Los Angeles Business Debt Settlement Lawyer

The goal in a business debt dispute is usually simple to state: pay less than the full balance, on terms the company can survive, and end the collection pressure for good. Wadhwani & Shanfeld, a consumer bankruptcy and debt relief law firm, helps owners and small business operators reach that point through negotiation, litigation defense, and bankruptcy when it is the better tool. Our Los Angeles business debt settlement lawyer team represents clients across Los Angeles, Orange, Riverside, and San Bernardino Counties.

Business debt behaves differently from household debt. Much of it is signed personally, whether through a guarantee, a merchant cash advance agreement, or a credit line in the owner’s own name. That means a creditor who cannot collect from a struggling company can go after the owner’s paycheck, bank account, and property. Settlement talks therefore have to account for two balance sheets at once: the company’s and yours.

Leverage matters just as much as the numbers. A creditor who has not yet sued, whose claim is old, or whose paperwork has gaps is in a very different negotiating position from one holding a fresh judgment. Knowing which situation you are in before the first call is what separates a good settlement from a bad one.

Why Choose Wadhwani & Shanfeld for Business Debt Settlement

Wadhwani & Shanfeld has helped more than 30,000 individuals and families resolve debt, and the firm is led by two Board-Certified Specialists in Consumer Bankruptcy through the American Board of Certification. Raj Wadhwani and Greg Shanfeld are the firm’s founding shareholders and partners, and together with the firm’s attorneys they bring more than 90 years of combined legal experience to cases across Los Angeles County and the neighboring Orange, Riverside, and San Bernardino Counties, including the San Fernando Valley, the Westside, the Inland Empire, and the Antelope Valley. Clients get direct access to an attorney from the first call, free consultations, and the option to handle everything by phone, email, video, or online chat, including 100% virtual consultations.

Those credentials matter for a settlement practice because the strongest negotiating position is a credible alternative. Creditors know which lawyers can file a case and which can only send letters. Raj Wadhwani was the first attorney to file a bankruptcy case electronically in the Central District of California and helped pilot the Best Case Bankruptcy software in 1998. Greg Shanfeld, a University of Southern California law graduate, has handled more than 10,000 bankruptcy cases over three decades. Because the firm files in every division of the U.S. Bankruptcy Court for the Central District of California, a settlement offer from us carries a real fallback: if the creditor will not be reasonable, a petition is available.

The firm also treats settlement and bankruptcy as tools rather than loyalties. If negotiation is the wrong answer for your situation, you will hear that plainly, and the plan we build is based on your income, your property, and your goals.

Business Debt Situations We Settle for Los Angeles Owners

  • Personally Guaranteed Business Loans: Bank term loans, SBA-backed financing, and equipment loans often carry a personal guarantee, so the lender can pursue the owner directly once the company stops paying. Settlement usually focuses on the guarantor’s exposure.
  • Merchant Cash Advances: Daily or weekly withdrawals can drain a business account while the stated payback total stays out of reach. These contracts frequently include confessions of judgment or personal guarantees, and the terms deserve a close read before any payoff is negotiated.
  • Business Credit Cards and Lines of Credit: Cards issued to the company but signed by the owner can leave the owner personally liable. Lenders will often accept a reduced lump sum once an account is charged off.
  • Vendor and Supplier Balances: Unpaid invoices from suppliers, landlords, and service providers are frequently resolved with a discounted payoff, particularly when the vendor would rather be paid something than sue.
  • Collection Lawsuits Filed by Debt Buyers and Collection Firms: Los Angeles business owners are regularly sued in Superior Court on defaulted accounts. Whether to answer, settle, or file bankruptcy depends on the claim’s age, documentation, and the owner’s assets.
  • Judgments Against a Business Owner: A judgment can lead to bank levies and wage garnishment. Negotiated satisfaction of a judgment, or bankruptcy relief, can end the enforcement.
  • Business Tax Debt: IRS balances tied to a business can be addressed through payment arrangements and representation to stop levies, sometimes alongside a settlement of other debts.
  • Closing a Struggling Business: Owners winding down often need a plan for which debts to settle, which to discharge, and which to leave behind, so that personal finances are not dragged down with the company.

What to Do When a Creditor Is Pressing Your Business

Start by sorting your debts by who is actually liable. Pull the contracts, the personal guarantees, and the account statements, and separate what the company owes alone from what you signed personally. That distinction decides where a creditor can reach and how much pressure you can safely absorb.

Next, check dates. In California a creditor generally has four years to sue on a written contract or a book account and two years on an oral contract. A written acknowledgment of the debt that you sign can restart the clock, but a payment on a debt that has already expired cannot revive it. Do not send a partial payment or sign a payment plan just to calm a collector before you know where the debt stands. If you are sued on an expired claim, the deadline is a defense you must raise in a written answer. If you do not respond, the court can still enter judgment against you.

If you have been served, act before the response deadline. In Los Angeles County, collection suits are heard in the Los Angeles County Superior Court, which sits in twelve districts, including the Central District at the Stanley Mosk Courthouse in Los Angeles and courthouses in places like Van Nuys, Norwalk, Torrance, and Pasadena. Suits against Orange, Riverside, or San Bernardino County residents are heard in those counties’ Superior Courts. Where the case lands affects logistics, but the first move is the same: do not let the deadline pass.

Be wary of settling on a creditor’s first terms. Collectors often open with a demand for a large lump sum or a short payment window. Before agreeing, confirm that the settlement will be documented in writing, that it releases you from the full balance and any personal guarantee, and that the creditor will report or dismiss accordingly. A verbal promise on a collection call is not a release.

Finally, call an attorney early. If a garnishment, bank levy, or sale date is days away, a bankruptcy filing triggers the automatic stay, which halts most collection activity the moment the petition is filed. Our firm moves quickly in those situations, and you can speak with an attorney directly at the first call.

Settlement, Judgment Enforcement, and Bankruptcy Compared

Settlement works best when the creditor sees a real risk of collecting little or nothing. That risk is created by documented hardship, limited assets, an aging claim, or a credible bankruptcy alternative. It is typically a lump-sum payoff at a discount or a short payment plan, followed by a signed release.

If a judgment has already been entered, the picture changes. A California money judgment can be enforced for 10 years and can be renewed, though recent law limits renewal to a single five-year extension for certain medical expense judgments and personal debt judgments below specified principal amounts. Enforcement tools include wage garnishment, capped by statute at the lesser of 20 percent of weekly disposable earnings or 40 percent of the amount by which those earnings exceed 48 times the minimum hourly wage (with higher multiples for biweekly, semimonthly, and monthly pay), and bank levies. A bank account carries an automatic exemption that the bank must apply without you filing anything, though it does not shield against levies for wages owed to others, support, or debts owed to the state. You can also ask the court to exempt wages proven necessary to support you and your family. These protections reduce the damage but do not end it, which is why negotiated satisfaction or bankruptcy is usually the real exit.

Bankruptcy becomes the better route when debt is too large to settle, when several creditors are pressing at once, or when a judgment is draining income. California requires filers to choose between two exemption systems, and the choice affects how much of your home equity, vehicle, tools of the trade, and savings you keep. Filing a Chapter 7 or Chapter 13 case stops most garnishments immediately. Which chapter fits depends on your income, your property, and whether the debt is personal or tied to a company that is still operating. We review those facts before recommending any path, including the possibility that settlement alone is enough.

One more point deserves attention: California’s Rosenthal Act applies to original creditors as well as collection agencies, and a consumer can recover actual damages, additional statutory damages for willful violations, and attorney fees. Its coverage is aimed at consumer debts, so whether it helps a particular business owner depends on how the debt arose. Where it applies, abusive collection conduct can become leverage in settlement.

Business Debt Settlement FAQs

What is business debt settlement?

It is a negotiated agreement in which a creditor accepts less than the full balance as payment in full, usually in a lump sum or a short installment plan. The agreement should be in writing and should release both the business and any personal guarantor.

Can I settle business debt without filing bankruptcy?

Often, yes. Creditors frequently prefer a discounted payoff to the cost and uncertainty of a lawsuit or a bankruptcy where they might receive nothing. The strength of your position depends on documentation, the age of the debt, and your ability to show hardship.

Am I personally liable for my company’s debts?

It depends on how the debt was created. If you signed a personal guarantee or opened the account in your own name, the creditor can pursue you personally. Debts owed only by an entity may not reach you, but the contract language and how the business was operated both matter.

How long does a creditor have to sue over business debt in California?

Four years for written contracts and book accounts, and two years for oral contracts. If a suit is filed after the deadline, you must raise the expired deadline in a written answer, or the court can still enter judgment.

Does making a payment restart the statute of limitations?

A payment cannot revive a debt that is already time-barred. A signed written acknowledgment of the debt can restart the period, which is why you should not sign anything a collector sends before you understand the claim’s age.

What if a merchant cash advance company is draining my business account?

These agreements are drafted to favor the funder, and many include personal guarantees. An attorney can review the contract, evaluate whether the repayment structure is enforceable as written, and negotiate or, if needed, use bankruptcy to stop the withdrawals.

Will settling business debt hurt my personal credit?

If you guaranteed the debt, a settled account can appear on your personal credit report as settled for less than the full balance. That is generally less damaging than a judgment or an unresolved charge-off, and credit can be rebuilt afterward.

Can a creditor garnish my wages for a business debt?

Only after it obtains a judgment against you personally, such as under a guarantee. Garnishment is limited by statute, and your employer is barred from firing you because of garnishment on a single judgment. A bankruptcy filing stops most garnishments when the case is filed.

What happens to a business debt judgment after ten years?

A California money judgment is generally enforceable for 10 years, after which enforcement stops and liens created by enforcement are extinguished unless the judgment has been renewed. Renewal rules are narrower for certain medical and personal debt judgments.

Is it worth hiring a lawyer for a small business debt?

Often, yes. Even a modest balance can become a judgment with garnishment and levy risk if a response deadline is missed. A short consultation can show whether to answer the suit, negotiate, or pursue a different route, and the consultation is free.

Should I stop paying my business creditors so I can settle?

Stopping payment is sometimes part of a settlement strategy, but doing it without a plan can invite a lawsuit and a judgment. Talk with an attorney first so you can weigh the risks, especially if a personal guarantee is involved.

Can I handle a business debt settlement remotely?

Yes. We handle cases by phone, email, video, and online chat for clients across Southern California, and virtual consultations are available.
