Huntington Beach Chapter 7 Bankruptcy Lawyer

The goal in a Chapter 7 case is simple to state: the calls stop, the lawsuits stop, the qualifying debt is wiped out, and you walk away with your home, your car, and your paycheck intact. Wadhwani & Shanfeld is a consumer bankruptcy and debt relief law firm that guides Orange County residents toward that result, and a Huntington Beach Chapter 7 bankruptcy lawyer from our team can tell you quickly whether it is realistic for your finances.

Chapter 7 works on a few moving parts: a means test that compares your household income to the California median, a set of state exemptions that decide what property you keep, and a discharge that erases credit cards, medical bills, personal loans, and repossession deficiencies. Most cases wrap up in roughly four months. The details of how those pieces fit together, especially for a coastal homeowner or a renter with a car loan and a stack of medical bills, decide whether filing is a clean reset or a costly mistake.

Our attorneys file for clients across Huntington Beach and the rest of Orange County, and a first conversation with an attorney is free.

Why Choose Wadhwani & Shanfeld for Chapter 7 Filings in Huntington Beach

The firm serves Huntington Beach and Orange County along with Los Angeles, Riverside, and San Bernardino Counties, handling Chapter 7, Chapter 13, debt settlement, foreclosure defense, wage garnishment, creditor lawsuits, IRS tax debt, and small business debt. When you call, you reach an attorney directly from the first conversation, and you can handle your entire case by phone, email, video, and online chat if you prefer not to travel.

Raj Wadhwani, founding shareholder and partner, and Greg Shanfeld, founding shareholder and partner, are both Board-Certified Specialists in Consumer Bankruptcy through the American Board of Certification, a distinction held by a small fraction of attorneys nationwide. Raj Wadhwani, a Southwestern Law School graduate, helped pilot the Best Case Bankruptcy software in 1998 and was the first attorney to file a bankruptcy case electronically in the Central District of California. Greg Shanfeld earned his law degree from the University of Southern California and has handled more than 10,000 bankruptcy cases over three decades. Together the firm’s lawyers carry more than 90 years of combined legal experience.

That depth matters in Chapter 7 because the outcome rarely turns on the petition itself. It turns on choices made before filing: which exemption system to elect, whether your income clears the means test, and what to do about a property or debt that does not fit neatly. The firm files in every division of the U.S. Bankruptcy Court for the Central District of California, and when a garnishment, foreclosure sale, or repossession is days away, we move fast.

Debts and Situations That Lead Huntington Beach Residents to Chapter 7

  • Credit Card Balances: Revolving balances that grew through job loss, reduced hours, or rising living costs are among the most common debts discharged in Chapter 7, particularly once minimum payments no longer cover interest.
  • Medical Bills: Unsecured medical debt, including accounts already sent to collections, is generally dischargeable and often drives filings after an illness or injury.
  • Personal and Payday Loans: Unsecured personal loans and payday loans can be wiped out, which is useful when high-interest borrowing has become a cycle.
  • Repossession Deficiencies: If a car was repossessed and sold for less than you owed, the leftover balance is an unsecured debt Chapter 7 can eliminate.
  • Collection Lawsuits and Judgments: A suit from a collection firm or a judgment already entered against you can be stopped by the automatic stay, and judgment debt can often be discharged.
  • Wage Garnishment: A garnishment taking part of every paycheck ends when the case is filed, which is often the trigger that finally sends people to a lawyer.
  • Older Income Tax Debt: Some older income taxes can be discharged if they meet specific timing rules, which our attorneys check before recommending a chapter.
  • Business Debt From a Failed Venture: Owners of small businesses that did not work out often carry personal liability, and Chapter 7 can resolve it alongside personal debt.

What to Do Right Now if Creditors Are Closing In

Start by gathering paperwork: recent pay stubs, the last couple of years of tax returns, bank statements, a list of every creditor, and any lawsuit papers, garnishment notices, or sale notices. If you have been served with a summons, do not let the response deadline pass. A debt that is past the statute of limitations is a defense, but it is one you must raise in a written answer, or a court can still enter judgment. Collectors can sue on a written contract or a book account for four years and on an oral contract for two. Making a payment cannot revive a debt that is already time-barred, and only a signed written acknowledgment restarts the clock on one still in time.

If a foreclosure is underway, the dates matter. A sale cannot be set until at least three months and 20 days after the notice of default is recorded, the notice of sale must be mailed and posted at least 20 days before the sale, and you can reinstate a missed-payment default until five business days before the sale. On a repossession, the lender generally must give at least 15 days’ written notice before disposing of the vehicle, and you can ask in writing for an extra 10 days to redeem. Filing a bankruptcy petition halts all of this through the automatic stay, so if a date is close, call before it passes.

Your filing location is set by your home address. Huntington Beach is in Orange County, so a Chapter 7 case for a resident here is handled by the Santa Ana Division of the U.S. Bankruptcy Court for the Central District of California. Collection lawsuits against Orange County residents are heard in the Orange County Superior Court, with the Harbor Justice Center in Newport Beach and the Central Justice Center in Santa Ana among its locations. Our Huntington Beach Chapter 7 attorneys prepare the filing and represent you at the meeting of creditors, so you are not left to face the trustee alone.

The common mistakes are predictable: paying one friendly creditor in full right before filing, moving money around, letting a lawsuit default while “thinking about it,” and hiring a petition preparer who can type forms but cannot advise on exemptions or defend you if a trustee objects. Errors in a filing can cost you property or your discharge.

Keeping Your Home, Car, and Savings Under California’s Exemptions

The word “liquidation” frightens people, but the vast majority of our clients keep everything they own. California has opted out of the federal exemption scheme, so you choose one of two state systems for the entire case. One system carries a substantial homestead exemption that favors homeowners with equity. The other, found in the 703.140(b) system, offers a smaller residence amount plus a flexible wildcard that often suits renters or people with little home equity. You cannot mix and match between them.

The homestead amount under the first system is tied to the countywide median home price within a statutory floor and ceiling and adjusts for inflation, which matters in a high-value market like coastal Orange County. Because the right choice depends on your equity, your vehicle, your retirement accounts, and your tools of the trade, our board-certified attorneys run the numbers on both systems before anything is filed. To use California’s exemptions, you generally need to have lived in the state for at least 730 days.

Your bank account has a baseline protection too. California automatically shields a set amount in a deposit account from a levy by a judgment creditor, without any claim form, though that protection does not cover levies for child or spousal support or debts owed to the state. For a garnishment on an ordinary judgment, the cap is the lesser of 20 percent of disposable earnings or a figure tied to the minimum wage, and you can ask the court to exempt more if you prove you need it for your family’s support. Chapter 7 makes the question moot by ending the garnishment outright.

Chapter 7 Questions From Huntington Beach Filers

Do I qualify for Chapter 7 in Orange County?

Qualification starts with the means test, which compares your household income to the California median for a household your size and then accounts for your actual expenses. If your income is above the median, you may still qualify after expenses are factored in, and if you do not, Chapter 13 is often the alternative.

How long does a Chapter 7 case take?

Most cases are completed in roughly four months from filing to discharge. The automatic stay takes effect the moment the petition is filed, so collection activity stops long before the case closes.

Will I lose my house or car?

Most clients keep both. In Chapter 7 the question is whether your equity is protected by the exemption system we select, and whether you are current on the loan. If you are behind or have more equity than exemptions cover, Chapter 13 may let you keep the property.

Which debts can Chapter 7 not erase?

Child support, alimony, most student loans, most government fines, and debts for injuries caused by drunk driving generally survive. Some older income taxes can be discharged if they meet specific timing rules.

How much will my credit score drop?

It depends on where it starts. People with high scores see a larger drop, while many filers already have damaged scores from missed payments and collections. Scores can begin recovering within the first year with a secured card, on-time payments, and low balances.

How long does bankruptcy stay on my credit report?

A Chapter 7 can remain on your report for up to 10 years from filing. Its effect on your score fades well before then.

Can I file again if I filed before?

Yes, subject to waiting periods. You must wait 8 years between Chapter 7 filings, and generally 6 years to file Chapter 7 after a Chapter 13, though that period can be shortened if your plan paid enough to unsecured creditors.

The collector says the judgment against me is from years ago. Does it still count?

A California money judgment is enforceable for 10 years from entry and can be renewed. Whether an old judgment can still be enforced against you is worth checking before you decide how to respond.

Can a collector break the law and still be sued?

California’s Rosenthal Act reaches original creditors as well as third-party collectors. A consumer can recover actual damages, an additional $100 to $1,000 if the collector acted willfully and knowingly, and attorney fees if they prevail. The suit must be brought within one year, and a collector can avoid liability by correcting a curable violation within 15 days. Tell us about harassing contact, because it can shape the strategy.

Will my employer find out, and can they fire me?

Your employer is not automatically notified. They might learn of it if they are a creditor or if a garnishment must stop. Employers cannot fire you solely for filing bankruptcy, and California law separately bars firing an employee over a garnishment for a single judgment.

Do I have to come in person?

No. We handle cases fully by phone, email, video, and online chat, and 100% virtual consultations are available.
