Huntington Beach Student Loan Debt Lawyer

Student loans are the one big debt that bankruptcy does not erase automatically, which is why people often assume it can never be touched. That is only half true. Wadhwani & Shanfeld is a consumer bankruptcy and debt relief law firm that handles Chapter 7, Chapter 13, debt settlement, wage garnishment, and creditor lawsuits for clients across Orange County and Southern California, and a Huntington Beach student loan debt lawyer has more tools to work with than most borrowers expect.

Student loan trouble rarely travels alone. Borrowers in Huntington Beach and the surrounding Orange County cities tend to be carrying credit cards, medical bills, a car payment, and sometimes a mortgage at the same time, and the loan servicer is only one of the creditors calling. The real question is rarely “can I get rid of this loan?” It is “what happens to everything else if I focus on the loan, and what happens to the loan if I deal with everything else first?” That sequencing decision shapes the outcome more than any single filing does.

Why Choose Wadhwani & Shanfeld for Student Loan Debt Problems

Wadhwani & Shanfeld has helped more than 30,000 individuals and families get out from under debt, serving Orange County, Los Angeles County, Riverside County, and San Bernardino County. The firm is led by two Board-Certified Specialists in Consumer Bankruptcy, certified through the American Board of Certification, and the attorneys and staff bring more than 90 years of combined legal experience to each case. Clients speak directly with an attorney from the first call, and consultations are free, with full remote handling available by phone, email, video, and online chat.

Raj Wadhwani, a founding shareholder and partner, is a Southwestern Law School graduate who helped pilot the Best Case Bankruptcy software in 1998 and was the first attorney to file a bankruptcy case electronically in the Central District of California. Greg Shanfeld, also a founding shareholder and partner, earned his law degree from the University of Southern California and has handled more than 10,000 bankruptcy cases over three decades. That depth matters for student loans because the best strategy usually involves several pieces at once: stopping garnishments, resolving other debts so cash frees up, and deciding whether the loan itself should be addressed inside or outside a bankruptcy case.

Because the firm handles bankruptcy and its alternatives, including debt settlement, IRS tax debt, creditor lawsuits, and second mortgage settlements, the advice you get is based on what fits your finances rather than on the only service a firm happens to sell. The firm files in every division of the U.S. Bankruptcy Court for the Central District of California, and when a garnishment, foreclosure sale, or repossession is days away, it acts fast.

Where Student Loan Debt Goes Wrong for Huntington Beach Borrowers

  • Private loan lawsuits: Private lenders and the collection firms that buy their accounts can sue on a written contract. In California the window to sue on a written contract is four years, and an expired deadline is a defense you must raise in a written answer. Ignoring the summons can still produce a judgment.
  • Wage garnishment after judgment: Once a creditor has a money judgment, it can garnish wages. On an ordinary judgment, the take is capped at the lesser of 20 percent of weekly disposable earnings or 40 percent of the amount by which those earnings exceed 48 times the minimum hourly wage, using a higher local minimum wage if one applies. Different multipliers apply for biweekly, semimonthly, and monthly pay.
  • Bank levies: A judgment creditor can levy a bank account. California automatically shields a fixed amount in a deposit account from an ordinary levy without you filing anything, but that protection does not cover levies for child or spousal support or debts owed to the state.
  • Stacked consumer debt: Many borrowers are also behind on credit cards, medical bills, and personal loans. Chapter 7 can wipe out qualifying unsecured debt like these, which can free monthly income to pay the student loan on workable terms.
  • Cosigned loans: A parent or relative who cosigned is liable on the contract. Their exposure, and the way a bankruptcy filing by either person affects the other, needs to be mapped out before anyone files.
  • Behind on a mortgage or car loan: When student loan payments have crowded out the mortgage or the car note, Chapter 13 can let you catch up over three to five years while keeping the property.
  • Older judgments and renewals: A California money judgment is enforceable for 10 years from entry and can be renewed, though recent law limits renewal on certain personal debt and medical judgments to one time for five years. Knowing where a judgment sits on that timeline changes the strategy.

What to Do Now If a Student Loan Is Costing You Ground

Start by sorting your loans into two piles: federal and private. They behave differently, and the right move for one can be the wrong move for the other. Pull your servicer statements, any collection letters, and anything with a court caption on it. If you have been served with a lawsuit, the response deadline is short, and a missed answer lets the creditor take a default judgment even on a debt that is too old to sue on. Bring the summons to a consultation immediately rather than setting it aside.

Do not send a payment to a collector on an old account before talking to a lawyer. In California, a payment cannot revive a debt that is already time-barred, but a signed written acknowledgment of the debt can restart the clock, so be careful about what you sign or agree to on the phone. Keep copies of every letter, and note the dates and names of every call.

If your paycheck is already being garnished or a bank account has been levied, the situation is time-sensitive. Filing Chapter 7 or Chapter 13 triggers the automatic stay, which stops most garnishments and levies the moment the case is filed. You may also be able to claim an exemption for the portion of earnings you can show is needed to support yourself or your family. Your employer cannot fire you because wages are garnished for a single judgment.

For Huntington Beach residents, a bankruptcy case is filed in the Santa Ana Division of the U.S. Bankruptcy Court for the Central District of California, which serves Orange County. A collection lawsuit would typically be heard in Orange County Superior Court, which operates several justice centers around the county. You do not need to come to a courthouse to start the process with us; consultations are available 100% virtually, and the whole case can be handled remotely.

The most common mistake is waiting until the garnishment starts. The second most common is paying a debt settlement company or a document preparer to “handle” the loans. A petition preparer can type forms but cannot advise you, choose your exemptions, or represent you if a trustee or creditor objects.

Can Student Loans Be Discharged or Reduced Through Bankruptcy?

Most student loans cannot be discharged in a routine bankruptcy case, and that is the starting point. Chapter 7 wipes out qualifying unsecured debt like credit cards, medical bills, and personal loans, but student loans are on the short list of debts that generally survive. That does not make bankruptcy pointless for a borrower with student debt. It often makes it more useful.

Here is why. If credit cards, medical bills, and collection accounts are eliminated in Chapter 7, the monthly income that was going to those creditors can go toward the student loan. Many borrowers find that the student loan is manageable once everything around it is cleared. In Chapter 13, the loan can be folded into a structured plan where your other debts are reorganized into one payment over three to five years, and creditors are bound by the plan once the court confirms it. For someone who needs the stability of one predictable payment, that structure can be the difference between catching up and falling further behind.

Whether a particular loan can be challenged as an exception to the general rule depends on the loan type, the lender, and your circumstances, and that call belongs in a conversation with an attorney who has your documents in front of them. We will tell you honestly if the better path is outside bankruptcy altogether, through negotiation with a private lender or student loan debt strategies tailored to the type of loan you hold.

Protecting Your Property While You Deal With Student Debt

The fear that stops many people from acting is losing the house, the car, or the paycheck. California does not use the federal bankruptcy exemptions. Filers choose one of two state systems for the entire case: the standard system, with a homestead exemption tied to county home prices, or an alternative system with a flexible wildcard amount that often suits renters better. To use California’s exemptions you generally need to have lived in the state for at least 730 days. Choosing the right system is one of the most consequential decisions in the case, and our board-certified attorneys make it deliberately for every client.

In Chapter 7, most clients keep everything they own because exemptions cover home equity, vehicles, household goods, tools of the trade, and retirement accounts. If you are behind on a mortgage, filing can stop a foreclosure, and Chapter 13 gives you time to cure the arrears. A foreclosure sale in California cannot be set until at least three months and 20 days after the notice of default is recorded, and a monetary default can generally be reinstated until five business days before the sale, so there is often more time than people think, but not unlimited time.

Student Loan Debt Questions From Huntington Beach Borrowers

Can I get rid of student loans by filing bankruptcy?

Generally not in an ordinary case. Most student loans are among the debts that survive discharge. But bankruptcy can still help by eliminating other unsecured debts, stopping garnishments, and restructuring your payments so the student loan becomes manageable.

Will filing bankruptcy stop a wage garnishment over a student loan?

For a garnishment based on a court judgment, yes. The automatic stay takes effect the moment a Chapter 7 or Chapter 13 petition is filed and halts most garnishments, bank levies, lawsuits, and repossessions.

How long can a private lender sue me over a student loan?

A suit on a written contract carries a four-year limitations period in California. But the deadline is a defense you must raise in your answer; the court will not apply it automatically, and a default judgment can still be entered if you ignore the summons.

Does making a small payment restart the clock?

A payment cannot revive a debt that is already time-barred in California. A signed written acknowledgment of the debt can restart the limitations period, so be careful about what you sign.

How much can be taken from my paycheck?

On an ordinary judgment, the maximum is the lesser of 20 percent of weekly disposable earnings or 40 percent of the amount your weekly disposable earnings exceed 48 times the minimum hourly wage. You can also ask the court to exempt the portion of your earnings proven necessary to support you or your family.

Can my employer fire me because of a garnishment?

Not for a garnishment based on a single judgment. California law bars an employer from terminating an employee for that reason.

What if my parent cosigned my loan?

A cosigner is liable on the contract, so collection can be directed at them. Your filing and theirs affect each other, so the strategy should be planned together, ideally before either of you files anything.

Is a bankruptcy judgment on my record going to block me from refinancing or buying a home later?

Not permanently. A Chapter 7 can stay on your credit report for up to 10 years from filing, and a Chapter 13 is typically removed after 7 years, but the impact fades well before then. Many clients rebuild with a secured card and on-time payments, and buying a home can be possible within a few years of discharge depending on the loan type.

If I already have a judgment against me, is it too late to do anything?

No. A California money judgment is enforceable for 10 years from entry, which is a long time, so acting early matters. Bankruptcy can stop enforcement, and we can review whether the judgment has been properly renewed or whether limits on renewal apply to your situation.

Should I hire a lawyer or use a document preparer to file?

A preparer can enter information into forms but cannot give legal advice, pick your exemptions, or stand up for you if a trustee or creditor objects. Errors in a filing can cost you property or your discharge, which is why representation by a bankruptcy attorney matters.

Do I have to come into an office to get help?

No. Consultations are available 100% virtually, and cases can be handled entirely by phone, email, video, and online chat.
