Montclair Debt Settlement Lawyer

Wadhwani & Shanfeld is a consumer bankruptcy and debt relief law firm that works with individuals, families, and small business owners across Montclair and the rest of San Bernardino County, as well as Los Angeles, Orange, and Riverside Counties. When the people we meet in Montclair are behind on credit cards, personal loans, or medical bills, many of them ask first about a Montclair debt settlement lawyer, because they want to resolve what they owe without a bankruptcy filing on their record.

Settlement is a negotiation with a deadline attached, and the deadline is usually set by the creditor’s lawsuit, not by you. A collection firm that has served you with a summons has already chosen a venue and a timeline. If a judgment is entered, the creditor gains tools that settlement talks never had to contend with: wage garnishment and bank levies. A settlement offer made before judgment, with a realistic read on what the creditor will accept and what you can actually pay, is a very different conversation from one made after your paycheck has been cut.

Our attorneys also tell people when settlement is the wrong tool. If the debt is large, the income is thin, and a lump sum is not realistic, a settlement that never gets funded only delays the lawsuit. Part of our work is deciding honestly whether to negotiate, defend, or file.

What a Debt Settlement Attorney Actually Does

The work begins before any offer goes out. We determine who actually holds the debt, because accounts are sold and resold and the party calling you may not be able to prove it owns the balance. We check whether the debt is still legally collectible. In California, a suit on a written contract or a book account generally must be filed within four years, and a suit on an oral contract within two. That defense does not raise itself: if you are sued on an expired claim and never file a written answer, a court can still enter judgment against you. A signed written acknowledgment of an old debt can restart the clock, but a payment on a debt that has already expired cannot revive it, which is why casual phone conversations and small “good faith” payments to collectors can be costly.

From there, we negotiate directly with the creditor or its lawyers. Settlement figures depend on the creditor’s alternatives. A creditor facing a debtor who is ready to file Chapter 7 gets nothing in a bankruptcy, so a realistic payout looks better. We structure the agreement in writing, confirm what happens to the lawsuit (dismissal with prejudice is what we look for), confirm how the account will be reported, and make sure the payment terms fit your budget so the deal does not collapse on month three.

Collector conduct matters too. California’s Rosenthal Act reaches original creditors as well as third-party collectors, and a consumer who proves a violation can recover actual damages, with an additional $100 to $1,000 available when the collector acted willfully and knowingly, plus reasonable attorney fees for a prevailing consumer. The suit must be brought within one year, and a collector can avoid liability by correcting a curable violation within 15 days of learning of it. Documenting abusive calls early preserves leverage for the settlement table.

Why Choose Wadhwani & Shanfeld for Debt Settlement in Montclair

Wadhwani & Shanfeld has helped more than 30,000 individuals and families resolve debt, and the firm is led by two Board-Certified Specialists in Consumer Bankruptcy through the American Board of Certification, with more than 90 years of combined legal experience. Raj Wadhwani, a Southwestern Law School graduate, helped pilot the Best Case Bankruptcy software in 1998 and was the first attorney to file a bankruptcy case electronically in the Central District of California. Greg Shanfeld earned his law degree from the University of Southern California and has handled more than 10,000 bankruptcy cases over three decades. Both are founding shareholders of the firm.

That bankruptcy depth matters in a settlement practice. Creditors price their offers against what you could do if negotiations fail, and they know whether the lawyer across the table can credibly file a case the same week. Because we handle Chapter 7, Chapter 13, and settlement under one roof, the recommendation you get is based on what works for your numbers, not on the only service a firm happens to sell. You get direct access to an attorney from the first call, a free consultation, and fast action when a garnishment, foreclosure sale, or repossession is days away. We can handle your case entirely by phone, email, video, and online chat, and 100% virtual consultations are available.

Debts We Commonly Settle for Montclair Clients

  • Credit Card Debt: The most common settlement candidate. Balances often sit with a debt buyer by the time a lawsuit arrives, and verifying ownership and the four-year limitations window shapes the entire negotiation.
  • Personal Loans: Unsecured installment loans and payday-style loans can usually be settled for less than the balance, especially once the lender has charged the account off.
  • Medical Bills: Providers and their collection agencies often accept reduced payoffs, and a medical judgment carries its own renewal limits under California law.
  • Second Mortgage Settlements: A junior lienholder that stands little chance of being paid in a foreclosure may accept a negotiated payoff, and in some cases a wholly unsecured second can be addressed through Chapter 13 instead.
  • IRS Tax Debt: Not a creditor lawsuit, but a negotiation all the same. We represent clients with the IRS to stop levies and set up payment arrangements.
  • Student Loan Debt: Most student loans cannot be discharged in bankruptcy, so strategy and negotiation carry more weight here than for other debts.
  • Deficiency Balances After Repossession: When a vehicle is sold for less than the loan balance, the lender may pursue the gap, and the notice and timing requirements are often a source of leverage.
  • Business Debt: Small business owners with personal guarantees often need settlement and bankruptcy analyzed together.

Steps to Take If a Creditor Has Sued You or a Judgment Is Looming

Start by gathering every document: the summons and complaint, any letters from the collector, and your most recent statements. Note the response deadline on the summons and treat it as fixed. Missing it invites a default judgment, and the expired-limitations defense described above is lost if it is never raised in a written answer. Do not make a payment or sign anything on an old account before an attorney has looked at the dates.

If your case is heard in civil court, San Bernardino County civil matters are generally handled through the Superior Court, with some now heard at the Rancho Cucamonga courthouse depending on jurisdiction. The Fontana District of the San Bernardino Superior Court also serves nearby communities. We confirm the correct venue from the summons itself. If bankruptcy becomes the better route, Montclair filers fall within the Riverside Division of the U.S. Bankruptcy Court for the Central District of California, which serves Riverside and San Bernardino Counties, and the filing division is determined by your street address.

If a judgment has already been entered, the picture changes. An ordinary wage garnishment is capped at the lesser of 20% of weekly disposable earnings or 40% of the amount by which those earnings exceed 48 times the applicable minimum hourly wage, with different multipliers for biweekly, semimonthly, and monthly pay. You can also ask the court to exempt earnings shown to be necessary to support you or your family. Your employer cannot fire you because of garnishment for a single judgment. Bank levies have a built-in protection: a set amount in your deposit accounts is protected automatically, without filing a claim, though that protection does not apply to levies for child or spousal support or debts owed to the state. A judgment is enforceable for 10 years and may be renewed, though renewal is limited to one five-year extension for certain medical and smaller personal debt judgments.

Filing bankruptcy triggers the automatic stay, which halts most garnishments, levies, lawsuits, and collection calls from the moment the case is filed. When a sale date or levy is days away, that speed is often the deciding factor, and we can often prepare an emergency filing quickly.

When Settlement Works, When Bankruptcy Works Better

Settlement tends to fit when you have a manageable number of unsecured debts, access to a lump sum or a steady monthly amount, and a goal of staying out of bankruptcy. It tends to fall short when debts are spread across many creditors, when some creditors have already obtained judgments, or when your income cannot fund the settlements. Unsettled amounts forgiven by a creditor can also carry tax consequences, which we flag before you agree to anything.

Bankruptcy changes the math. Chapter 7 eliminates qualifying unsecured debt for filers who pass the means test, and California filers choose between two state exemption systems, one favoring homeowners with a substantial homestead protection and one offering a flexible wildcard that often suits renters. You must have lived in California long enough to use the state’s exemptions, and you must pick one system for the whole case. Chapter 13 reorganizes debts into a single plan payment over three to five years, helps catch up a delinquent mortgage, and can stop a foreclosure. In a foreclosure, you generally have until five business days before the sale to reinstate by curing the default, and a sale cannot occur until at least three months and 20 days after the notice of default is recorded, with the notice of sale mailed and posted at least 20 days ahead. Those windows are the room we work with.

Montclair Debt Settlement FAQs

How much less than the full balance will a creditor accept?

There is no standard percentage. The figure depends on the age of the debt, who owns it, whether a lawsuit is pending, and what the creditor expects to collect if you file bankruptcy. We evaluate those factors before any number is proposed.

Will settling a debt stop a lawsuit?

Only if the agreement says so. A proper settlement provides for dismissal of the case, and we do not consider a deal finished until that term is in writing and carried out.

Do I have to answer the lawsuit even if I plan to settle?

Yes. Negotiating does not pause the response deadline. Without a timely answer, the creditor can seek a default judgment while talks are underway.

Is an old debt still collectible?

It depends on the type of contract. Written contract and book account claims generally carry four years, and oral contract claims two. Once expired, the deadline is a defense you must raise, and a payment cannot revive a debt that has already run out.

Can a collector garnish my wages without suing me first?

For ordinary consumer debts, a creditor generally needs a judgment first. Debts owed to the government, such as certain tax obligations, follow different rules.

Should I stop paying my creditors while I negotiate?

Not automatically. Missing payments can lead to lawsuits and added fees, and the right approach depends on your situation. Talk to an attorney before changing how you pay.

Can I settle a debt that already became a judgment?

Often yes. Judgment creditors will frequently accept a reduced payoff, particularly when garnishment would bring in little. A judgment is enforceable for 10 years and can be renewed, so a negotiated satisfaction should be documented and recorded properly.

What happens to my wages if a garnishment starts mid-negotiation?

The statutory cap on ordinary garnishments limits what can be taken, and you can seek an exemption for earnings needed to support your family. If the garnishment is unsustainable, a bankruptcy filing stops it when the case is filed.

Is a repossession deficiency negotiable?

Often. A lender must give at least 15 days’ written notice before disposing of a repossessed vehicle, and is liable for a deficiency claim only if the notice was given within 60 days and contained the required items. Defects in the notice give us leverage.

Will my employer learn about a debt settlement?

Not unless the creditor is your employer or obtains a wage garnishment against you. California law bars an employer from firing you because wages are garnished on a single judgment.

Can I handle a settlement myself instead of hiring a lawyer?

You can, but collectors negotiate daily and you do not. An attorney can spot limitations defects, ownership gaps, and collection violations, and can credibly point to bankruptcy as the alternative.
