Tustin Debt Relief Lawyer

Wadhwani & Shanfeld is a consumer bankruptcy and debt relief law firm that helps Tustin residents and families across Orange County get out from under credit card balances, medical bills, personal loans, mortgage trouble, and tax debt. Clients here can reach an attorney directly on the first call, and the firm handles cases by phone, email, video, and online chat as well as in person.

Searching for a Tustin debt relief lawyer usually means something has already gone wrong: a summons has arrived, a paycheck is being trimmed, or a bank account has been frozen. The right answer depends on which of those is happening. A debt that is past the four-year limit for a written contract may need a written response to a lawsuit rather than a bankruptcy. A wage garnishment may be stopped on the day a bankruptcy case is filed. A second mortgage with no equity behind it may be removable in Chapter 13. Debt relief is not one product; it is a choice among several tools, and picking the wrong one costs money.

Debt Relief Options Available to Tustin Residents

The firm works across the full range of consumer debt solutions, which matters because the best fit differs from household to household. Chapter 7 eliminates qualifying unsecured debt, usually in about four months. Chapter 13 reorganizes debt into one payment over three to five years. Debt settlement negotiates with a creditor to accept less than the balance. A Tustin bankruptcy attorney who offers only one of these will tend to recommend that one.

Orange County filers file in the Santa Ana Division of the U.S. Bankruptcy Court for the Central District of California, and the debtor’s zip code determines the division. Wadhwani & Shanfeld files in every division of that court, so a client’s home address does not limit the firm’s reach.

Why Choose Wadhwani & Shanfeld for Debt Relief in Tustin

Wadhwani & Shanfeld serves Orange County, Los Angeles County, Riverside County, and San Bernardino County, helping individuals, families, and small business owners resolve debt through bankruptcy, settlement, and negotiation. Clients get free consultations, direct access to an attorney from the first call, and fast action when a garnishment, foreclosure sale, or repossession is only days away.

Raj Wadhwani, founding shareholder and partner, is a Southwestern Law School graduate who helped pilot the Best Case Bankruptcy software in 1998 and was the first attorney to file a bankruptcy case electronically in the Central District of California. That matters in practice: filing correctly and quickly in this court is what turns an emergency into a stay. Greg Shanfeld, founding shareholder and partner, earned his law degree at the University of Southern California and has handled more than 10,000 bankruptcy cases over three decades. Together the firm has more than 90 years of combined legal experience.

The firm also handles debt problems that bankruptcy does not fix, including foreclosure defense, loan modification, second mortgage settlements, student loan debt, IRS tax debt, creditor lawsuits, and small business debt. Because it offers both bankruptcy and its alternatives, the recommendation follows the facts rather than a limited menu. Clients can handle the whole case remotely, with 100% virtual consultations available.

Common Debt Situations We Resolve for Tustin Clients

  • Credit Card Debt: Revolving balances that have grown through interest and fees are typically unsecured and dischargeable in Chapter 7, or can be negotiated down through settlement when bankruptcy is not the right fit.
  • Medical Bills: Hospital and provider balances usually carry no collateral and are generally eliminated in Chapter 7. Judgments on medical debt are renewable only once, for five years, when the unpaid principal is under $200,000.
  • Personal Loans and Payday Loans: These unsecured debts are generally dischargeable, and a lender that keeps calling after a filing is violating the automatic stay.
  • Creditor Lawsuits and Judgments: A collection firm’s suit has a response deadline, and an expired limitations period is a defense that must be raised in writing. A California money judgment is enforceable for 10 years and can be renewed.
  • Wage Garnishment and Bank Levies: Garnishment on an ordinary judgment is capped by a statutory formula, and filing bankruptcy halts most garnishments and levies immediately through the automatic stay.
  • Mortgage Default and Foreclosure: Chapter 13 can stop a scheduled sale and spread arrears over the plan, and in some cases a wholly unsecured second mortgage can be stripped off.
  • Car Repossession and Deficiencies: A repossession deficiency is an unsecured balance that Chapter 7 can discharge, and Chapter 13 can help keep a car you are behind on.
  • IRS Tax Debt: Some older income tax debt can be discharged if it meets timing rules, and other tax debt can be handled through levy relief and payment arrangements.

What to Do Right Now if Creditors Are Closing In

Start with whatever has a date on it. If you were served with a lawsuit, find the response deadline on the summons and do not let it pass; a debtor who ignores a suit invites a default judgment, and a default can lead to a garnishment or bank levy. Civil collection suits against Tustin residents are generally heard in the Orange County Superior Court, whose Central Justice Center sits in Santa Ana. Bring the summons, complaint, and any letters to a consultation as soon as you have them.

If a foreclosure is in motion, the dates are fixed by statute. A sale cannot be set earlier than three months and 20 days after the notice of default is recorded, and the notice of sale must be mailed and posted at least 20 days before the sale. A monetary default can be reinstated until five business days before the sale. If a sale date is close, call before those five business days run out. Filing bankruptcy stops the sale on filing, but timing still matters for the options you have.

For a repossession, the lender must give at least 15 days’ written notice before disposing of the vehicle, and you can request a 10-day extension of the redemption period in writing. A lender can pursue a deficiency only if it gave the required notice within 60 days of repossession.

Gather recent pay stubs, bank statements, the last two years of tax returns, a list of every creditor with approximate balances, and any court papers. Do not make payments on a very old debt just to quiet a collector; a payment cannot revive a debt that is already time-barred, but a signed written acknowledgment can restart the clock, so do not sign anything a collector sends without having it reviewed. Also avoid transferring property to relatives or paying back one favored creditor shortly before filing, which can cause serious problems in a bankruptcy case.

How California Exemptions Decide What You Keep

California has opted out of the federal exemption scheme, so filers choose between two state systems for the whole case: the standard system in the Code of Civil Procedure sections 704 and following, or the alternative in section 703.140(b). The standard system protects a homestead set by a formula tied to county median home prices with a statutory floor, which can be substantial for Orange County homeowners given local values. The alternative system has a smaller residence exemption but a wildcard that can help renters. Picking the wrong one can expose property that the other would have protected, which is why the choice gets worked out before anything is filed.

You must also have lived in California for at least 730 days to use California’s exemptions. Most clients keep everything they own, and the firm works through every available exemption before filing.

How Garnishments, Bank Levies, and Judgments Actually Work

On an ordinary judgment, a garnishment cannot take more than the lesser of 20% of weekly disposable earnings or 40% of the amount by which those earnings exceed 48 times the applicable minimum hourly wage. Biweekly, semimonthly, and monthly pay use 96, 104, and 208 times the minimum wage instead. If the local minimum wage is higher than the state’s, the local rate is used. You can also ask the court to exempt the portion of earnings shown to be necessary to support you and your family. Your employer cannot fire you because of a garnishment on a single judgment.

Bank levies work differently. California automatically protects a fixed amount in a deposit account from a levy without any claim being filed, but that protection does not apply to levies for wages owed to another, support, or debts owed to the state. A judgment lasts 10 years and a creditor can renew it, so an old judgment is not necessarily dead. A bankruptcy filing can address most of these at once.

Tustin Debt Relief Questions, Answered

How fast can filing bankruptcy stop a garnishment or lawsuit?

The automatic stay takes effect the moment the petition is filed, and creditors must stop collection. In an emergency, the firm can often prepare and file quickly to stop a sale or levy.

Is debt settlement better than bankruptcy?

Sometimes. Settlement can make sense when the debt is manageable and you can fund the payoffs. Bankruptcy is stronger when debt is large, creditors are suing, or you cannot afford settlement payments. The firm handles both, so the recommendation depends on the numbers.

Which debts can bankruptcy eliminate?

Most unsecured debts, including credit cards, medical bills, personal loans, payday loans, and deficiency balances. Some older income taxes qualify under timing rules. Child support, alimony, most student loans, most government fines, and debts from drunk driving injuries generally cannot be discharged.

Will I lose my home in Chapter 7?

Most clients keep their homes. The question is whether your equity is protected by California’s homestead exemption and whether you are current on the mortgage. If you have more equity than the exemption covers or you are behind, Chapter 13 can let you keep the home and catch up over time.

Do I have to go to the Santa Ana courthouse?

Orange County filings go through the Santa Ana Division of the U.S. Bankruptcy Court for the Central District of California. The firm handles cases remotely, and a required meeting with the trustee and any hearings are managed with your attorney’s guidance.

The collector says the debt is too old to sue on. Is that true?

A written contract debt can be sued on for four years and an oral contract debt for two. But the deadline is a defense you must raise in a written answer, or the court can still enter judgment. A payment will not revive a time-barred debt, though a signed written acknowledgment can.

Can a debt collector in California be sued for harassment?

Yes. The Rosenthal Act covers original creditors as well as collection agencies. A consumer can recover actual damages, an additional $100 to $1,000 if the violation was willful and knowing, and attorney fees. The suit must be filed within one year, and a collector can avoid liability by correcting a curable violation within 15 days of learning of it.

Can I file again if I filed bankruptcy before?

Yes, subject to waiting periods: 8 years between Chapter 7 filings, 4 years to file Chapter 13 after a Chapter 7, 2 years between Chapter 13 filings, and generally 6 years to file Chapter 7 after a Chapter 13.

Will my employer find out I filed?

Not automatically. They might learn if they are a creditor, if a garnishment has to stop, or if Chapter 13 payments are deducted from your paycheck. Your employer cannot fire you solely for filing.

Can a document preparer file my case instead of a lawyer?

A petition preparer can type forms but cannot give legal advice, pick your exemption system, or represent you if a trustee or creditor objects. Errors can cost you property or your discharge.

How long will bankruptcy stay on my credit report?

A Chapter 7 can remain for up to 10 years from filing, and a Chapter 13 is typically removed after 7 years. The effect on your score fades well before then, and many clients begin rebuilding within the first year.

What if my paycheck is garnished and I cannot cover rent?

You can ask the court to exempt the part of your earnings needed to support your family, and a bankruptcy filing stops most garnishments entirely. Speak to an attorney quickly, since each pay period matters.
