligibility turns on the means test, which compares your income to the California median for your household size and then considers your real expenses. Despite the word liquidation, most of our clients keep everything they own, because California’s exemptions protect home equity, vehicles, household goods, tools of the trade, and retirement accounts.

California does not use the federal exemption list. Filers choose one of two state systems and must stay with that choice for the whole case. One system carries a homestead exemption that is tied to local home prices, and the other offers a smaller residence amount with a flexible wildcard that often suits renters, which describes a large share of Hollywood households. To use California’s exemptions at all, you generally must have lived in the state for at least 730 days. Picking the system that protects your particular property is one of the most consequential decisions in a case.

Chapter 13 fits people with steady income who are above the Chapter 7 limits or who have assets they need to protect beyond what exemptions cover. Your debts are folded into one monthly payment over three to five years. Debt settlement sits outside court: we negotiate directly with the creditor to resolve the balance for less than you owe, which can make sense when the debt is manageable and a lump sum or short payment plan is realistic. Finally, collectors themselves are regulated. California’s Rosenthal Act covers original creditors as well as third-party collectors, allows recovery of actual damages, permits an additional award of $100 to $1,000 when a collector acted willfully and knowingly, and lets a prevailing consumer recover attorney fees. A suit under the Act must be brought within one year, so harassment should be documented promptly.

Hollywood Credit Card Debt FAQs

Can credit card companies sue me in Los Angeles?

Yes. A card issuer or debt buyer can file a civil suit in Los Angeles County Superior Court. A lawsuit is not automatic after missed payments, but once one is filed you must respond in writing before the deadline on the summons or risk a default judgment.

How long do creditors have to sue on a credit card debt?

For written contract debt, including most credit card agreements, the limit is four years. For oral contract debt, it is two years. Credit card claims are commonly pleaded as written contract or book account claims, and both carry the four-year period. The clock and its starting point can be disputed, so the dates matter.

Does making a small payment restart the statute of limitations?

Not under California law. A payment cannot revive a debt that is already time-barred. A signed written acknowledgment of the debt can restart the period, though, which is why you should not sign anything or agree to terms with a collector before talking to an attorney.

Can credit card debt really be erased in bankruptcy?

Generally yes. Credit card balances are unsecured debt and are typically discharged in Chapter 7 for filers who qualify under the means test. In Chapter 13, the debt is reorganized into a plan payment instead. Debts like child support, most student loans, and most government fines are not discharged.

How much of my paycheck can a credit card creditor take?

Only after winning a judgment, and then the lesser of 20 percent of weekly disposable earnings or 40 percent of the amount by which weekly disposable earnings exceed 48 times the minimum hourly wage. If the local minimum wage is higher than the state’s, the local rate is used. For biweekly, semimonthly, and monthly pay, the multiplier is 96, 104, and 208 instead of 48.

Will a creditor take my bank account, and is any of it protected?

A judgment creditor can levy a bank account, but California automatically protects a fixed amount per judgment debtor in deposit accounts. You do not need to file a claim for it; the bank must apply it before releasing funds. It does not apply to levies for wages owed to others, child or spousal support, or debts owed to the state.

I work gig jobs and my income changes monthly. Can I still file Chapter 7?

Possibly. The means test looks at your income over a look-back period and then at your actual allowed expenses, so uneven earnings do not rule you out. We review your records and project which chapter fits, and Chapter 13 is an alternative if your income is above the limits.

What happens if a judgment was entered years ago and I never knew about it?

A California money judgment is enforceable for 10 years from entry, and a creditor can seek renewal. Since the 2023 rule change, renewal is limited to one time, for five years, on personal debt judgments under $50,000 in unpaid principal. If you suspect a default judgment was entered without proper service, that can sometimes be challenged, and bankruptcy can address the judgment debt as well.

Will my employer find out if I file bankruptcy?

Not automatically. An employer may learn of it if it is a creditor, if a garnishment must stop, or if Chapter 13 payments are deducted from pay. California and federal law bar an employer from firing you solely because you filed.

Is it worth hiring a lawyer if I owe only a few thousand dollars on one card?

Often, yes, especially if you have been served. A small balance can still become a judgment with garnishment rights, and a lawyer can check the deadline, challenge whether the plaintiff can prove ownership of the debt, or negotiate a resolution. The first consultation is free.

Can collectors keep calling me after I hire a lawyer or file bankruptcy?

After a bankruptcy filing, the automatic stay requires collectors to stop collection activity. Short of filing, an attorney can direct creditors to deal with the firm instead of you, and harassing conduct may violate the Rosenthal Act, which can carry damages and attorney fees.
