Pomona Wage Garnishment Lawyer

Pomona workers who open a pay stub and find a chunk missing have a decision to make, and it is better made in days than in months. Wadhwani & Shanfeld is a consumer bankruptcy and debt relief law firm that handles wage garnishment, Chapter 7 and Chapter 13 bankruptcy, debt settlement, and creditor lawsuits for clients in Pomona, the rest of Los Angeles County, and across Southern California.

A Pomona wage garnishment lawyer is usually called because a creditor already won a judgment, and the judgment now lets the creditor instruct your employer to take part of every paycheck. The choices from there are real ones: challenge the amount, claim a hardship exemption, negotiate a payoff, or file bankruptcy and stop the deductions at once. Each path has different costs and different consequences for your car, your home, and your savings, so the order in which you act matters.

The good news is that a garnishment is not a life sentence. It has legal limits, it can be contested, and in many cases it can be ended outright. What follows lays out how California garnishment actually works, what your options look like, and what to do this week.

Why Choose Wadhwani & Shanfeld for Wage Garnishment Defense

Wadhwani & Shanfeld has helped more than 30,000 individuals and families get out from under debt. The firm is led by two Board-Certified Specialists in Consumer Bankruptcy through the American Board of Certification, and the attorneys bring more than 90 years of combined legal experience. The firm serves clients across Los Angeles, Orange, Riverside, and San Bernardino Counties, and it files in every division of the U.S. Bankruptcy Court for the Central District of California.

Raj Wadhwani, founding shareholder and partner, is a Southwestern Law School graduate who helped pilot the Best Case Bankruptcy software in 1998 and was the first attorney to file a bankruptcy case electronically in the Central District of California. Greg Shanfeld, founding shareholder and partner, earned his law degree from the University of Southern California and has handled more than 10,000 bankruptcy cases over three decades. Both are board certified, a distinction held by a small fraction of attorneys nationally.

For garnishment cases, those credentials matter for a practical reason: a garnishment is usually a deadline problem. Speed of filing is what stops the next paycheck from being cut. The firm offers direct access to an attorney from the first call, acts fast when a garnishment, foreclosure sale, or repossession is days away, and handles cases fully by phone, email, video, and online chat, with 100% virtual consultations available. The first consultation is free, and the recommendation you get covers bankruptcy and the alternatives to it, so the advice is not shaped by a single service the firm happens to sell.

Situations That Lead to Paycheck Garnishment in Pomona

  • Credit Card Judgments: The most frequent source. A card issuer or debt buyer sues, you miss the response deadline or lose, and the judgment lets the creditor go after your wages.
  • Medical Bill Judgments: Hospital and provider accounts sent to collections can become lawsuits and judgments just like card debt, and they are generally dischargeable in bankruptcy.
  • Personal and Payday Loans: Unsecured loans that went unpaid often end in a collection suit, followed by a wage levy once judgment is entered.
  • Auto Repossession Deficiencies: After a vehicle is repossessed and sold, the lender can sue for the shortfall and then garnish to collect it.
  • Foreclosure or Second Mortgage Deficiencies: Certain second mortgage balances and related debts can turn into judgments that reach your paycheck.
  • IRS Tax Debt: Federal tax collection works differently from a civil judgment, with its own levy process, and representation with the IRS can stop levies and set up payment arrangements.
  • Bank Account Levies Alongside Wages: Creditors often levy the bank account and the paycheck together, and the protections for each are different.
  • Small Business Debt: Owners who guaranteed business loans or credit lines personally can find those debts attached to their own earnings.

What to Do the Week You Learn Your Pay Is Being Garnished

Start by finding out what you are actually dealing with. Get the paperwork: the judgment, the earnings withholding order your employer received, and any notice from the creditor or its law firm. In Southern California, collection firms such as Hunt & Henriques, Reese Law Group, and Patenaude & Felix file many of these suits. Knowing who holds the judgment and when it was entered tells us which defenses and which options are on the table.

Next, check the amount being taken. On an ordinary judgment, California caps the garnishment at the lesser of 20 percent of your weekly disposable earnings or 40 percent of the amount by which those earnings exceed 48 times the minimum hourly wage. For biweekly, semimonthly, and monthly paychecks, the multiplier is 96, 104, and 208 instead of 48. If your local minimum wage is higher than the state minimum, the higher local figure is used. Employers and levying officers get this math wrong, and it is worth having it checked against your pay stub.

Third, understand that you may be able to reduce the garnishment even without bankruptcy. California lets a judgment debtor claim as exempt the portion of earnings proven necessary to support yourself or your family. That is a hardship claim that must be filed and supported with a budget, and the creditor can object. It can bring relief, but it is a request the court has to grant, while bankruptcy is automatic.

That is the central decision. Filing a Chapter 7 or Chapter 13 case triggers the automatic stay the moment the petition is filed, which halts most garnishments, bank levies, and further collection. Pomona residents are filing into the U.S. Bankruptcy Court for the Central District of California, and the division that handles a case depends on the zip code of your street address, which we confirm before filing. If your civil case is still pending, it is also worth knowing that Los Angeles County Superior Court has a courthouse in Pomona, Pomona Courthouse South, and a judgment from that court is the usual starting point for a levy.

Two mistakes come up repeatedly. The first is ignoring the lawsuit, because a missed response deadline is how most garnishments begin. The second is quitting a job to avoid the levy, which does not erase the debt or the judgment and usually just costs you income. California law bars an employer from firing you because your wages are garnished for a single judgment, so the more useful move is to call us before the next payday.

Garnishment Versus Bankruptcy Versus Settlement: How the Choice Plays Out

Chapter 7 is the fastest route to ending a garnishment on unsecured debt. Most cases finish in roughly four months, qualifying debts such as credit cards, medical bills, and personal loans are discharged, and the stay stops the paycheck deductions as soon as the case is filed. You must pass the means test, which compares your household income to the California median for your household size and then accounts for actual expenses. Most clients keep everything they own, because California exemption law protects home equity, vehicles, household goods, tools of the trade, and retirement accounts.

California filers choose between two exemption systems, the standard state system with its homestead protection and an alternative system with a flexible wildcard that often suits renters better. You must pick one for the entire case, and you generally need to have lived in California for at least 730 days to use the state exemptions. This choice is among the most consequential in a case, which is part of why board-certified attorneys make it rather than a petition preparer working from a form.

Chapter 13 fits people with steady income who need structure instead of a wipeout. Debts are reorganized into one monthly payment over three to five years, and creditors are bound once the court confirms the plan. It is often the better answer when income is above the Chapter 7 limits, when you are behind on a mortgage or car loan and want to keep the property, or when you owe debts Chapter 7 cannot eliminate.

Debt settlement sits outside the court system. We negotiate directly with the creditor to settle for less than the balance, which can end a garnishment without a bankruptcy filing. It works best when you can fund a lump sum or a short payment plan and when the amount owed is manageable. If the numbers do not support settlement, we say so.

One more timing issue deserves attention. In California, a money judgment is enforceable for 10 years from entry, and a creditor can renew it, though for personal debt judgments under a set dollar level and medical judgments, renewal is limited to one time for five years. Separately, the window to sue on a written contract debt is four years, and an oral contract is two. If a creditor sued after that window closed, the expired deadline is a defense, but it only works if you raise it in a written answer. A payment cannot revive a debt that is already time-barred.

Pomona Wage Garnishment Questions, Answered

How much can be taken from my paycheck in California?

On an ordinary consumer judgment, the cap is the lesser of 20 percent of weekly disposable earnings or 40 percent of the amount your weekly disposable earnings exceed 48 times the minimum hourly wage. Lower earners often lose far less than 20 percent, and sometimes nothing. Support orders and tax levies follow different rules.

Can I stop a garnishment right away?

Filing bankruptcy does it. The automatic stay takes effect the moment the petition is filed, and most garnishments must stop. In an emergency we can often prepare and file quickly.

Will my employer find out?

Your employer already knows once it receives the withholding order, since it must carry out the garnishment. Filing bankruptcy then tells the employer to stop. Labor Code protections bar firing you because wages are garnished for one judgment, and California and federal law bar firing solely for filing bankruptcy.

Can a creditor garnish my wages without suing me first?

For ordinary consumer debt, no. A creditor generally needs a court judgment first. Tax debts and certain government debts follow separate collection rules, which is why identifying the creditor matters.

What if I never got served with the lawsuit?

A judgment entered without proper service can sometimes be challenged. This is time sensitive and fact specific, so bring whatever paperwork you have and we can look at how the case was handled.

Can the creditor also take money from my bank account?

Yes, through a separate bank levy. California automatically protects a set amount in a deposit account without you filing a claim, and the bank must apply that protection before turning money over. That protection does not apply to levies for wages owed to another person, child or spousal support, or debts owed to the state.

Does Chapter 7 or Chapter 13 stop garnishment better?

Both trigger the automatic stay. Chapter 7 wipes out qualifying unsecured debt and ends the garnishment permanently. Chapter 13 stops it and folds the judgment into a repayment plan. Which one fits depends on income, property, and the type of debt.

Is my judgment good forever?

No. A California money judgment is enforceable for 10 years from entry and can be renewed, though renewal is limited for certain medical and personal debt judgments.

Could I get back money already taken?

Sometimes. If the creditor took more than the legal cap, or if garnished wages were collected shortly before a bankruptcy filing, there may be recovery or credit options. We review the pay history to see what applies.

Can I handle this without coming into an office?

Yes. We handle cases by phone, email, video, and online chat for clients anywhere in Southern California, including Pomona, and offer 100% virtual consultations.

Can a paralegal or document preparer file this for me?

A petition preparer can type forms but cannot give legal advice, choose exemptions, or represent you if a trustee or creditor objects. Errors can cost you property or your discharge.

Does the creditor’s law firm matter?

It can. Collectors and original creditors in California are covered by the Rosenthal Act, which allows recovery of actual damages, additional damages up to a set amount for willful violations, and attorney fees for a prevailing consumer. The suit must be brought within one year, so abusive collection conduct should be raised early.
