Mission Hills Debt Settlement Lawyer

Before you send a creditor a single dollar toward a “settlement,” or sign anything a collector emails you, it is worth knowing exactly what you are trading away and what you might be giving up for nothing. Wadhwani & Shanfeld is a consumer bankruptcy and debt relief law firm that negotiates debt settlements for Mission Hills residents and families across the San Fernando Valley, Los Angeles County, and the rest of Southern California.

A Mission Hills debt settlement lawyer does more than call a lender and ask for a discount. Settlement works only when the creditor believes you have a credible alternative, and sometimes the strongest alternative is a bankruptcy filing or a statute of limitations defense that the collector would rather not test. Whether settlement is worth pursuing depends on how old the debt is, who owns it now, whether you have been sued, and whether your wages or bank account are already exposed.

When Settlement Beats Bankruptcy, and When It Does Not

Debt settlement means negotiating with a creditor or a debt buyer to accept less than the full balance as payment in full. It can make sense when the debt is manageable in total, when you have a lump sum available or a way to build one, and when you want to avoid a bankruptcy on your record. It tends to make less sense when the debts are spread across many creditors, when you lack any realistic source of settlement funds, or when a lawsuit is moving faster than negotiations can.

Our Los Angeles bankruptcy and debt relief attorneys look at settlement and bankruptcy side by side because the answer is often a comparison, not a preference. Chapter 7 can eliminate qualifying unsecured debt outright, and Chapter 13 can fold debts into a single payment plan over three to five years. If you can wipe out a balance for nothing, paying a settlement on it may be the wrong move. If your income fails the Chapter 7 means test and your debts are modest, a negotiated settlement may be the cleaner route. We tell clients which side of that line they fall on, even when the honest answer is that they do not need us for settlement at all.

Why Mission Hills Clients Choose Wadhwani & Shanfeld for Debt Settlement

Wadhwani & Shanfeld has helped more than 30,000 individuals and families resolve debt through bankruptcy, settlement, and negotiation. The firm serves clients throughout Los Angeles, Orange, Riverside, and San Bernardino Counties, with a long record in the San Fernando Valley communities that include Mission Hills, North Hills, Sylmar, San Fernando, and Granada Hills. Clients get direct access to an attorney from the first call, free consultations, and the option to handle everything by phone, email, video, or online chat, including fully virtual consultations.

The firm is led by two Board-Certified Specialists in Consumer Bankruptcy through the American Board of Certification, with more than 90 years of combined legal experience. Raj Wadhwani, founding shareholder and partner, is a Southwestern Law School graduate who helped pilot the Best Case Bankruptcy software in 1998 and was the first attorney to file a bankruptcy case electronically in the Central District of California. Greg Shanfeld, founding shareholder and partner, earned his law degree from the University of Southern California and has handled more than 10,000 bankruptcy cases over three decades.

That bankruptcy depth matters in a settlement negotiation. A creditor’s lawyer knows the difference between a debtor who can only plead for mercy and one whose attorney can file a case tomorrow and trigger the automatic stay. Because the firm files in every division of the U.S. Bankruptcy Court for the Central District of California, our settlement offers carry a credible alternative behind them. When a garnishment, foreclosure sale, or repossession is days away, the firm acts quickly rather than letting negotiations drift.

Debts We Commonly Settle for Mission Hills Residents

  • Credit Card Debt: Often the best settlement candidate, especially when the account has been charged off and sold to a debt buyer who paid pennies on the dollar and may accept a fraction of the balance.
  • Personal Loans: Unsecured installment loans and online lenders can often be negotiated down, particularly when you are behind and the lender prefers a lump sum to a collection lawsuit.
  • Medical Bills: Providers and their collection agencies frequently accept reduced payoffs, and medical balances are among the debts Chapter 7 can discharge if settlement stalls.
  • Second Mortgage Debt: A second lien that is wholly or largely underwater can sometimes be settled for a fraction of the balance, and in Chapter 13 a wholly unsecured second mortgage may be stripped off entirely.
  • IRS Tax Debt: Tax debt follows different rules than consumer debt, and our attorneys help stop levies and arrange payment plans with the IRS rather than treating it like a credit card negotiation.
  • Student Loan Debt: Most student loans cannot be discharged in bankruptcy, so strategy here centers on repayment options and negotiation rather than a standard discount settlement.
  • Debts Already in Lawsuit: When a collection firm has sued you, settlement can be paired with a response to the complaint, and a negotiated resolution often needs to happen before a judgment is entered.
  • Business Debt: Small business owners with personal guarantees or vendor and lender balances can negotiate or restructure, and in some cases a small business bankruptcy is the better tool.

What to Do Right Now If You Are Considering a Settlement

Start by gathering every letter, statement, and court paper you have received, and write down the date you first fell behind on each account. The age of a debt controls much of your leverage. In California, a creditor generally has four years to sue on a written contract and two years on an oral one. Once that period runs, the debt is time-barred, but the defense is not automatic: you must raise it in a written answer to the lawsuit, or the court can still enter judgment against you.

Be careful about what you say and pay while you decide. Under California law, a payment cannot revive a debt that is already time-barred, but a signed written acknowledgment of the debt can restart the clock on one that is not yet expired. Collectors sometimes ask for a small “good faith” payment or a signature on a form to move things along. Do not agree to either before an attorney has looked at the account.

If you have been served with a lawsuit, the response deadline is the single most important date in your file, and missing it can lead to a default judgment. Consumer collection suits for Mission Hills residents are typically heard in the Los Angeles County Superior Court, which operates courthouses across the county, including San Fernando and Van Nuys in the Valley. If bankruptcy becomes the better route, Mission Hills is among the communities served by the San Fernando Valley Division of the U.S. Bankruptcy Court for the Central District of California, and the filing division is determined by your street address zip code.

Also look at your exposure to enforcement. A judgment lets a creditor garnish wages, and ordinary garnishment is capped at the lesser of 20 percent of weekly disposable earnings or a set amount tied to the minimum wage. Your employer cannot fire you because of a garnishment for a single judgment. A bank levy is limited by an automatic exemption on deposit accounts that your bank must apply without you filing a claim. Filing Chapter 7 or Chapter 13 stops most garnishments and levies the moment the case is filed through the automatic stay, which gives us room to negotiate from a stable position.

Judgments, Time Limits, and Collector Misconduct

Many people searching for a settlement lawyer have already lost a lawsuit. A California money judgment is enforceable for ten years from entry and can be renewed for another ten. For judgments on personal debts under a certain principal amount and on medical expense judgments, recent law limits renewal to a single five-year extension. These rules affect how long a judgment can hang over you and how much leverage a creditor really has when it asks for payment.

Collector behavior matters too. California’s Rosenthal Fair Debt Collection Practices Act covers original creditors as well as third-party collectors, which makes it broader than the federal law. A consumer can recover actual damages, and a court can add a penalty of $100 to $1,000 when the collector acted willfully and knowingly, plus reasonable attorney fees for a prevailing consumer. Suits under the Act must be brought within one year, and a collector can avoid liability by curing a violation within 15 days of learning of it. If a collector has harassed you, threatened actions it cannot take, or misstated what you owe, that conduct can become part of the negotiation.

Mission Hills Debt Settlement Questions

How much can a debt settlement reduce what I owe?

There is no fixed percentage. Results depend on the creditor, the age of the account, whether it has been sold to a debt buyer, and how much cash you can offer. Debt buyers who acquired the account cheaply often have more room to accept a discount than an original lender early in the delinquency.

Is debt settlement better than filing bankruptcy?

Not automatically. Chapter 7 can eliminate qualifying unsecured debt, usually in about four months, with no payment to creditors, while settlement requires you to pay something. Settlement can avoid a bankruptcy on your credit report. We compare both against your income, property, and debts before recommending one.

Will settling a debt hurt my credit?

A settled account is typically reported as settled for less than the full balance, which is a negative mark. If the account is already late or in collections, the incremental damage is often smaller than people expect. Credit recovery depends heavily on how you manage new credit afterward.

Can a collector sue me while we negotiate?

Yes. Negotiations do not pause a lawsuit unless the creditor agrees in writing or a court orders it. That is why the response deadline on any summons must be met regardless of how settlement talks are going.

What if the debt is too old to be sued on?

If the limitations period has expired, that is a defense, but you must assert it in a written answer if you are sued. A payment on a time-barred debt does not revive it, but a signed written acknowledgment can restart the period on a debt that has not yet expired. Check the dates before making any commitment.

Can settlement stop a wage garnishment that has already started?

A negotiated payoff with the judgment creditor can end a garnishment once the agreement is satisfied. If a faster stop is needed, filing Chapter 7 or Chapter 13 halts most garnishments immediately under the automatic stay.

Will my employer find out about a settlement?

Not unless the creditor garnishes your wages, in which case your employer must process the order. California law bars an employer from firing you because of a garnishment for a single judgment.

What is the difference between a settlement and a debt management program?

A settlement reduces the principal you owe. A debt management program typically lowers interest and consolidates payments without cutting the balance. Because our attorneys negotiate directly with creditors, the focus is on reducing what you owe, and on whether that is the right goal given your circumstances.

What happens to a settled debt after the creditor sells the account?

Get any settlement in writing and confirm it states the debt is paid in full. Without that documentation, a later buyer or collector may claim you still owe a balance. Keep proof of every payment.

Do I need to come into an office to start?

No. We handle cases entirely by phone, email, video, and online chat, and we offer 100% virtual consultations, so you can speak directly with an attorney without leaving home.

Can I settle a second mortgage without losing my home?

Often, yes. A second mortgage with little or no value behind it can sometimes be negotiated down, and in Chapter 13 a wholly unsecured second lien may be removed. The outcome turns on the value of your home and the size of the first mortgage.
