La Habra Lawsuits & Judgments Lawyer

Getting a collection lawsuit dismissed, settled, or neutralized before it turns into a garnished paycheck or a frozen bank account is the goal for nearly everyone who gets served with a summons. Wadhwani & Shanfeld is a consumer bankruptcy and debt relief law firm that represents people in La Habra and throughout Orange County, as well as Los Angeles, Riverside, and San Bernardino Counties, who are dealing with creditor lawsuits, entered judgments, and the enforcement that follows. Finding the right La Habra lawsuits and judgments lawyer early matters because the options narrow quickly once a response deadline passes.

A lawsuit from a credit card company, a debt buyer, or a collection firm is a court case with real deadlines, not just another letter. If no written answer is filed, the court can enter a judgment by default, and that judgment becomes a tool for taking money from your wages and bank accounts. Many of the suits we see are filed after the time to sue has already run out, and that defense disappears if nobody raises it. The decision in front of you is whether to answer, negotiate, or file bankruptcy, and each path leads somewhere very different.

Why Choose Wadhwani & Shanfeld for Creditor Lawsuit and Judgment Defense

Wadhwani & Shanfeld has helped more than 30,000 individuals and families get out from under debt, from La Habra and the rest of Orange County across Southern California. The firm is led by two Board-Certified Specialists in Consumer Bankruptcy, certified through the American Board of Certification, and the attorneys bring more than 90 years of combined legal experience to every file. Clients get direct access to an attorney from the first call, and the firm moves fast when a garnishment, foreclosure sale, or repossession is days away.

Raj Wadhwani, a founding shareholder and partner, is a Southwestern Law School graduate who helped pilot the Best Case Bankruptcy software in 1998 and was the first attorney to file a bankruptcy case electronically in the Central District of California. Greg Shanfeld, also a founding shareholder and partner, earned his law degree from the University of Southern California and has handled more than 10,000 bankruptcy cases over three decades. That depth matters in lawsuit work because a judgment fight is often decided by what bankruptcy can do about it. The firm files in every division of the U.S. Bankruptcy Court for the Central District of California, so when a case needs the automatic stay, it can be prepared and filed without handing the file to someone else.

Because the firm handles both litigation-stage debt problems and their alternatives, the recommendation is based on what fits your income, property, and goals. Consultations are free, and the entire case can be handled by phone, email, video, and online chat, with 100% virtual consultations available for clients anywhere in the area.

Situations That Lead to Lawsuits and Judgments Against La Habra Residents

  • Credit Card Collection Suits: Filed by the original card issuer or a debt buyer who purchased the account. The creditor usually has four years to sue on a written contract and two years on an oral one, and the defense of an expired deadline must be raised in a written answer or it is lost.
  • Medical Bill Judgments: Unpaid hospital and provider balances that went to collections and then to court. These are generally unsecured and often dischargeable in bankruptcy.
  • Personal Loan and Payday Loan Suits: Lenders and their assignees sue after missed payments, sometimes tacking on interest and fees that deserve scrutiny.
  • Auto Deficiency Claims: After a repossession and resale, the lender may sue for the shortfall. The lender must send a written notice of intent to sell at least 15 days ahead, and a deficiency claim depends on that notice being timely and containing the required items.
  • Default Judgments from Missed Service: Some people never knew they were sued. A judgment entered because a summons was missed or mishandled can sometimes be challenged.
  • Wage Garnishment After Judgment: Once a creditor holds a judgment, it can order your employer to withhold part of your paycheck, which is often the point where people call us.
  • Bank Levies: A judgment creditor can freeze and take funds from a deposit account, subject to automatic protections the bank must apply.
  • Judgment Liens on Real Property: A recorded judgment can attach to a La Habra home and complicate a sale or refinance, which raises both homestead and bankruptcy questions.

What to Do After You Are Served or a Judgment Is Entered

Start with the paperwork. Read the summons for the response deadline and keep the envelope, since the date you were served can matter. Do not ignore it and do not assume the creditor will wait. A written answer filed on time keeps the case alive and preserves defenses, including the statute of limitations, whether the plaintiff can prove it owns the debt, and whether the amount is right. Call an attorney before that deadline passes, because the choice between answering, negotiating, and filing bankruptcy is much easier to make with time left.

Civil suits against La Habra residents are filed in the Orange County Superior Court, and the La Habra area falls within the territory of the court’s North Justice Center in Fullerton. Some cases are heard at the Central Justice Center in Santa Ana. A creditor may also have sued in a different county if the contract or your prior address pointed there, so check where the case was actually filed. Do not make a payment or sign anything acknowledging an old debt without advice. A payment cannot revive a debt that is already time-barred, but a signed written acknowledgment can restart the clock on one that is still close, and collectors know how to ask for exactly that.

If a judgment has already been entered, gather your pay stubs, bank statements, and a list of what you own, and note any notices from your employer or bank. Ask whether the judgment came from a default and whether the deadline to seek relief has passed. A money judgment in California is enforceable for 10 years and can be renewed, which means ignoring it does not make it go away. Judgments on medical expenses under a set dollar limit and personal debts under a lower limit can be renewed only once, and for five years, under a law that took effect in 2023, which helps with the long tail of older judgments.

A common mistake is paying the first collector who calls after a judgment, or letting a levy drain the account before anyone checks what is protected. Another is waiting until the second or third garnishment to act. If you are within days of a bank levy or the first deduction from your paycheck, tell us immediately, because the firm acts fast and a bankruptcy filing stops most garnishments and levies the moment the case is filed.

How Garnishments and Bank Levies Actually Work in California

Wage garnishment on an ordinary judgment is capped. The creditor may take the lesser of 20 percent of your weekly disposable earnings or the amount by which those earnings exceed 48 times the minimum hourly wage, and if a local minimum wage is higher than the state’s, the higher rate is used. For biweekly, semimonthly, and monthly pay periods, the multiplier is 96, 104, and 208 times the minimum wage. You can also ask the court to exempt the portion of earnings you can show is necessary to support yourself or your family, which can reduce the take or stop it. An employer cannot fire you because your wages are garnished for a single judgment.

Bank levies work differently. California automatically protects a set amount in a deposit account for each judgment debtor, and the bank must apply that protection before sending money to the levying officer, with no claim of exemption required. The amount is adjusted periodically. The protection does not cover levies for wages owed to another person, child or spousal support, or debts owed to the state. Money beyond the automatic amount may still be protected, for example if it is Social Security or other exempt income, but you generally have to claim that protection.

Bankruptcy as an Answer to a Judgment

When a lawsuit or judgment cannot be beaten on its own terms, bankruptcy often ends the problem. The automatic stay takes effect when the petition is filed and halts pending lawsuits, wage garnishments, bank levies, repossessions, and foreclosure proceedings. In Chapter 7, qualifying unsecured debts, including credit cards, medical bills, and personal loans, are discharged, and a judgment on those debts is discharged with them. In Chapter 13, you pay what you can afford over three to five years under a court-confirmed plan, which can make sense if you have significant home equity or income above the Chapter 7 limits.

The property question is where careful planning pays off. California does not use the federal exemptions. A filer chooses one of two state systems, and the choice applies to the whole case. One offers a homestead exemption tied to local home prices, which usually favors homeowners. The other has a smaller residence exemption plus a flexible wildcard that often works better for renters. Filing also requires having lived in California long enough, generally 730 days, to use these exemptions. A bankruptcy filed by a La Habra resident goes to the Santa Ana Division of the U.S. Bankruptcy Court for the Central District of California, which serves Orange County. The firm does not rush people into bankruptcy, though. If settlement or a successful defense is the better route, we will say so.

Debt Collector Misconduct and Your Own Claims

Sometimes the collector is the one with a problem. California’s Rosenthal Act regulates debt collection and, unlike the federal law, covers original creditors as well as third-party collectors. A consumer can recover actual damages, and a court can add an award of $100 to $1,000 if the collector acted willfully and knowingly. A prevailing consumer can also recover reasonable attorney fees. The window to sue is short, just one year, and a collector can avoid liability by correcting a curable violation within 15 days of learning of it. If you have been harassed, contacted at work after asking them to stop, or told something false about a debt, tell us when you call, because those facts can become leverage in settlement.

Common Questions About Lawsuits and Judgments in La Habra

How long do I have to respond to a debt collection lawsuit?

The summons states your deadline, and it is short. Missing it risks a default judgment. Call an attorney as soon as you are served so there is time to prepare an answer or consider bankruptcy.

What happens if I ignore a lawsuit from a debt collector?

The court can enter a judgment by default, which allows the creditor to garnish wages and levy bank accounts without proving much. An expired deadline to sue is a defense, but it must be raised in a written answer.

How long can a creditor wait before suing me?

For written contract debts and most credit card accounts, creditors have four years. For oral contracts, it is two. A payment on a time-barred debt does not revive it, but a signed written acknowledgment can restart the period on a debt that is still within it.

How long is a judgment good for in California?

A money judgment can be enforced for 10 years from entry, and the creditor can renew it. Medical expense judgments below a dollar limit and personal debt judgments below a lower limit can be renewed only once, for five years.

How much of my paycheck can be garnished?

On an ordinary judgment, the creditor takes the lesser of 20 percent of weekly disposable earnings or the amount above 48 times the minimum hourly wage. You can ask the court to protect more if you show the money is needed to support your family.

Can my employer fire me for being garnished?

Not for a single judgment. California law bars an employer from terminating an employee because wages are garnished on one judgment.

Is any money in my bank account protected from a levy?

Yes. A set amount per judgment debtor is protected automatically, and the bank must apply it without a claim from you. Other funds, such as exempt benefits, may be protected but usually require you to claim the exemption.

Will bankruptcy erase a judgment against me?

If the judgment is on dischargeable unsecured debt like credit cards or medical bills, Chapter 7 can eliminate it. Judgments for support and certain other debts generally cannot be discharged, and a judgment lien on property may need separate treatment.

Can I get a default judgment set aside?

Sometimes. If you were never properly served or missed the case for a legitimate reason, relief may be available, but the time limits are strict. An attorney can review how service was made and what motion fits.

Does a judgment lien affect my La Habra home?

A recorded judgment can attach to real property and surface when you sell or refinance. Whether it can be removed depends on your equity, the homestead exemption, and whether bankruptcy is an option.

Can a collector call my employer about a lawsuit?

Collectors face limits on contacting third parties, and a call that discloses the debt may violate California’s collection law. Document who called, when, and what was said.

Do I have to come to an office to get help?

No. We handle cases fully by phone, email, video, and online chat, and consultations are free.
