Redondo Beach Chapter 7 Bankruptcy Lawyer
The goal of a Chapter 7 case is simple to say and hard to reach alone: walk out with qualifying debt wiped away, your home, car, and paycheck intact, and creditors no longer calling. Wadhwani & Shanfeld is a consumer bankruptcy and debt relief law firm that handles Chapter 7 and Chapter 13 filings for people in Redondo Beach and across Los Angeles County, Orange County, Riverside County, and San Bernardino County.
If you are searching for a Redondo Beach Chapter 7 bankruptcy lawyer, you are probably dealing with some mix of credit card balances, medical bills, personal loans, a collection lawsuit, or a garnishment notice. Chapter 7 is built for exactly that unsecured debt, and most cases wrap up in roughly four months.
What Chapter 7 Does for Debt Owed by South Bay Households
Chapter 7 discharges qualifying unsecured debt. That covers credit cards, medical bills, payday and personal loans, and deficiency balances left after a repossession or foreclosure. Some older income tax debt can also be eliminated if it meets specific timing rules. Child support, alimony, most student loans, most government fines, and debts from drunk-driving injuries generally survive.
The word “liquidation” scares people, but it rarely describes what happens. In the great majority of our clients’ cases, the filer keeps everything they own, because California’s exemption laws protect home equity, vehicles, household goods, tools of the trade, and retirement accounts. Before we file, we work through every available exemption to confirm your property is covered.
Why Choose Wadhwani & Shanfeld for Your Chapter 7 Case
Wadhwani & Shanfeld has helped more than 30,000 individuals and families get out from under debt. The firm is led by two Board-Certified Specialists in Consumer Bankruptcy through the American Board of Certification, a distinction held by a small fraction of attorneys nationwide, and the team carries more than 90 years of combined legal experience. We serve clients throughout Los Angeles, Orange, Riverside, and San Bernardino Counties, and we handle cases by phone, email, video, and online chat as well as in person. You get direct access to an attorney from your first call, and we move fast when a garnishment, foreclosure sale, or repossession is days away.
Raj Wadhwani, a founding shareholder and partner, is a Southwestern Law School graduate who helped pilot the Best Case Bankruptcy software in 1998 and was the first attorney to file a bankruptcy case electronically in the Central District of California. Greg Shanfeld, also a founding shareholder and partner, earned his law degree from the University of Southern California and has handled more than 10,000 bankruptcy cases over three decades. Both hold board certification in consumer bankruptcy.
That depth matters in Chapter 7 because the filing is only as good as the choices made before it: which exemption system to use, how to treat the last few months of payments and transfers, and whether Chapter 7 is truly the right chapter at all. The firm files in every division of the U.S. Bankruptcy Court for the Central District of California, and if Chapter 7 is not your best route, we will say so and walk you through Chapter 13 or debt settlement instead. Free consultations are available, including 100% virtual ones.
Debt Situations That Lead Redondo Beach Residents to File
- Credit Card Balances: Revolving debt that has outgrown your income is the classic Chapter 7 case, especially after a job loss, reduced hours, or a stretch of rising rent and living costs.
- Medical Bills: Unsecured medical debt is dischargeable, so an illness or surgery that left you with bills you cannot repay can be wiped out along with everything else.
- Collection Lawsuits: Once a creditor or its law firm sues you, a judgment can lead to wage garnishment or a bank levy. Filing triggers the automatic stay, which halts the suit and enforcement.
- Wage Garnishment: A garnishment on an ordinary judgment can take a meaningful slice of each paycheck. A Chapter 7 or Chapter 13 filing stops most garnishments the moment the case is filed.
- Personal and Payday Loans: High-interest unsecured loans are generally dischargeable, which ends the cycle of borrowing to cover the last loan.
- Repossession Deficiencies: When a repossessed car sells for less than you owe, the leftover balance is unsecured debt that Chapter 7 can eliminate.
- Older Income Tax Debt: Some income taxes can be discharged if they satisfy the timing rules, which we check before recommending a chapter.
- Small Business Debt: Owners who personally guaranteed business obligations often find that debt sits in their personal bankruptcy, and we handle small business bankruptcy and business debt solutions.
Do You Qualify? The Means Test and Your Property
To file Chapter 7, your household income generally has to pass the means test. The test compares your income to the California median for a household of your size, and if you are above it, it then accounts for your actual allowed expenses. Pass, and you are eligible. Fail, and Chapter 13 is often the better fit because it reorganizes your debts into one payment over three to five years based on what you can afford. The median figures are updated periodically, so we run your numbers against the current ones rather than guessing.
The second question is property. California has opted out of the federal exemptions, so you choose one of two state systems for the entire case. The first, found in CCP section 704, offers a homestead exemption tied to your county’s median home price within a statutory range, which is why it often favors homeowners with real equity. The second, under section 703.140(b), is smaller on the home but includes a flexible wildcard that frequently works better for renters. You also generally need to have lived in California for 730 days to use California’s exemptions. Picking the wrong system can cost you property, so this is one of the most consequential decisions we make with you.
What to Do Right Now and Where Your Case Will Be Heard
Start by gathering what a bankruptcy attorney will need: recent pay stubs, the last couple of years of tax returns, bank statements, a list of every creditor, any lawsuit papers, and deeds and car titles. Do not pay one creditor in a rush or move property to a relative. Those moves can create problems the trustee will unwind. Stop using credit cards you plan to discharge.
If you have been served with a lawsuit, the response deadline matters. An expired statute of limitations is a defense, but you have to raise it in a written answer, or a court can still enter judgment. California gives creditors four years on written contract and book account claims and two years on oral contracts, and a payment on a time-barred debt does not revive it. Do not ignore papers hoping the problem fades. Call before the response deadline passes, and we can tell you whether to answer, negotiate, or file.
If a deadline is closer, such as a foreclosure sale, you have limited time to act. A trustee’s sale cannot be set earlier than three months and 20 days after the notice of default is recorded, and the notice of sale must be mailed and posted at least 20 days before the sale. You can reinstate a monetary default until five business days before the sale. For a repossessed vehicle, the lender must give at least 15 days’ written notice before disposing of it, and you can ask in writing for a 10-day extension of the redemption period. Filing bankruptcy halts all of this the moment the petition is submitted.
Your case is filed in the U.S. Bankruptcy Court for the Central District of California. Which division handles it depends on your street-address zip code, and for most of Los Angeles County that is the Los Angeles Division. We confirm the right division using the court’s locator before filing. A few weeks after you file, you attend a meeting with the trustee, and we prepare you for it. If a creditor sued you earlier, that suit would have been in Los Angeles County Superior Court, which operates a courthouse in Redondo Beach.
Protecting Your Paycheck, Bank Account, and Car
An ordinary wage garnishment is capped at the lesser of 20 percent of weekly disposable earnings or 40 percent of the amount your weekly disposable earnings exceed 48 times the minimum hourly wage, with higher multiples for biweekly, semimonthly, and monthly pay. If the local minimum wage is higher than the state’s, the local rate is used. You can also claim as exempt the portion of earnings proven necessary to support you and your family. Labor Code section 2929 bars an employer from firing you because your wages are garnished for a single judgment. Bankruptcy ends most garnishments outright.
Bank levies work differently. California automatically shields a set amount in your deposit account from a levy without any claim being filed, and the bank must apply that protection before turning money over. It does not apply to levies for wages owed to another, child or spousal support, or debts owed to the state. The amount is adjusted periodically, so we confirm the current figure with you. A Chapter 7 filing stops levies on unsecured judgments altogether.
Redondo Beach Chapter 7 Questions, Answered
How long does a Chapter 7 case take?
Most cases are completed in roughly four months from filing to discharge. The automatic stay protects you from the day we file, long before the discharge arrives.
Will I lose my house or car?
Most of our clients keep their homes and vehicles. In Chapter 7, the question is whether your equity is covered by the exemption system we choose, and whether you are current on the loan. If you have more equity than the exemption covers or you are behind on payments, Chapter 13 may let you keep the property and catch up over time.
What debts cannot be erased?
Child support, alimony, most student loans, most government fines, and debts for injuries caused by drunk driving generally cannot be discharged. Some older income taxes can be, if they meet specific timing rules.
How does the means test work?
It starts by comparing your household income to the California median for your household size. If you are at or under it, you generally qualify. If you are over it, the test looks at allowed expenses to see whether you have enough left over to fund a repayment plan.
Will my employer find out?
Not automatically. They may learn of it if they are a creditor or if a garnishment has to stop. California and federal law bar an employer from firing you solely for filing.
Can I file again if I filed before?
Yes, subject to waiting periods. You must wait 8 years between Chapter 7 filings, 4 years to file Chapter 13 after a Chapter 7, 2 years between Chapter 13 filings, and generally 6 years to file Chapter 7 after a Chapter 13, though that last period can be shortened if your plan paid enough to unsecured creditors.
If a collector has been harassing me, do I have any claim against them?
Possibly. California’s Rosenthal Act covers original creditors as well as third-party collectors. A consumer can recover actual damages, and a court can add $100 to $1,000 if the collector acted willfully and knowingly, plus reasonable attorney fees. The suit must be brought within one year, so tell us about harassment early.
What if a judgment was entered against me years ago?
A California money judgment is generally enforceable for 10 years from entry and can be renewed. Recent law limits renewal to a single five-year extension for medical judgments under $200,000 and personal debt judgments under $50,000. Whether a judgment can still be enforced against you is worth checking before you decide how to deal with it.
Can a paralegal or notary file my Chapter 7 for me?
A petition preparer can type information into forms but cannot give legal advice, choose exemptions, or represent you if a trustee or creditor objects. A mistake in the filing can cost you property or your discharge, which is why we recommend representation by a bankruptcy attorney.
How soon can I rebuild credit?
Many clients see scores begin recovering within the first year by using a secured card responsibly, paying every bill on time, and keeping balances low. A Chapter 7 can remain on your credit report for up to 10 years, but its effect fades well before then.
Do I have to come into an office?
No. We handle cases fully by phone, email, video, and online chat, and 100% virtual consultations are available.
