Long Beach Wage Garnishment Lawyer
The goal in a garnishment case is simple: get the full paycheck back and keep it coming. Wadhwani & Shanfeld, a consumer bankruptcy and debt relief law firm, helps workers across Long Beach and the rest of Los Angeles County, Orange County, Riverside County, and San Bernardino County do exactly that. If you are searching for a Long Beach wage garnishment lawyer, you are probably looking at a pay stub that came up short, or a letter from your payroll department that you did not expect.
A garnishment does not appear out of nowhere. A creditor sued, won a judgment, and then asked a court to direct your employer to hold back part of every paycheck. That means there are usually several points where the process can be challenged, slowed, or ended outright. The earlier you act, the more of those points remain open.
Garnishment is also a recurring drain. Each pay period takes another bite until the judgment is paid, set aside, or discharged. Our attorneys can often stop it at the source, and when a bankruptcy filing is the right tool, it can be prepared quickly when a paycheck is about to be hit.
How Much Can Be Taken From a Long Beach Paycheck
California sets a ceiling on garnishment of ordinary judgments. Your employer can be directed to withhold the lesser of two amounts: 20% of your weekly disposable earnings, or 40% of the amount by which those weekly disposable earnings exceed 48 times the minimum hourly wage. The second calculation protects lower earners, and for many workers it produces a smaller number than the 20% figure.
Two details matter in Long Beach. First, if the local minimum wage is higher than the state minimum, the local rate is used in the formula, which increases the protected portion of your pay. Second, the multiplier changes with your pay schedule. Biweekly, semimonthly, and monthly paychecks use 96, 104, and 208 times the minimum wage in place of 48. Employers and levying officers do not always run this math correctly, so it is worth checking.
The ceiling is not the final word. A judgment debtor can ask the court to exempt the portion of earnings shown to be necessary to support the debtor or the family. That means rent, utilities, food, child care, and medical costs can be argued as reasons to reduce or end the withholding. It takes documentation and a properly filed claim, and it does not happen automatically.

Situations That Lead to Garnished Wages
- Credit Card Judgments: Card issuers and debt buyers sue, often win by default when the defendant never answers, and then pursue a wage levy. Many Long Beach workers first learn of the case when the paycheck shrinks.
- Medical Debt Judgments: Unpaid hospital and provider bills are sent to collection and then to court. These are unsecured debts that Chapter 7 can generally eliminate.
- Personal and Payday Loan Judgments: Lenders who obtain a judgment can garnish just as a card company can, and the interest on these debts can make the balance grow while the garnishment runs.
- Repossession Deficiencies: After a car is repossessed and sold, the lender may sue for the shortfall. That deficiency judgment becomes a wage garnishment basis if it is not resolved.
- Business Debt Guaranteed Personally: When a small business fails and the owner personally guaranteed the loan or lease, the lender can pursue the owner’s paychecks, including wages from a new job.
- IRS Tax Debt: Federal tax collection runs on a different track from a court judgment, but the result is the same: a levy on wages. Representation with the IRS can stop levies and set up payment arrangements.
- Old Judgments Still Being Enforced: A California money judgment can be enforced for 10 years and can be renewed, so a judgment from years ago may still be drawing on your pay.
- Bank Account Levies Paired With Garnishment: Some creditors levy the account and the paycheck at the same time, which can leave a household unable to cover rent in a single week.
What to Do the Week You Learn About a Garnishment
Start by reading everything. Your employer received a document, and so did you, or you should have. Gather the notice, your last few pay stubs, and any court papers from the original lawsuit. The name of the court and the case number tell us where the judgment was entered and who the creditor is.
Next, check how the case began. Most Long Beach collection suits are filed in Los Angeles County Superior Court, which hears civil cases in several courthouses around the county. If you were never properly served, or if the debt was past its limitations period when the suit was filed, there may be grounds to challenge the judgment. In California, a written contract debt generally carries a four-year limitations period and an oral contract debt carries two. That deadline is a defense you must raise in a written answer. If you did not answer, the court can still enter judgment, which is how many people end up garnished on debts that should have been dead.
Do not make a payment on an old debt to “show good faith” before talking to counsel. A payment cannot revive a debt that is already time-barred, but it can muddy the record and cause confusion about where you stand. A signed written acknowledgment is what restarts a limitations period, so be careful about what you sign in response to a collector’s letter.
Then decide on the remedy. If the garnishment is the tip of a larger pile of debt, bankruptcy is often the answer. The automatic stay takes effect the moment a Chapter 7 or Chapter 13 petition is filed, and it halts most garnishments right away. For Long Beach residents, the case is filed in the Los Angeles Division of the U.S. Bankruptcy Court for the Central District of California, and your street address zip code determines the division, so we confirm that before filing. If bankruptcy is not the right fit, a claim of exemption, a negotiated settlement, or a motion to challenge the judgment may be.
Finally, keep working and keep your employer informed only as needed. California law bars an employer from firing an employee because wages are garnished for a single judgment. If your job is threatened, tell us right away.
Stopping the Garnishment With Chapter 7 or Chapter 13
Chapter 7 wipes out qualifying unsecured debt, including credit cards, medical bills, personal loans, and repossession deficiencies. Most cases finish in roughly four months. You qualify by passing the means test, which compares your household income to the California median for your household size and then accounts for your actual expenses. If the garnished debt is discharged, the garnishment does not come back.
Chapter 13 suits people with steady income who need time. Your debts are reorganized into one monthly payment over three to five years, and creditors are bound by the plan once the court confirms it. It is the usual choice when income is above the Chapter 7 limits, or when you owe priority debts such as certain taxes or support arrears that Chapter 7 cannot erase.
People worry that filing means losing property. For most of our clients it does not. California has opted out of the federal exemption scheme, so filers choose between two state systems, one with a large homestead protection for homeowners and another with a flexible wildcard that often suits renters. You must pick one system for the whole case, and you generally must have lived in California for 730 days to use these exemptions. We work through every exemption before you file, and choosing the right system is one of the most consequential decisions in the case.
Garnishment and Bank Levies: Know the Difference
A wage garnishment takes a slice of each paycheck. A bank levy freezes and takes money already in your account. They are separate tools, and a creditor can use both.
California automatically protects a set amount in a deposit account from a levy, and the bank must apply that protection before turning money over to the levying officer. You do not have to file a claim to receive it. The protection does not apply to levies for wages owed to another person, child or spousal support, or debts owed to the state. If your paycheck is deposited into the account being levied, the two remedies can combine to leave you with very little, so both need attention at once.
Long Beach Wage Garnishment Questions, Answered
Can my employer refuse to garnish my wages?
No. A valid wage garnishment order directed at your employer is something the employer must follow. What the employer cannot do is fire you because wages are garnished for one judgment. If you are treated badly at work over it, contact us promptly.
How soon does bankruptcy stop a garnishment?
When the petition is filed. The automatic stay takes effect immediately, and creditors must stop collection. Your employer then needs to be notified so the withholding ends, and we handle that step.
Is there a limit on how much of my paycheck can be taken?
Yes. For an ordinary judgment, the cap is the lesser of 20% of weekly disposable earnings or 40% of the amount your weekly disposable earnings exceed 48 times the minimum wage. Different multipliers apply to biweekly, semimonthly, and monthly pay periods, and the local minimum wage is used if it is higher than the state rate.
Can I reduce the garnishment without filing bankruptcy?
Often, yes. You can claim that part of your earnings is necessary to support you and your family, which can reduce or end the withholding. Another path is negotiating directly with the creditor to settle the judgment for less than the full amount in exchange for a lump sum or a payment plan.
What if the debt was too old to sue on?
Written contract debts generally carry a four-year limit and oral contract debts two years in California. But the defense must be raised in a written answer. If a default judgment was entered anyway, there may be ways to ask the court to set it aside, depending on how and when you learned of the case.
How long can a creditor keep garnishing me on one judgment?
A California money judgment can be enforced for 10 years from entry. A creditor can renew it, but for medical expense judgments and personal debt judgments under certain principal amounts, renewal is limited to one time and for five years only.
Will I lose my job if my employer finds out about the garnishment?
California law prohibits an employer from terminating you because your wages are garnished for one judgment. Multiple garnishments are treated differently, so tell us if more than one creditor is pursuing you.
Does a garnishment stop if I switch jobs?
No, not automatically. The creditor can serve the new employer, and many do. The judgment follows you until it is paid, expires, or is discharged in bankruptcy.
Are Social Security and unemployment benefits subject to this kind of garnishment?
Different rules apply to benefit payments, and the answer depends on the type of benefit and how it is deposited. Bring the details to your consultation and we will tell you what applies to your situation.
What if a collector keeps harassing me while the garnishment runs?
California’s Rosenthal Act covers original creditors and third-party collectors. A consumer can recover actual damages, a court may award an additional $100 to $1,000 for willful and knowing violations, and a prevailing consumer can recover reasonable attorney fees. The suit must be brought within one year, so timing matters.
Is it worth hiring a lawyer if only a small amount is being taken?
Often it is, because the garnishment is a symptom. The underlying judgment may be growing with interest, other creditors may be lining up, and a single consultation can show whether the debt is even valid. The consultation is free.
