Santa Ana Student Loan Debt Lawyer

Orange County’s bankruptcy cases are heard in the Santa Ana Division of the U.S. Bankruptcy Court for the Central District of California, and that is where a student loan discharge fight would be decided if a borrower ever pursued one. Wadhwani & Shanfeld is a consumer bankruptcy and debt relief law firm that handles student loan debt strategies, Chapter 7, Chapter 13, debt settlement, wage garnishment, and creditor lawsuits for clients in Santa Ana and across Orange County and Southern California.

If you need a Santa Ana student loan debt lawyer, the first thing to know is that student loans behave differently from almost every other debt you owe. Credit cards and medical bills can usually be wiped out in a Chapter 7 case, but most student loans cannot. That does not mean bankruptcy is irrelevant to you. Clearing your other debts can free up the income you need to deal with the loans, and a Chapter 13 plan can give you breathing room while you sort out a repayment path.

The right answer depends on whether your loans are federal or private, who is collecting, and whether anyone has sued you or started taking money from your paycheck or bank account. Those details determine your options, and the sooner they are sorted out, the more choices you keep.

Why Choose Wadhwani & Shanfeld for Student Loan Debt Problems

Wadhwani & Shanfeld has helped more than 30,000 individuals and families get out from under debt, serving Orange, Los Angeles, Riverside, and San Bernardino Counties. The firm is led by two Board-Certified Specialists in Consumer Bankruptcy through the American Board of Certification, a credential held by only a small fraction of attorneys nationally, and the firm brings more than 90 years of combined legal experience to every file. Clients get direct access to an attorney from the very first call, a free consultation, and the option to handle everything by phone, email, video, or online chat.

Raj Wadhwani, a founding shareholder and Board-Certified Specialist in Consumer Bankruptcy, is a Southwestern Law School graduate who helped pilot the Best Case Bankruptcy software in 1998 and was the first attorney to file a bankruptcy case electronically in the Central District of California. Greg Shanfeld, also a founding shareholder and Board-Certified Specialist in Consumer Bankruptcy, earned his law degree from the University of Southern California and has handled more than 10,000 bankruptcy cases over three decades. The firm files in every division of the Central District, including Santa Ana.

That depth matters for student loans because the work is rarely about one filing. It is about sequencing: which debts to eliminate, which to restructure, what to do about a garnishment that is about to hit, and whether bankruptcy should be used at all. Because the firm handles both bankruptcy and its alternatives, you get a recommendation based on what fits your situation. When a garnishment, foreclosure sale, or repossession is days away, the firm acts fast.

Student Loan Situations We See in Orange County

  • Federal Student Loans in Default: Federal lenders have collection tools that private creditors lack, and wage garnishment and offsets can begin without a lawsuit. A default is often the point where borrowers first call an attorney.
  • Private Student Loans After a Lawsuit: Private lenders and the collection firms that buy their accounts do sue in Orange County Superior Court. Once a judgment is entered, wage garnishment and bank levies become possible.
  • Old Private Loans Past the Filing Deadline: A suit on a written contract generally must be filed within four years under California law. The expired deadline is a defense you must raise in a written answer, or the court can still enter judgment against you.
  • Student Loans Plus Credit Card and Medical Debt: Many borrowers owe on loans and also carry unsecured balances that Chapter 7 can discharge. Eliminating those frees monthly income for the loans.
  • Loans Alongside a Mortgage or Car Payment at Risk: When the student loan payment is crowding out a mortgage or auto loan, Chapter 13 can let you catch up on those secured debts over time while keeping the property.
  • Garnished Wages or Frozen Bank Accounts: A garnishment or levy tied to a loan judgment can often be stopped or reduced, either through exemptions or through the automatic stay once a bankruptcy case is filed.
  • Co-Signed or Parent-Borrowed Loans: When a parent or relative signed or borrowed on a student’s behalf, the strategy has to account for everyone liable on the contract, not just the person calling us.

What to Do Now If Student Loan Collection Is Closing In

Start by gathering paper. Pull every notice you have received, including letters from servicers, collection firms, or a court, and write down who owns each loan. Federal and private loans follow different rules, so knowing which is which comes first. If you have been served with a lawsuit, the response deadline is short and does not pause because you are weighing options. A missed deadline lets the other side seek a default judgment, so call before it passes. In Orange County, civil suits like these are typically heard through the Orange County Superior Court, with the Central Justice Center in Santa Ana handling many of them.

Do not make a payment on a very old loan without talking to a lawyer first. Under California law, a payment cannot revive a debt that is already time-barred, but a signed written acknowledgment of the debt can restart the clock, and informal conversations with collectors sometimes go sideways. Do not sign anything a collector sends you until someone has read it.

If wages are already being taken, understand the limits. On an ordinary judgment, a garnishment is capped at the lesser of 20 percent of your weekly disposable earnings or 40 percent of the amount by which those earnings exceed 48 times the minimum hourly wage. Different multiples apply to biweekly, semimonthly, and monthly pay, and if the local minimum wage is higher than the state’s, the local rate is used. You can also claim as exempt the portion of earnings shown to be necessary to support you or your family. Your employer may not fire you because of a garnishment on a single judgment.

For bank accounts, California automatically protects a set amount in a deposit account from a levy, and the bank must apply that protection before turning money over, with no claim required. That protection has exceptions, including levies for child or spousal support and debts owed to the state, so it is not a complete shield.

Finally, talk to an attorney about whether filing makes sense. If you file Chapter 7 or Chapter 13, the automatic stay takes effect the moment the case is filed and halts most garnishments, lawsuits, and levies. For Orange County residents, cases are filed in the Santa Ana Division, which serves the county. We handle the whole process, and you can meet with us by phone or video.

How Bankruptcy Fits Around Student Loans

Most student loan debt is not discharged in a standard bankruptcy case. Getting a loan discharged generally requires a separate proceeding in which the borrower must prove undue hardship, and that is a demanding standard. We tell clients plainly when that route is unrealistic, and we do not promise results that the law does not support.

What bankruptcy does well is clear everything around the loans. Credit cards, medical bills, personal loans, payday loans, and repossession deficiencies are typically dischargeable in Chapter 7 if you pass the means test, which compares your income to the California median for your household size and then accounts for your expenses. Chapter 13 is built for people with steady income who need structure. It consolidates what you owe into one monthly payment over three to five years, and it can help you keep a home or car while you recover. Once the other pressure is gone, a borrower has more room to pursue repayment programs, negotiated resolutions, or other strategies on the loans themselves.

Exemptions matter too. California does not allow filers to use the federal exemption system. You choose between two state systems, one with a larger homestead protection that suits many homeowners and one with a flexible wildcard that often suits renters. You must pick one system for the whole case, and you generally must have lived in California for at least 730 days to use them. We work through this choice carefully because it determines what property you keep.

Student Loan Debt Questions Answered

Can student loans be discharged in bankruptcy?

Not automatically. Most student loans survive a typical Chapter 7 or Chapter 13 discharge. Eliminating them usually requires a separate court proceeding and proof of undue hardship, which is a high bar. We will tell you honestly whether that path is realistic for you.

Is it worth filing bankruptcy if I cannot discharge the loans?

Often yes. If credit cards, medical bills, or personal loans are eating your income, eliminating them can free money for the student loans. The automatic stay also stops lawsuits and garnishments while you regroup.

How long do lenders have to sue me over a student loan?

For a written contract debt, California generally allows four years to sue, and two years for an oral contract. Which deadline and which start date apply depend on your specific loan, and federal loans can follow different rules, so have the paperwork reviewed.

What if the lender sues me after the deadline has passed?

The expired deadline is a defense, but it is not automatic. You must raise it in a written answer, or the court can still enter judgment. Ignoring the lawsuit is the worst response.

Will making a small payment restart the clock?

A payment alone cannot revive a debt that is already time-barred in California. A signed written acknowledgment of the debt can restart the period, so be careful about what you sign.

How much of my paycheck can be garnished?

On an ordinary judgment, the cap is the lesser of 20 percent of weekly disposable earnings or 40 percent of the amount by which those earnings exceed 48 times the minimum hourly wage, with different multiples for other pay periods. You can also ask the court to exempt earnings needed to support your family.

Can a bankruptcy stop a wage garnishment right away?

Yes. Filing triggers the automatic stay, which halts most garnishments as of the filing. In an emergency, we can often prepare and file quickly.

How long can a student loan judgment be enforced in California?

A California money judgment is enforceable for 10 years from entry, and it can be renewed. For personal debt judgments with unpaid principal under $50,000, recent law limits renewal to one time, for five years.

Can my employer fire me because of a garnishment?

No. California law bars an employer from firing you because your wages are garnished for a single judgment. Bankruptcy itself is also a protected filing, and an employer may not fire you solely because you filed.

My parent co-signed my loan. Does that change anything?

It can. Everyone liable on the contract may be pursued, and a bankruptcy filing by one person does not necessarily protect the co-signer. We look at both sides before recommending a strategy.

Do I have to come to an office to work with you?

No. We offer 100% virtual consultations and can handle your case by phone, email, video, and online chat. If you prefer to meet in person, we can arrange that.

Can a paralegal or document preparer handle this for me?

A preparer can type your information into forms, but cannot give legal advice, choose your exemptions, or represent you if a creditor or trustee objects. Mistakes can cost you property or your discharge.
