North Hollywood Wage Garnishment Lawyer

When a portion of your paycheck disappears before it ever reaches your account, rent, groceries, and car payments all start competing for what is left. Wadhwani & Shanfeld is a consumer bankruptcy and debt relief law firm that handles Chapter 7, Chapter 13, debt settlement, creditor lawsuits, and wage garnishment for clients in North Hollywood, the rest of the San Fernando Valley, and across Los Angeles, Orange, Riverside, and San Bernardino Counties.

A North Hollywood wage garnishment lawyer starts with one question: how did the garnishment come about? An ordinary garnishment in California does not happen on a creditor’s say-so. It follows a lawsuit and a money judgment, and the creditor then asks the court for a wage garnishment order that goes to your employer. Whether you were properly served, whether the debt was too old to sue on, and whether the judgment was entered correctly all affect how much leverage you have today.

The good news is that a garnishment is rarely permanent. Depending on the facts, it can be stopped outright, reduced, or ended through a bankruptcy filing, and the earlier you act, the more paychecks you keep.

How California Limits What a Creditor Can Take From Your Wages

California caps garnishment on an ordinary judgment. The employer may withhold no more than the lesser of two figures: 20 percent of your weekly disposable earnings, or 40 percent of the amount by which your weekly disposable earnings exceed 48 times the minimum hourly wage. For people paid biweekly, semimonthly, or monthly, the multiplier changes to 96, 104, or 208 times the minimum wage. When a local minimum wage is higher than the state’s, the local rate is used in the calculation, which matters for workers in Los Angeles. Disposable earnings means what remains after legally required deductions such as taxes, not after your rent or credit card bills.

The practical effect is that lower-wage workers often lose far less than 20 percent, and sometimes nothing at all, because the second formula produces a smaller number. Many people assume the full 20 percent is coming out and never check the math against their pay stub.

There is also a hardship route. A judgment debtor can ask the court to exempt the portion of earnings shown to be necessary to support the debtor or the debtor’s family. That is a request you must make and prove, usually with a detailed budget and supporting documents, and creditors often oppose it. Support-related garnishments, tax debts, and student loans follow different rules and carry different limits than an ordinary consumer judgment.

Your employer is also restricted. California law bars an employer from firing you because your wages are garnished for a single judgment. Employers typically comply with the order and keep your payroll file confidential, but they are required to withhold once they are served.

Why Choose Wadhwani & Shanfeld for Wage Garnishment Relief

Wadhwani & Shanfeld has helped more than 30,000 individuals and families get out from under debt. The firm is led by two Board-Certified Specialists in Consumer Bankruptcy through the American Board of Certification, and together the attorneys carry more than 90 years of combined legal experience. For North Hollywood clients, that depth matters because a garnishment is usually a deadline problem, and the people reading your paperwork have seen the same situation thousands of times.

Raj Wadhwani, a founding shareholder and partner, graduated from Southwestern Law School. He helped pilot the Best Case Bankruptcy software in 1998 and was the first attorney to file a bankruptcy case electronically in the Central District of California. Greg Shanfeld, also a founding shareholder and partner, earned his law degree from the University of Southern California and has handled more than 10,000 bankruptcy cases over three decades. The firm files in every division of the U.S. Bankruptcy Court for the Central District of California, so your case is not limited by where you live or work.

Clients get direct access to an attorney from the first call, a free consultation, and fast action when a garnishment, foreclosure sale, or repossession is only days away. You can handle your whole case by phone, email, video, or online chat, and 100 percent virtual consultations are available if getting across the Valley is hard with your work schedule. The firm also looks beyond bankruptcy. Because it handles debt settlement, creditor lawsuits, loan modification, and IRS tax debt as well, the recommendation you get is based on what fits your situation, and you will be told plainly if bankruptcy is not the right tool.

Situations That Lead to Wage Garnishment in the San Fernando Valley

  • Credit Card Judgments: Collection firms and debt buyers sue on delinquent cards, and an unanswered lawsuit often becomes a default judgment. Garnishment typically follows within weeks or months of that judgment.
  • Medical Bill Judgments: Unpaid hospital and provider balances that were sent to collections can end in a lawsuit. These are among the debts Chapter 7 can eliminate.
  • Personal and Payday Loan Judgments: Online and storefront lenders may sue after a few missed payments, and their judgments can also add interest and costs to what you owe.
  • Repossession Deficiencies: After a vehicle is repossessed and sold, the lender can sue for the shortfall between the sale price and your loan balance, then garnish to collect it.
  • Time-Barred Debt Lawsuits: Suing on a written contract debt generally must happen within four years, and on an oral contract within two. Expiration is a defense you must raise in a written answer, or the court can still enter judgment against you.
  • Old Judgments Still Being Enforced: A California money judgment is enforceable for 10 years and can be renewed. Recent law limits renewal to one time, for five years, on medical judgments under $200,000 and personal debt judgments under $50,000.
  • IRS and Government Debt: Tax levies and government collections run on a separate track from civil judgments, and the tools for stopping them differ. The firm handles IRS tax debt representation.

What to Do the Week You Learn Your Pay Is Being Garnished

Start by getting your documents together: the garnishment notice or letter from your employer’s payroll department, your recent pay stubs, and any court papers you received at any point. The name of the creditor and the case number on those papers tell us which court entered the judgment. For many North Hollywood residents, that court is part of the Los Angeles County Superior Court system, which is divided into 12 geographic districts, and a judgment can come from a district other than the one near your home.

Next, find out whether you were actually served with the original lawsuit and whether you ever responded. A default judgment entered without proper service can sometimes be challenged. Also check how old the underlying debt is and whether the judgment is still within its 10-year enforcement window. A written acknowledgment must be a signed writing to restart the limitations period on a stale debt, and a payment alone cannot revive a debt that is already time-barred.

Do not ignore the problem hoping it fades. Calling us early lets an attorney compare your options, which can include a claim of exemption, negotiating a payment arrangement with the creditor, or a bankruptcy filing. If you file Chapter 7 or Chapter 13, the automatic stay takes effect the moment the petition is filed and halts most garnishments, and your employer is then told to stop withholding.

North Hollywood sits within the territory of the San Fernando Valley Division of the U.S. Bankruptcy Court for the Central District of California, which sits in Woodland Hills. Your street address, not a P.O. box, controls which division your case belongs in, so the filing location is confirmed before anything is submitted.

A common mistake is paying a creditor in a panic after a threatening call. Another is letting a bank account fill up after a garnishment. A deposit account levy is a separate tool from wage garnishment, though creditors sometimes use both. California automatically protects a set amount in a bank account without you filing a claim, but it does not cover every type of debt, such as support obligations or debts owed to the state. Avoid moving money around in ways that could look like hiding assets, and bring those concerns to us before acting.

Chapter 7, Chapter 13, and Other Ways to End a Garnishment

Chapter 7 wipes out qualifying unsecured debt such as credit cards, medical bills, personal loans, and repossession deficiencies, and most cases are completed in roughly four months. It requires passing the means test, which compares your household income to the California median for your household size. When the judgment debt is discharged, the garnishment ends and the creditor cannot restart it. Most of our clients keep everything they own, because California’s exemption laws protect home equity, vehicles, household goods, tools of the trade, and retirement accounts.

Chapter 13 fits people with steady income who are over the means test or have assets they want to protect. Your debts are reorganized into one monthly payment over three to five years, and creditors are bound once the court confirms the plan. It also stops a garnishment when filed and can cover back mortgage payments, support arrears, and priority tax debt.

California does not use the federal exemption list. Filers pick one of two state systems for the whole case, the standard system with a large homestead exemption or an alternative with a flexible wildcard that often suits renters. You must have lived in California for at least 730 days to use these exemptions. Choosing the wrong system can cost you property, which is why that decision is made carefully for every client.

Bankruptcy is not always the answer. If the debt is small, the garnishment is already modest, or the judgment is nearly expired, negotiation or debt settlement may serve you better. If a collector crossed a line, California’s Rosenthal Act may give you a claim of your own, covering original creditors as well as third-party collectors. It allows actual damages, an additional award of $100 to $1,000 for willful and knowing violations, and attorney fees to a prevailing consumer, but a suit must be brought within one year.

North Hollywood Garnishment and Bankruptcy Questions

Can my employer fire me because my wages are being garnished?

No, not for a garnishment on a single judgment. California Labor Code section 2929 prohibits termination for that reason. If you are fired in that situation, tell us promptly.

How much of my paycheck can be taken?

On an ordinary consumer judgment, the cap is the lesser of 20 percent of weekly disposable earnings or 40 percent of the amount your weekly disposable earnings exceed 48 times the minimum hourly wage. Different multipliers apply to biweekly, semimonthly, and monthly pay. Support and tax garnishments follow other rules.

How quickly can bankruptcy stop a garnishment?

The automatic stay takes effect the moment your petition is filed. Once the employer is notified, withholding should stop. When a payday is close, we can often prepare and file quickly.

Will bankruptcy get rid of the judgment itself?

For most consumer debts, yes. In Chapter 7, a discharge eliminates the debt behind the judgment, and it cannot be enforced afterward. Debts that survive, such as child support, alimony, most student loans, and most government fines, generally continue.

Can a creditor garnish my wages without suing me?

Generally not for an ordinary consumer debt. Garnishment follows a court judgment, so if wages are being taken and you do not remember being sued, you may have a default judgment from a lawsuit you never saw. That is worth investigating right away.

Can I reduce a garnishment without filing bankruptcy?

Possibly. You can ask the court to exempt the portion of earnings shown to be necessary to support you and your family, or negotiate directly with the creditor. We will tell you honestly whether those routes are realistic for your budget.

The debt is very old. Does that matter?

It can matter a great deal. Suing on a written contract debt is generally limited to four years, and an oral contract to two. But the defense must be raised in a written answer, or the court can enter judgment anyway. A payment cannot revive a time-barred debt, and only a signed written acknowledgment can restart the clock.

How long can a creditor keep garnishing me?

A California money judgment is enforceable for 10 years from entry and can be renewed. For medical and smaller personal debt judgments, recent law limits renewal to a single five-year extension. That limit can matter if you have been paying for years.

Will filing bankruptcy get me in trouble at work?

Your employer is not automatically notified. They may learn of it because they stop withholding after a garnishment ends, or because Chapter 13 payments come out of your paycheck. California and federal law bar firing you solely because you filed.

Can I handle this without coming to an office?

Yes. We handle cases fully by phone, email, video, and online chat, and 100 percent virtual consultations are available. That helps if you work long shifts or commute across the Valley.

Is it worth hiring a lawyer for a modest garnishment?

Often yes, because even a small garnishment compounds over months and a creditor can renew a judgment. A short consultation can show whether the garnishment is calculated correctly, whether the judgment is valid, and whether a cheaper fix exists. The consultation is free.
