Norwalk Debt Settlement Lawyer
A collection letter with a lawsuit threat, a creditor who keeps calling your cell, a bank hold on your checking account: for many Norwalk households, the pressure arrives long before any court date does. Wadhwani & Shanfeld is a consumer bankruptcy and debt relief law firm that negotiates with lenders, defends creditor lawsuits, and files bankruptcy when that is the better route, serving clients across Los Angeles County, Orange County, Riverside County, and San Bernardino County.
Hiring a Norwalk debt settlement lawyer makes the most sense when you can offer a creditor real money but cannot pay the full balance. Settlement works by persuading a lender or a debt buyer to accept less than the amount owed, in exchange for payment on defined terms. What a creditor will accept depends on how collectible the debt is, how old it is, whether it has already become a judgment, and whether the creditor believes you may file bankruptcy instead. A lawyer who handles both settlement and bankruptcy negotiates from a very different position than a company that can only offer one product.
Settlement is not always the right answer, and a good attorney will say so. If the debts are too large, the income too thin, or a wage garnishment is already running, bankruptcy may do more for you at lower cost. The goal of a first conversation is to sort out which of those situations you are actually in.
Why Choose Wadhwani & Shanfeld for Debt Settlement Near Norwalk
Wadhwani & Shanfeld has helped more than 30,000 individuals and families resolve debt, and the firm is led by two Board-Certified Specialists in Consumer Bankruptcy, certified through the American Board of Certification. Raj Wadhwani and Greg Shanfeld are the firm’s founding shareholders and partners, and together with their team they bring more than 90 years of combined legal experience to every file. Greg Shanfeld, a University of Southern California law graduate, has handled more than 10,000 bankruptcy cases. Raj Wadhwani, a Southwestern Law School graduate, helped pilot the Best Case Bankruptcy software in 1998 and was the first attorney to file a bankruptcy case electronically in the Central District of California.
Why does bankruptcy credentialing matter on a settlement page? Because settlement leverage comes from credibility. Creditors and collection firms know which law offices can and do file Chapter 7 and Chapter 13 cases in every division of the U.S. Bankruptcy Court for the Central District of California. When the attorney across the table can credibly say that the alternative to a fair settlement is a discharge that pays the creditor nothing, the offers tend to improve.
Clients get direct access to an attorney from the first call, a free consultation, and the option to handle everything by phone, email, video, or online chat, including 100% virtual consultations. When a garnishment, foreclosure sale, or repossession is only days away, the firm acts fast, because some deadlines cannot wait for a negotiation to finish.
Debts a Norwalk Settlement Attorney Can Negotiate
- Credit Card Debt: Revolving balances that have grown past what monthly payments can reduce, often with accounts already charged off and sold to a debt buyer who paid pennies on the dollar and may accept a fraction of the face amount.
- Personal Loans: Unsecured installment loans from banks, online lenders, and finance companies, where a lump-sum offer or short payment plan can close the account for less than the balance.
- Medical Bills: Hospital and provider balances that have moved into collections; many providers and their collectors will discount heavily to avoid litigation and closed-out accounts.
- Second Mortgage Balances: Junior liens and home equity lines where the property value no longer supports the loan; these can sometimes be settled, and in the right Chapter 13 case a wholly unsecured second mortgage can be stripped off.
- IRS Tax Debt: Not settled the way credit cards are, but the firm represents clients with the IRS to stop levies and arrange payment plans, and some older income tax debt can be eliminated in bankruptcy.
- Student Loan Debt: Most student loans cannot be wiped out in bankruptcy, so strategy centers on repayment options and negotiating the account rather than a court discharge.
- Debts Already in Lawsuit or Judgment: Cases filed by collection firms or creditors, where settlement may resolve the suit, release a judgment lien, or end a garnishment.
- Small Business Debt: Business loans, vendor balances, and personally guaranteed obligations for owners who need a workout or, in some cases, a small business bankruptcy.
What to Do If a Creditor Has Sued or Is About to Sue
If you have been served with a complaint, the response deadline is short, and ignoring it is the single costliest mistake in consumer debt. In a Norwalk case, the suit is typically filed in the Los Angeles County Superior Court, which has a courthouse in Norwalk as well as other district courthouses across the county. A creditor that wins by default can move straight to a wage garnishment or bank levy. Bring the summons and complaint to a lawyer before the deadline, not after.
Check how old the debt is. In California, a written contract debt generally carries a four-year window to sue, while an oral contract debt carries two. Credit card agreements and loan contracts are usually written, so four years is the number to watch. Expiration of that window is a defense, but you have to raise it in a written answer; a court can still enter judgment against you if you stay silent. Be careful about what you say and sign, too. Only a signed writing acknowledging the debt restarts the clock, and a payment cannot revive a debt that is already time-barred. Still, a casual promise or partial payment on a collector’s call can create arguments you do not want to fight, so refer collectors to your attorney.
Gather every statement, letter, and court paper you have, along with recent pay stubs and a list of your monthly expenses. Settlement offers are built on proof of what you can actually pay. Do not wire money or agree to a draft on a debtor’s account to a collector who calls you cold, and do not stop talking to your attorney about it either, because a settlement negotiated without a plan can leave a balance still owed and a lawsuit still running.
If a collector is harassing you, California’s Rosenthal Act gives you remedies that the federal law does not always provide. It reaches original creditors as well as third-party collectors, allows actual damages plus an additional award of $100 to $1,000 where the violation was willful and knowing, and lets a winning consumer recover attorney fees. The deadline to sue under it is one year, so documenting calls and letters early matters.
Settlement, Judgments, and Garnishment: Where the Leverage Shifts
Once a creditor holds a judgment, the negotiation changes. A California money judgment is enforceable for 10 years and can be renewed by the creditor, although recent law limits renewal to a single five-year extension for medical-expense judgments and personal-debt judgments below stated principal amounts. Settling a judgment often means paying a reduced amount in exchange for a satisfaction of judgment and release of liens, which matters if you plan to refinance or sell.
Wage garnishment on an ordinary judgment is capped at the lesser of 20 percent of weekly disposable earnings or 40 percent of the amount by which those earnings exceed 48 times the applicable minimum hourly wage; biweekly, semimonthly, and monthly pay use 96, 104, and 208 times the minimum wage instead. You can also ask the court to exempt the portion of earnings you can show is needed to support yourself and your family. Your employer cannot fire you because of a garnishment for a single judgment. A bank levy is different: California automatically protects a set amount in your deposit accounts without any claim being filed, and the bank must apply that protection before handing money over, though it does not apply to levies for wages owed to others, support, or debts owed to the state.
Filing Chapter 7 or Chapter 13 stops most garnishments and levies the moment the case is filed through the automatic stay. That is why the settlement-versus-bankruptcy question has to be asked early. If a creditor knows a garnishment is the only thing standing between you and default, it may hold out; if it knows you can file tomorrow, it often will not.
When Bankruptcy Beats Settlement
Settlement is a good fit when you have a lump sum or a manageable payment you can sustain and when the debt load is concentrated in a few accounts. Bankruptcy is the better tool when the total debt is out of proportion to your income, when you are juggling many creditors, or when a foreclosure sale or repossession is imminent. A foreclosure sale in California cannot be set until at least three months and 20 days after the notice of default is recorded, and a monetary default can be reinstated until five business days before the sale; a Chapter 13 filing can catch up arrears over time. For a repossessed car, the lender generally must send at least 15 days’ written notice before disposing of it, and the deficiency rules are strict.
California does not use the federal exemptions. Filers choose between two state systems, one built around a substantial homestead exemption and another with a flexible wildcard that often suits renters, and you must live in the state long enough to use them. Which one fits depends on your equity, vehicle, and savings. In a bankruptcy the case would be filed in the court division determined by your street address zip code; Norwalk and surrounding Los Angeles County communities are generally handled by the Los Angeles Division, which serves most of the county, and your attorney will confirm that with the court’s zip code locator before filing.
Norwalk Debt Settlement Questions Answered
How does debt settlement actually work?
Your attorney negotiates with the creditor or collector to accept less than the full balance as payment in full, either as a lump sum or over agreed installments. The agreement should be put in writing before you pay, and it should state that the account is resolved and that no further balance will be pursued.
Will settling debt hurt my credit?
Yes, to a degree. A settled account is typically reported as settled for less than the full balance, which is a negative mark. But accounts that are already delinquent or in collections are usually damaging your score anyway, and many clients find that resolving them clears the way to rebuild.
What if I cannot afford any settlement offer?
Then bankruptcy deserves a close look. Chapter 7 can eliminate qualifying unsecured debt such as credit cards, medical bills, and personal loans, and most cases finish in roughly four months. Chapter 13 reorganizes debt into one payment over three to five years.
Can a creditor sue me while I am negotiating?
Yes. Negotiating does not pause a lawsuit unless the creditor agrees to hold off. If you have been served, the response deadline keeps running, which is why a lawyer should deal with the court papers at the same time as the settlement talks.
Is a very old debt worth paying or settling?
Not necessarily. If a debt is beyond the four-year window for a written contract, the creditor may be barred from suing, but you must raise that in a written answer if you are sued. A payment on a time-barred debt does not revive it, but you should talk to a lawyer before engaging with any collector about it.
What happens to a settled debt if the creditor sold it to a collector?
The collector stands in the creditor’s shoes and can negotiate, often at a bigger discount because it bought the account cheaply. Ask for proof of ownership of the debt and keep a signed settlement agreement showing the account is closed.
Can I settle a debt after a judgment was entered against me?
Yes. Judgment creditors often accept less than the judgment amount to avoid collection costs, especially when wages are exempt or the debtor has few levy-able assets. Get a signed satisfaction of judgment so liens come off and the matter cannot be revived.
Does settlement stop wage garnishment?
A signed settlement can end an existing garnishment when the creditor releases it, but until that happens the garnishment continues. If the garnishment is causing immediate hardship, bankruptcy can halt it right away through the automatic stay.
Is it worth hiring a lawyer for a small debt?
Often it is, if you have been sued or the debt carries added interest and fees. A lawyer can check whether the claim is time-barred, whether the collector can prove ownership, and whether a Rosenthal Act violation gives you leverage.
Will my employer find out if I settle or file?
Not automatically. An employer usually learns of financial trouble only if it is a creditor or if it receives a garnishment order. State law bars firing an employee for a single-judgment garnishment, and federal and California law prohibit termination based solely on a bankruptcy filing.
Do I have to come into an office to start?
No. The firm handles consultations and entire cases by phone, email, video, and online chat, and the first consultation is free.
