Long Beach Business Debt Settlement Lawyer

Wadhwani & Shanfeld is a consumer bankruptcy and debt relief law firm that helps Long Beach business owners, sole proprietors, and self-employed people resolve debts tied to their companies, and it serves clients across Los Angeles County, Orange County, and the rest of Southern California. Our attorneys negotiate directly with lenders and creditors to settle what a business owes for less than the full balance, and they will tell you plainly when settlement is the wrong tool.

A Long Beach business debt settlement lawyer earns their keep on a few early decisions: whether to answer a lawsuit or negotiate first, whether you signed a personal guarantee, and whether a settlement beats a bankruptcy filing on your numbers. Get those decisions right and a settlement can close out a debt for good. Get them wrong and you can end up paying a lender, then getting sued anyway, or watching a judgment reach your personal bank account.

Many small business debts are not really “business” debts at all once a guarantee is signed. A merchant cash advance, an equipment lease, a line of credit from a bank, or a supplier account can all be backed by the owner’s personal signature. That changes who the creditor can pursue and what leverage you have at the table.

The Decisions That Shape a Business Debt Settlement

Settlement is a negotiation, and negotiations are won on information. Before anyone makes an offer, you need to know who is actually liable, how old the debt is, what the creditor can realistically collect, and what happens to you if talks fail. A lump-sum offer made without that groundwork often leaves money on the table or locks you into a deal with terms that do not protect you.

The first question is liability. If the debt belongs to a corporation or LLC and you never guaranteed it, the creditor generally looks to the company’s assets. If you signed a personal guarantee, your home equity, bank accounts, and paycheck are in play. We read the actual loan documents, because the guarantee language, the default provisions, and any acceleration clause control what a creditor can demand and how fast.

The second question is timing. A creditor who has not sued yet has a different posture than one who has already filed, and a creditor holding a judgment has more tools than either. Settling before a judgment usually costs less and keeps your options open, which is why waiting for the lawsuit to land is a common and expensive mistake.

Why Choose Wadhwani & Shanfeld for Business Debt Settlement

Wadhwani & Shanfeld has helped more than 30,000 individuals and families, along with small business owners, resolve debt through bankruptcy, settlement, and negotiation. The firm is led by two Board-Certified Specialists in Consumer Bankruptcy through the American Board of Certification, and the attorneys bring more than 90 years of combined legal experience. We serve clients throughout Los Angeles, Orange, Riverside, and San Bernardino Counties, and you get direct access to an attorney from your very first call, with a free consultation and the option to handle everything by phone, email, video, or online chat.

Raj Wadhwani, a founding shareholder and partner and a Board-Certified Specialist in Consumer Bankruptcy, is a Southwestern Law School graduate who helped pilot the Best Case Bankruptcy software in 1998 and was the first attorney to file a bankruptcy case electronically in the Central District of California. Greg Shanfeld, also a founding shareholder and partner and a Board-Certified Specialist in Consumer Bankruptcy, earned his law degree from the University of Southern California and has handled more than 10,000 bankruptcy cases over three decades.

That bankruptcy depth matters for settlement. A creditor negotiating with a lawyer who files in every division of the U.S. Bankruptcy Court for the Central District of California knows the alternative is real. Because we handle both settlement and bankruptcy, our recommendation rests on what actually works for your numbers, not on the only service a firm happens to sell. When a garnishment, foreclosure sale, or repossession is days away, we act fast.

Business Debts We Settle for Long Beach Owners

  • Personally Guaranteed Business Loans: Bank and online lender loans often carry an owner’s guarantee, which exposes personal assets when the company cannot pay. Settlement talks focus on the guarantor’s real ability to pay and the creditor’s cost of pursuing collection.
  • Merchant Cash Advances: Daily or weekly withdrawals can drain operating cash quickly, and defaults often trigger lawsuits and bank account demands. We review the agreement’s terms and negotiate a reduced payoff or a workable schedule.
  • Business Credit Cards: Cards issued to a company are frequently guaranteed by the owner, and balances can climb fast when revenue dips. These accounts are often good candidates for lump-sum or structured settlement.
  • Equipment Leases and Financing: When a lease is in default, the lessor may demand the remaining payments plus return of the equipment. Negotiation can cap the deficiency or reduce the total owed.
  • Vendor and Supplier Accounts: Unpaid trade accounts are often unsecured and negotiable, especially when the supplier would rather recover something than litigate against a struggling customer.
  • Judgments Already Entered: A judgment against you or your company gives the creditor garnishment and levy tools. Settling a judgment can release liens and stop enforcement, and we also look at whether the judgment is still enforceable.
  • IRS and Payroll Tax Debt: Tax obligations follow different rules than ordinary creditor debt, and we represent clients with the IRS to stop levies and arrange payment terms.
  • Second Mortgages and Home Equity Lines Used for the Business: Owners often borrow against the house to fund the company. We handle second mortgage settlements and, where it fits, loan modification.

What to Do When a Creditor Is Pressing a Business Debt

Start by gathering the paper. You want the original agreement, any personal guarantee, the most recent statements, every demand letter, and any court papers. If you have been served with a lawsuit, the response deadline is the most important date you have, and it does not move because you are negotiating. Missing it can let the creditor take a default judgment, so contact us before it passes. In Los Angeles County, a collection suit against a Long Beach business owner is typically heard in the county’s Superior Court, and Orange County cases proceed in the Orange County Superior Court.

Do not make payments or sign anything until you understand what it does. In California, a signed written acknowledgment of a debt can restart the limitations period, but a payment cannot revive a debt that is already time-barred. Contract debts carry a four-year window for written contracts and two years for oral ones, but that expiration is a defense you must raise in a written answer. If you ignore the lawsuit, the court can still enter judgment even on an old claim.

Protect your cash, too. A creditor with a judgment can levy a bank account, and the automatic deposit account exemption protects only a limited amount without any claim being filed. It does not cover every kind of levy. Mixing business and personal funds in one account makes this worse, so separate them where you can.

Do not pay one creditor in full while ignoring others, and do not drain retirement funds to satisfy an unsecured debt that could be settled for less. Those accounts are often protected from creditors, and spending them on a negotiable balance is a costly error. Bring us the whole picture, and we will compare settlement against Chapter 7, Chapter 13, and small business bankruptcy before you commit to anything.

Settlement or Bankruptcy: Where the Line Falls

Settlement works best when you have a way to fund it, whether a lump sum, a lender-friendly payment plan, or help from family, and when the creditor has a reason to take less. It works poorly when you owe many creditors at once, when income is too thin to fund any offer, or when a judgment is already draining your paycheck.

If you are a sole proprietor or a personal guarantor, Chapter 7 can eliminate qualifying unsecured debt, while Chapter 13 reorganizes debt into one payment over three to five years. Filing triggers the automatic stay, which halts lawsuits, bank levies, wage garnishments, and most collection activity the moment the petition is filed. California does not use the federal exemption list, so a filer picks between two state exemption systems, and which one protects more depends on whether you own a home and what you hold. The choice binds you for the whole case, and the filer generally must have lived in California for 730 days to use the state’s exemptions.

Where a company is winding down, small business bankruptcy and business debt solutions may be the cleaner route than piecemeal settlements. We lay out both paths with real numbers so the decision is yours and is informed.

Garnishment, Levies, and Judgments in Business Collection

When a business debt becomes a judgment, collection gets personal. An ordinary wage garnishment is capped at the lesser of 20 percent of weekly disposable earnings or the amount by which those earnings exceed 48 times the minimum hourly wage, and different multiples apply to biweekly, semimonthly, and monthly pay. A higher local minimum wage is used in the calculation where one applies. You can also ask the court to exempt earnings shown to be necessary to support you and your family, and your employer may not fire you because of garnishment on a single judgment.

A California money judgment is enforceable for 10 years and can be renewed, although recent law limits renewal to one time, for five years, on certain personal debt and medical judgments under specified principal amounts. Knowing a judgment’s age and renewal status can change your leverage considerably.

The Rosenthal Act also gives you protection against abusive collection tactics, and it covers original creditors as well as third-party collectors. A consumer who proves a violation can recover actual damages, additional statutory damages for willful and knowing conduct, and attorney fees, though the suit must be brought within one year. If a collector is harassing you over a business debt you personally guaranteed, tell us what is happening.

Long Beach Business Debt Questions Owners Ask Us

Can a creditor go after my personal assets for a business debt?

Only if you are personally liable. A personal guarantee, a sole proprietorship, or a general partnership puts your own property at risk. A corporation or LLC with no guarantee generally limits exposure to company assets, though exceptions exist, so we read the documents before advising you.

Will a creditor really accept less than I owe?

Often, yes, when collecting the full amount looks costly or uncertain. A creditor weighs your ability to pay, the cost of suing, and the risk that you file bankruptcy. A credible alternative to settlement strengthens your position.

Should I stop paying while I negotiate?

Not without advice. Stopping payments can trigger default interest, acceleration, and a lawsuit. Whether to pause depends on your documents, your cash, and where the creditor stands, so decide with an attorney rather than on your own.

What if I have already been sued over a business debt?

Do not ignore it. The response deadline runs from service, and a default judgment can follow if you miss it. We can explain whether to answer, negotiate, or file bankruptcy, and we can help with judgments already entered.

Does the statute of limitations protect me on an old business debt?

It can, but only if you raise it. A written contract claim generally carries a four-year limit and an oral contract two years. If the creditor sues and you do not answer in writing, the court can still enter judgment. A payment will not revive a debt that has already expired, though a signed written acknowledgment can restart the clock on one that has not.

Can the IRS debt from my business be settled?

The IRS follows its own rules rather than ordinary creditor negotiation. We represent clients with the IRS to stop levies and set up payment arrangements, and we review whether bankruptcy treats a particular tax debt differently.

What happens to the equipment or vehicle securing my business loan?

A secured lender can repossess. In California, a repossessed vehicle generally requires written notice of the intent to dispose of it at least 15 days beforehand, extended to 20 days in some mailing situations, and you may request a 10-day extension of the redemption period. A deficiency claim depends on the notice being timely and complete.

Will settling hurt my personal credit?

A settled account is typically reported as settled for less than the full balance, which affects credit but is usually less damaging than a judgment or a charge-off left unresolved. The effect depends on where your credit already stands.

Can I use business debt settlement if my company is closing?

Yes, but closing the company does not erase a personal guarantee. We look at settlement of the guaranteed debts alongside whether a bankruptcy filing would resolve everything more completely.

Do I have to come to an office to get started?

No. We offer 100 percent virtual consultations and can handle your case by phone, email, video, and online chat, or you can meet in person if you prefer.

Is it worth hiring a lawyer for a smaller business debt?

Often it is, because a lawyer can see a guarantee, a limitations defense, or an exemption problem that changes the outcome. The free consultation lets you weigh that before committing to anything.
