Santa Monica Debt Relief Lawyer

Wadhwani & Shanfeld is a consumer bankruptcy and debt relief law firm that helps people across Santa Monica and the rest of Los Angeles County get out from under credit card balances, medical bills, personal loans, tax debt, wage garnishments, and creditor lawsuits. A Santa Monica debt relief lawyer at the firm can sit down with you, look at what you owe and what you earn, and tell you plainly whether bankruptcy, settlement, or a fight in court is the better route.

Santa Monica is an expensive place to live, and that shapes how debt problems start here. Rent and mortgage payments take a large share of a paycheck, so a few months of reduced hours or one unexpected medical bill can push a household from tight to underwater. By the time people call, they usually have a pile of collection letters, a few creditors calling daily, and sometimes a summons from a court in the county.

Debt relief is not one product. It is a set of tools: Chapter 7, Chapter 13, negotiated settlements, defenses to a lawsuit, and challenges to improper collection tactics. Picking the right one depends on your income, your property, and which creditors are closing in first.

Where Debt Cases Actually Start and How They Progress

Most debt cases follow a recognizable arc. First come the missed payments and the calls. Then the account is charged off or sold to a collection company. Eventually a creditor or debt buyer files a lawsuit, and that is where the timeline gets short. In Los Angeles County, collection suits against Santa Monica residents are typically heard in the county’s Superior Court system, which has a Santa Monica courthouse as well as a Central District courthouse downtown.

Once you are served, a written response is due by a deadline stated on the summons. Ignoring it is the costliest mistake in the whole process. If you do not file an answer, the court can enter a default judgment, and a judgment is what lets a creditor reach your paycheck and bank account.

A judgment in California stays enforceable for 10 years from the date it is entered, and it can be renewed. For judgments on personal debts under a certain size and medical debts, recent reforms limit renewal to a single five-year extension. That means a judgment can follow you for a long time, which is one reason people choose to resolve the underlying debt rather than wait it out.

Why Choose Wadhwani & Shanfeld for Debt Relief in Santa Monica

The firm is led by two Board-Certified Specialists in Consumer Bankruptcy through the American Board of Certification: founding shareholders Raj Wadhwani and Greg Shanfeld. Together the firm’s attorneys bring more than 90 years of combined legal experience.

Raj Wadhwani, a Southwestern Law School graduate, helped pilot the Best Case Bankruptcy software in 1998 and was the first attorney to file a bankruptcy case electronically in the Central District of California. Greg Shanfeld earned his law degree from the University of Southern California and has handled more than 10,000 bankruptcy cases over three decades. The firm files in every division of the U.S. Bankruptcy Court for the Central District of California, so the court a Santa Monica client is assigned to is never a limitation.

For a debt relief client, the practical benefits are concrete. You reach an attorney directly from your first call, and the consultation is free. When a garnishment, foreclosure sale, or repossession is days away, the firm moves fast. The whole case can be handled by phone, email, video, and online chat, and 100% virtual consultations are available, which matters if you are working long hours or commuting across the county. Because the firm handles bankruptcy and the alternatives to it, the recommendation you get is based on your numbers rather than on the only service on offer.

The Debt Problems We Handle for Santa Monica Clients

  • Credit Card Debt: Revolving balances that grew through job loss, rising living costs, or a stretch of covering rent on plastic. These are unsecured debts that Chapter 7 can eliminate and that settlement can often reduce.
  • Medical Bills: Emergency care, surgery, or an uninsured stretch can generate balances that go to collections quickly. Medical debt is treated as unsecured and is generally dischargeable.
  • Creditor Lawsuits and Judgments: Suits filed by banks, debt buyers, and collection firms. We can evaluate defenses, including an expired limitations period, negotiate, or file bankruptcy to stop the case.
  • Wage Garnishment: A judgment creditor can take a portion of each paycheck. The ordinary cap is the lesser of 20 percent of disposable earnings or a figure tied to the minimum wage, and a bankruptcy filing stops most garnishments immediately.
  • Foreclosure and Second Mortgages: Homeowners behind on a mortgage or carrying a second loan that exceeds the home’s value. Chapter 13 can catch up arrears, and in some cases a wholly unsecured second mortgage can be removed.
  • IRS Tax Debt: Levies, liens, and unpaid balances that need payment arrangements or, in some cases, discharge if older income tax meets timing rules.
  • Personal Loans and Repossession Deficiencies: Unsecured loans and the balance left over after a car is taken and sold, which Chapter 7 can often wipe out.
  • Student Loans and Small Business Debt: Student loan strategies and business debt solutions for owners whose personal finances are tied to a struggling company.

What to Do Right Now If Creditors Are Closing In

Start by gathering what you have: every collection letter, any summons and complaint, recent pay stubs, a list of your debts, and statements for your bank accounts. Do not throw away court papers, and do not ignore them. If you have been served, look at the response deadline and call before it passes. A lawyer can tell you whether to answer, negotiate, or file for bankruptcy, and the deadline for a written response is unforgiving.

If you are being sued on an old account, check the age of the debt. In California, a written contract claim generally must be filed within four years, and an oral contract claim within two. The expired deadline is a defense you must raise yourself in a written answer; the court will not raise it for you. Also be careful about what you say to collectors. A payment on a time-barred debt does not revive it, but a signed written acknowledgment can restart the clock, so do not sign anything without advice.

If a garnishment has started or your bank account has been levied, know that some protection exists automatically. California shields a set amount in a deposit account from a levy without any paperwork, and the bank is supposed to apply that protection before releasing funds. It does not cover every kind of debt, such as support obligations or amounts owed to the state, so do not assume it will solve the problem. If wages are being taken, you can also ask the court to exempt the portion you can show you need to support yourself and your family.

When bankruptcy is the right answer, the petition is filed in the U.S. Bankruptcy Court for the Central District of California, and your street address, not a P.O. box, determines which division handles it. The Los Angeles Division covers most of the county. Filing triggers the automatic stay, which halts lawsuits, garnishments, levies, and collection calls. A hearing with the trustee follows, and most Chapter 7 cases wrap up in about four months. Chapter 13 runs three to five years on a court-approved plan.

Choosing Between Bankruptcy, Settlement, and Fighting the Claim

Chapter 7 is built for people whose income is low enough to pass the means test, which compares your household income with the California median for your household size and then looks at your actual expenses. It eliminates qualifying unsecured debt. Chapter 13 is for people with steady income who need time to catch up on a mortgage or car loan, who are over the Chapter 7 limits, or who owe priority debts like certain taxes or support arrears.

Debt settlement is different. We negotiate with the creditor to accept less than you owe. It can work well when the debt is manageable in size and you can fund a lump sum or a short payment plan, but it does nothing to stop a lawsuit in progress the way a bankruptcy filing does. Sometimes the best answer is none of these: a collector who has broken the law may owe you money. California’s Rosenthal Act covers original creditors as well as third-party collectors, and a consumer who proves a violation can recover actual damages, an additional award of $100 to $1,000 for willful violations, and attorney fees. The suit must be brought within one year.

What you can keep matters as much as what you can discharge. California does not use the federal exemptions. Filers choose between two state systems, one with a large homestead exemption for homeowners and one with a flexible wildcard that often suits renters. You pick one for the entire case, and you must have lived in California long enough to use the state’s exemptions. In a county with high home values, the homestead protection tied to local median prices can be significant, which is why many homeowners keep their homes in Chapter 7.

Santa Monica Debt Relief Questions, Answered

How fast can bankruptcy stop a garnishment or lawsuit?

The automatic stay takes effect the moment the petition is filed. Creditors must stop collection activity, including lawsuits, wage garnishments, bank levies, and repossessions. When a sale or levy is close, the firm can often prepare and file quickly.

Will I lose my home or car if I file?

Most clients keep both. In Chapter 7, the question is whether your equity falls within California’s exemptions. If you have more equity than the exemption covers, or you are behind on payments, Chapter 13 lets you keep the property and catch up over time.

What debts can bankruptcy eliminate?

Most unsecured debts, including credit cards, medical bills, personal loans, payday loans, and deficiencies after a repossession or foreclosure. Some older income taxes qualify under timing rules. Child support, alimony, most student loans, and most government fines generally survive.

How long can a creditor sue me for an old debt?

For a written contract, the filing period is four years; for an oral contract, two. If you are sued after that, you must raise the expired deadline in a written answer. If you do nothing, the court can still enter judgment.

How long does a judgment last once a creditor wins?

A California money judgment is enforceable for 10 years from entry and can be renewed. Recent reforms limit renewal to one five-year extension for certain personal debt and medical judgments under specific dollar sizes.

Can I be fired because my wages are garnished?

California law bars an employer from firing you because your wages are garnished for a single judgment. Employers also cannot fire you solely because you filed for bankruptcy.

Is my bank account safe if a creditor levies it?

Part of it is. California automatically protects a set amount per debtor in a deposit account, and the bank should apply that protection without you filing anything. It does not apply to levies for support or debts owed to the state, and anything above the protected amount can be taken.

My car was repossessed. Can I still be sued for the balance?

Possibly. The lender must send written notice of intent to sell at least 15 days ahead, and 20 if mailed from or to an address outside California. To hold you liable for a deficiency, the notice has to go out within 60 days of repossession and contain required items. You can also ask in writing for a 10-day extension of the redemption period.

How long do I have to stop a foreclosure?

California foreclosures move on a statutory schedule. A sale date cannot be earlier than three months and 20 days after the notice of default is recorded, and a notice of sale must be mailed and posted at least 20 days before the sale. Reinstatement of a monetary default is allowed until five business days before the sale. Filing bankruptcy halts the process at any point.

Is it worth hiring a lawyer instead of a debt settlement company or document preparer?

A petition preparer can type forms but cannot give legal advice, choose your exemptions, or represent you if a trustee or creditor objects. A mistake in a filing can cost you property or your discharge, which is the strongest case for having a bankruptcy attorney handle it.

Do I have to come into an office?

No. The whole case can be handled by phone, email, video, and online chat, and virtual consultations are available. In-person meetings are welcome if you prefer them.

Which division of the bankruptcy court would my case go to?

That depends on your street address. Santa Monica residents are generally assigned based on zip code through the court’s locator, and the Los Angeles Division covers most of the county. The firm confirms the correct division before filing.
