West Hollywood Debt Settlement Lawyer

A creditor’s lawsuit lands on a West Hollywood doorstep, or a wage garnishment notice shows up at the office, and suddenly a debt that was a monthly worry becomes a deadline. Wadhwani & Shanfeld is a consumer bankruptcy and debt relief law firm that handles Chapter 7, Chapter 13, and out-of-court negotiation for clients in West Hollywood and across Los Angeles County, Orange County, Riverside County, and San Bernardino County.

A West Hollywood debt settlement lawyer negotiates directly with a lender or collector to resolve what you owe for less than the full balance. Settlement is not a one-size answer. It works best when there is a real reason the creditor should accept less, such as a credible alternative of bankruptcy, a debt that is aging toward its legal expiration, or a lawsuit the creditor would rather not spend money pursuing.

The leverage in a settlement conversation comes from the law, not from pleading. Knowing how long a creditor has to sue, what a judgment can actually reach, and what bankruptcy would do to the debt is what turns a lowball offer into a number a creditor will accept.

How a Debt Settlement Case Usually Unfolds

Most settlements follow a rhythm. First comes an honest look at the whole picture: every debt, your income, your property, and whether anyone has sued yet. That review decides whether settlement is the right tool at all. If your debts are large, your income is limited, and creditors are already suing, bankruptcy may do more for you than negotiation. We say so when that is the case.

If settlement is the right path, the attorney contacts the creditor or its collection counsel and opens negotiations. Early offers are usually low on both sides. Creditors counter, and the back-and-forth can take weeks. A settlement may be paid as a lump sum, which typically earns the biggest discount, or in installments over a set period.

Once terms are agreed, they should be put in writing before any money moves. The written agreement should state the amount, the payment schedule, and that the account is resolved in full. If a lawsuit is pending, the agreement should also address dismissal of the case.

Not every creditor settles. Some refuse, some sell the account to a buyer who starts the negotiation over, and some push ahead with litigation. A good plan accounts for that from the start, with bankruptcy held in reserve as the fallback.

Why Choose Wadhwani & Shanfeld for Debt Settlement

The firm is led by two Board-Certified Specialists in Consumer Bankruptcy through the American Board of Certification, and its attorneys bring more than 90 years of combined legal experience. That depth matters for settlement because a creditor negotiates differently when it knows the lawyer across the table can file a bankruptcy case the same week.

Raj Wadhwani, a founding shareholder and Southwestern Law School graduate, helped pilot the Best Case Bankruptcy software in 1998 and was the first attorney to file a bankruptcy case electronically in the Central District of California. Greg Shanfeld, also a founding shareholder, earned his law degree at the University of Southern California and has handled more than 10,000 bankruptcy cases over three decades. The firm files in every division of the U.S. Bankruptcy Court for the Central District of California.

Because the firm handles bankruptcy and its alternatives, the recommendation you get is based on what works for your finances, not on the only service a firm happens to offer. Clients get direct access to an attorney from the first call, a free consultation, and the option of handling everything by phone, email, video, or online chat, including 100% virtual consultations. When a garnishment, foreclosure sale, or repossession is days away, the firm moves fast.

Debts That Settlement Can Address

  • Credit Card Debt: Often the strongest settlement candidate. Balances that have grown through interest and fees can frequently be resolved for a fraction of what is owed, especially when the alternative is a lawsuit or bankruptcy.
  • Personal Loans: Unsecured loans from banks, online lenders, and finance companies can be negotiated the same way, including accounts that have been charged off or sold to a debt buyer.
  • Medical Bills: Providers and their collectors often accept reduced payoffs, particularly when the account has gone to collections.
  • Creditor Lawsuits and Judgments: A suit from a collection firm can still be settled, sometimes at a steep discount, and an entered judgment can be negotiated down or paid off on terms that stop wage and bank levies.
  • Second Mortgage Settlements: A second lien that is underwater can sometimes be settled for less than the balance, or addressed through Chapter 13 if it is wholly unsecured.
  • IRS Tax Debt: Representation with the IRS can stop levies and set up payment arrangements, and some older income tax debt may be eligible for discharge in bankruptcy.
  • Student Loan Debt: Most student loans cannot be discharged in bankruptcy, so strategy focuses on the repayment options and negotiation tools that fit the loan type.
  • Small Business Debt: Owners carrying business credit lines or personal guarantees can negotiate or, where needed, use small business bankruptcy tools.

What to Do When a Collector Is Pressing You in West Hollywood

Start by gathering paper. Collect every letter, summons, and statement you have received, and note dates you were served. If you have been sued, the response deadline is short and cannot be ignored. West Hollywood sits within Los Angeles County, and consumer debt suits there are filed in Los Angeles County Superior Court, which operates courthouses including the Hollywood courthouse and the Stanley Mosk Courthouse in the Central District.

Do not ignore a lawsuit. If you do not file a written answer, the court can enter judgment against you by default, even on a debt that is too old to sue on. The expired deadline is a defense, but only if you raise it.

Be careful with small payments and casual statements on old accounts. A written, signed acknowledgment of a debt can restart the limitations period, though a payment alone cannot revive a debt that is already time-barred. Still, saying the wrong thing on a recorded call can complicate a negotiation. Talk to an attorney before you discuss payment with a collector.

Know what a collector cannot do. California’s Rosenthal Act covers original creditors as well as third-party collectors. A consumer can recover actual damages and, for willful and knowing violations, an additional award between $100 and $1,000, plus attorney fees if the consumer prevails. The suit must be brought within one year, and a collector can avoid liability by fixing a curable violation within 15 days of learning of it. Keep a log of every call.

If a garnishment or bank levy is already hitting, call right away. Filing a Chapter 7 or Chapter 13 case triggers the automatic stay, which stops most collection actions the moment the petition is filed. Bankruptcy filings for West Hollywood residents are assigned by street-address zip code, using the Central District of California court’s locator tool, and most Los Angeles County addresses go to the Los Angeles Division.

Time Limits, Judgments, and the Leverage They Create

Settlement strategy depends heavily on the calendar. In California, a creditor generally has four years to sue on a written contract and on a book account, and two years on an oral contract. Credit cards and personal loans typically fall under the four-year rule. A creditor suing on an expired debt is in a weak position, but the court will not raise the defense for you.

If a judgment has already been entered, it is enforceable for 10 years and can be renewed. Recent law limits renewal to a single five-year extension for personal debt judgments under a set principal amount and for qualifying medical expense judgments. That cap changes how long a judgment hangs over you and how a creditor weighs a settlement.

Judgment enforcement has limits too. Wage garnishment on an ordinary judgment is capped by a formula that takes the lesser of 20% of weekly disposable earnings or 40% of the amount by which those earnings exceed 48 times the minimum wage, with different multipliers for biweekly, semimonthly, and monthly pay. If the local minimum wage is higher than the state’s, the local rate is used. You can also claim as exempt the portion of earnings you can show is needed to support yourself or your family. An employer cannot fire you because of garnishment on a single judgment.

Bank levies carry an automatic protection: California applies a deposit account exemption without your filing a claim, and the bank must apply it before turning money over. It does not apply to levies for wages owed to another person, support, or debts owed to the state.

When Bankruptcy Beats Settlement

Settlement only helps if you can fund the deals. Paying creditors one at a time requires cash, and when debts are large and income is thin, the money simply is not there. Chapter 7 can eliminate qualifying unsecured debt such as credit cards, medical bills, and personal loans, and most cases finish in roughly four months. Eligibility turns on the means test, which compares your income to the California median for your household size.

Chapter 13 fits people with steady income who need structure. Debts are reorganized into one payment over three to five years, which can stop a foreclosure sale, catch up missed mortgage payments, and in some cases strip off a wholly unsecured second mortgage.

California does not use the federal exemptions. Filers choose one of two state systems for the whole case: one with a substantial homestead protection for homeowners, and another with a flexible wildcard that often suits renters. You generally must have lived in California for 730 days to use these exemptions. In West Hollywood, where many residents rent, that choice is a real strategic decision, and most clients keep everything they own.

Foreclosure timing also matters if the debt is a mortgage. A sale cannot be set until roughly three months and 20 days after the notice of default is recorded, and a monetary default can be reinstated up to five business days before the sale. Vehicle repossession has its own protections, including a 15-day written notice before disposal and a requirement that a deficiency claim rest on a proper notice given within 60 days.

West Hollywood Debt Settlement FAQs

How much less than I owe will a creditor accept?

There is no fixed discount. The outcome depends on the creditor, how old the account is, whether it has been sold to a debt buyer, and what the creditor believes it would recover otherwise. Lump-sum offers generally get better results than installments.

Will settling a debt hurt my credit?

A settled account is typically reported as settled for less than the full balance, which is a negative mark. Accounts already delinquent or in collections have usually done much of the damage already. Credit can recover over time with on-time payments and low balances.

Is forgiven debt taxable?

Canceled debt can be treated as income by the IRS, and a creditor may send a tax form for the forgiven amount. There are exceptions, including insolvency. Discuss this with your attorney or a tax professional before you sign a settlement.

Can a creditor sue me while we negotiate?

Yes. Negotiating does not pause a lawsuit. If you have been served, the response deadline keeps running, so a written answer must still be filed even while talks continue.

What if the debt is too old to sue on?

For written contracts and book accounts, the filing window is four years; oral contracts allow two. An expired deadline is a defense you must raise in a written answer. A payment will not revive a time-barred debt, but a signed written acknowledgment can restart the clock.

Should I settle with one creditor or all of them?

It depends on your cash and your risk. Settling one account while others go to judgment can leave you exposed. A full review of every debt comes first, so settlement money goes where it protects you most.

Can a collector garnish my wages for a debt I settle?

Not if the settlement is honored and documented. Garnishment generally requires a judgment. If a judgment already exists, the settlement should address it explicitly so enforcement stops.

Is it worth hiring a lawyer for a small debt?

Often yes, if a lawsuit has been filed. A default judgment on even a modest balance can lead to wage garnishment or a bank levy, and the cost of responding properly is usually less than the cost of ignoring it.

Can settlement and bankruptcy be combined?

Sometimes. A client might settle one stubborn account, such as a second mortgage, and use bankruptcy for the rest. Because the firm handles both, the plan can be built around the combination that fits.

What happens to a judgment after ten years?

A California money judgment is enforceable for 10 years from entry. After that it cannot be enforced unless it was properly renewed, and liens created by enforcement are extinguished. Recent law limits how renewals work for many personal and medical judgments.

Do I have to come in to the office to get started?

No. The firm handles cases by phone, email, video, and online chat, and offers 100% virtual consultations, so you can begin from home in West Hollywood.

Can my employer find out about a settlement?

Not from a settlement itself. An employer may learn of debt trouble if it receives a garnishment order, but California law bars firing an employee because of garnishment on one judgment.
