Sylmar Lawsuits & Judgments Lawyer
A lawsuit from a debt collector is not a final verdict, and a judgment is not the end of the road either. Wadhwani & Shanfeld is a consumer bankruptcy and debt relief law firm that handles creditor lawsuits, judgments, wage garnishment, and bank levies for people in Sylmar and across Los Angeles County, Orange County, Riverside County, and San Bernardino County. If you are looking for a Sylmar lawsuits and judgments lawyer, the first thing to know is that the stage you are at, served but not yet answered, default entered, or judgment already in hand, decides which tools are still available.
Each stage has its own clock. A response to a complaint has a short deadline. A judgment, once entered, can be enforced against your paycheck and bank account. And a bankruptcy filing can stop nearly all of it at once. The sooner the paperwork on your kitchen table is read by a lawyer, the more of those options remain open.
Why Choose Wadhwani & Shanfeld for Creditor Lawsuit and Judgment Defense
Wadhwani & Shanfeld has helped more than 30,000 individuals and families get out from under debt, serving clients throughout Los Angeles County, Orange County, Riverside County, and San Bernardino County, including the San Fernando Valley communities around Sylmar. The firm is led by two Board-Certified Specialists in Consumer Bankruptcy through the American Board of Certification, with more than 90 years of combined legal experience across the team. Clients get direct access to an attorney from the very first call, and the firm moves fast when a garnishment, foreclosure sale, or repossession is days away.
Raj Wadhwani, a founding shareholder and partner, is a Southwestern Law School graduate who helped pilot the Best Case Bankruptcy software in 1998 and was the first attorney to file a bankruptcy case electronically in the Central District of California. Greg Shanfeld, also a founding shareholder and partner, earned his law degree from the University of Southern California and has handled more than 10,000 bankruptcy cases over three decades. The firm files in every division of the U.S. Bankruptcy Court for the Central District of California.
That matters on a lawsuit and judgment page because the best answer to a collection suit is sometimes a response in state court, sometimes a negotiated settlement, and sometimes a bankruptcy petition. A firm that does all three can recommend the one that fits, rather than the only one it sells. Consultations are free, and you can handle everything by phone, email, video, or online chat, with 100% virtual consultations available.
Types of Collection Suits and Judgment Problems We See
- Credit Card Lawsuits: Banks and debt buyers sue on unpaid card balances, often through collection law firms that file in volume. These are typically contract or book account claims, which is where the limitations defense comes in.
- Medical Bill Judgments: Hospital and provider balances that went to collections can become judgments. Medical judgments have their own renewal limits under California law.
- Personal Loan and Payday Loan Suits: Online lenders and installment lenders sue when payments stop, sometimes adding fees and interest that inflate the claim well past the original loan.
- Default Judgments: When a summons is ignored, or never actually reached you, the court can enter judgment without hearing your side. Many people learn about it only when a paycheck shrinks.
- Wage Garnishments: A creditor with a judgment can instruct your employer to withhold part of each paycheck. The amount is capped by formula, and some of it may be exempt if you need it to support your family.
- Bank Levies: A frozen account after a judgment is a levy. California protects a baseline amount in your deposit account automatically, but not against every kind of claim.
- Repossession Deficiencies: After a car is repossessed and sold, the lender may sue for the shortfall. Whether it can depends on whether it followed the notice rules.
- Old Judgments and Renewals: A judgment lasts ten years in California and can be renewed, so a creditor may resurface years later.
What to Do in Sylmar When You Have Been Served or Already Have a Judgment
Start by reading what you actually received. A summons and complaint carries a response deadline, and missing it lets the creditor ask for a default. Do not ignore it because the amount looks wrong or the plaintiff is a company you have never heard of. Collection suits often come from debt buyers, and being wrong about who owns the debt is a reason to answer, not to wait.
Write down the date you were served, the court named on the papers, and the case number. Sylmar sits in the San Fernando Valley, and Los Angeles County Superior Court handles civil cases through its geographic districts, with courthouses in San Fernando, Van Nuys, and Chatsworth among those serving the Valley. Which courthouse your case sits in depends on the filing, so check the papers rather than assume. Then gather the statements, letters, and any earlier collection notices. A lawyer will want to see them to judge whether the suit is timely and whether the plaintiff can prove it owns the debt.
If a judgment has already been entered, the question shifts to enforcement. Look at your most recent pay stub to see whether a garnishment has begun, and check your bank balance before you rely on it. If an account is levied, the bank must apply the automatic deposit account exemption before turning money over, and you do not have to file a claim for that portion. That protection does not reach levies for wages owed to another person, child or spousal support, or debts owed to the state, so the type of creditor matters.
If you want to stop everything at once, bankruptcy is the tool. When a Chapter 7 or Chapter 13 petition is filed, the automatic stay halts lawsuits, judgments, bank levies, wage garnishments, repossessions, and foreclosure proceedings. A Sylmar filer’s case is generally assigned by home zip code, and Sylmar falls within the San Fernando Valley Division of the U.S. Bankruptcy Court for the Central District of California. Your attorney confirms this before filing.
Common mistakes are predictable. People pay a small amount to make the collector go away, not realizing that a payment cannot revive a debt already time-barred, though a signed written acknowledgment can restart the clock on one that is not. Others ignore the summons because the debt is old. Others sign a payment plan on the phone without knowing whether the suit was even valid. Call before you pay, sign, or ignore anything.
The Defenses and Limits That Shape Your Leverage
California gives debtors real defenses, and several are easy to lose by silence. A written contract debt generally must be sued on within four years, and an oral contract debt within two. Book account claims also carry four years. But an expired deadline is a defense you must raise in a written answer. If you do not respond, the court can still enter judgment even though the debt was stale.
Proof is another pressure point. A debt buyer has to show it actually owns your account and can document the balance. Collection suits sometimes lean on thin paperwork, and a properly filed answer forces the plaintiff to prove its case rather than collect by default.
The Rosenthal Fair Debt Collection Practices Act gives California consumers additional protection, and unlike the federal law it reaches original creditors as well as third-party collectors. A consumer can recover actual damages, a court can add $100 to $1,000 for willful and knowing violations, and a prevailing consumer can recover reasonable attorney fees. The suit must be brought within one year, and the collector can avoid liability by curing a violation within 15 days of learning of it. Harassing calls or false statements in a collection campaign can become leverage in a settlement conversation.
How Judgments Are Enforced, and When Bankruptcy Changes the Picture
A California money judgment is enforceable for ten years from entry, and it can be renewed by filing an application, which extends enforceability another ten years from the renewal date. For medical expense judgments with unpaid principal under $200,000 and personal debt judgments with unpaid principal under $50,000, a law that took effect in 2023 allows only a single renewal, and only for five years. That means a creditor cannot hold these judgments over you indefinitely the way it once could.
Wage garnishment on an ordinary judgment is capped by statute at the lesser of 20% of your weekly disposable earnings or 40% of the amount by which those earnings exceed 48 times the minimum hourly wage. Where a local minimum wage is higher than the state’s, the local rate is used. If you are paid biweekly, semimonthly, or monthly, the multiplier is 96, 104, or 208 times the minimum wage instead of 48. You can also ask the court to exempt the portion of your earnings proven necessary to support you or your family. And an employer cannot fire you because your wages are garnished for a single judgment.
A bankruptcy filing can do more than pause enforcement. In Chapter 7, qualifying judgment debt arising from credit cards, medical bills, and personal loans can be discharged, and California’s exemption systems determine what property you keep. California has opted out of the federal exemption scheme, so filers choose either the section 704 system, which includes a large homestead exemption, or the section 703.140(b) system, which includes a wildcard that often suits renters. You must pick one system for the whole case, and you generally must have lived in California for at least 730 days to use them. Chapter 13 is the alternative when you have steady income and want to catch up on a mortgage or car loan while the plan binds your creditors.
Questions About Lawsuits and Judgments in Sylmar
How long do I have to respond to a debt collection lawsuit?
The deadline is printed on the summons you were served with, and it is short. Missing it lets the creditor request a default judgment. Check the paperwork the day it arrives and speak with an attorney before the deadline passes.
Can a creditor sue me for an old debt?
Possibly, but the limitations periods matter. A written contract debt generally carries four years to sue, and an oral contract two. If the deadline has passed, you still must raise it in a written answer. Otherwise the court can enter judgment anyway.
Will making a payment restart the clock on an old debt?
A payment cannot revive a debt that is already time-barred. Only a signed written acknowledgment restarts the period. Be careful about what you sign or say to a collector before you know where the debt stands.
How long can a creditor enforce a judgment against me?
Ten years from entry. A creditor can renew by filing an application, which extends enforceability another ten years, though medical and smaller personal debt judgments face limits on renewal. After enforceability ends, enforcement liens created by the judgment are extinguished.
How much of my paycheck can be garnished?
On an ordinary judgment, the lesser of 20% of weekly disposable earnings or 40% of the amount your weekly earnings exceed 48 times the minimum hourly wage. If your pay period is longer, a larger multiplier applies. You can also claim an exemption for earnings proven necessary to support your family.
Is any money in my bank account protected from a levy?
Yes. California applies a deposit account exemption automatically per judgment debtor, so the bank must set aside that amount before releasing money. It does not apply to levies for wages owed to another person, child or spousal support, or debts owed to the state.
If I file bankruptcy, does the lawsuit stop?
Filing a Chapter 7 or Chapter 13 case triggers the automatic stay, which halts lawsuits, judgments, bank levies, and most wage garnishments from the moment of filing. In an emergency we can often prepare and file a case quickly to stop a levy or sale.
Can I be fired because my wages are being garnished?
Not for a single judgment. California law bars an employer from firing you because your wages are garnished for one judgment. Your employer also does not learn of a bankruptcy automatically, though garnishment itself involves them.
What if I never received the summons and a default judgment was entered against me?
That is a real situation, and there are procedures for challenging a judgment entered without proper notice. Time limits apply, so bring the judgment papers to a lawyer promptly to see whether it can be set aside.
Can a collector be punished for harassing me over a debt?
Under the Rosenthal Act, a consumer can recover actual damages, a court may add $100 to $1,000 for willful and knowing violations, and a prevailing consumer can recover reasonable attorney fees. The claim must be filed within one year, and a collector that fixes a curable violation within 15 days may avoid liability.
Does bankruptcy get rid of a judgment already entered against me?
If the underlying debt is dischargeable, such as credit card or medical debt, Chapter 7 can eliminate it. Some debts, including child support, alimony, most student loans, most government fines, and injury claims tied to drunk driving, generally cannot be discharged.
Is it worth hiring a lawyer for a small collection lawsuit?
Often yes, because a default or a bad settlement can lead to garnishment and a ten-year enforcement window. An attorney can tell you whether to answer, negotiate, or file, and the first consultation is free.
